HomeMy WebLinkAbout2004.rural.GMQS.allocationsREADING ON DRAFT RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO ALLOCATING 2004 RURAL AREA RESIDENTIAL GMQS ALLOTMENTS FOR NEW SUBDIVISION LOTS AND NEWLY CREATED 35+ ACRE PARCELS TO: THRU: FROM: RE: AGENDA ITEM SUMMARY Board of County Commissioners Regular Meeting - January 12, 2005 Cindy Houben, Colmnunity Development Director Suzanne Wolff, Seuior Planner Allocation Of 2004 Rural Area Residential GMQS Allotments SUMMARY: Section 9-150-30(E) of the Land Use Code ("Code") states, "Upon receipt of the Planning and Zoning Commission Resolution forwarding their ranking and final scores, tbe Board of County Commissioners may by resolution, allocate development allotments to the eligible applicants...." The Planning and Zoning Commission's scores for tile following applications for 2004 Residential GMQS allotments for new subdivision lots and newly created 35+ acre parcels were forwarded to the BOCC on December 15~ 2004: Jelinek Lot 1E (Crystal Island Ranch Subdivision/PUD): Prince Creek Ranch 1, LLC and Richard Jelinek are requesting 5,000 square feet of floor area in the Crystal Area. Jelinek Lot 9W (Crystal Island Ranch Subdivision/PUD): CIR 7 Ranch, LLC and Richard Jelinek are requesting 5,000 square feet of floor area iii the Crystal Area. There are 10,000 square feet available in the Crystal Area for the 2004 residential GMQS competition for new subdivisions and newly created 35+ acre parcels. Tile Commission gave the Jelinek Lot 1E application a score of 49 points and the Jeljnek Lot 9W application a score of 53 points, therefore, both lots are eligible for the requested development allotments. RECOMMENDATION: Staffrecommends tbat tile Board approve a motion "to adopt a res01ution stating that an allocation of 5,000 square feet shall be granted to each of the Jelinek lots in the 2004 Rural Area Residential GMQS competition for new subdivision lots and newly created 35+ acre parcels." G:counly/planning/GMQS/rural areas/subdivision/2004/2004 allot new sub.doc RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, ALLOCATING 2004 RURAL AREA RESIDENTIAL GMQS ALLOTMENTS FOR NEW SUBDMSION LOTS AND NEWLY CREATED 35+ ACRE PARCELS Resolution No. -2005 RECITALS 1. On December 7, 2004, the Planuing and Zoning Commission ("Commission") held a duly aoticed public hearing at which time evidence and testimony was presented with respect to Rural Area Growth Management applicatious. 2. The Commission reviewed the following application for the 2004 Rural Area Residential GMQS competition for new subdivisiou tots and newly created 35+ acre parcels: Jelinek Lot 1E (Crystal Island Ranch Subdivision/PUD): Prince Creek Ranch 1, LLC and Richard Jelinek are requesting 5,000 square feet of floor area in the Crystal Area.. The parcel is located south of Carbondale, Colorado, is accessed from Prince Creek Road, and is legally described as Lot 1 E, a parcel of land situated in tile S½ SE~A of Section 24 and the NE~A of Section 25, both in Township 8 Soutb, Range 88 West of the 6th P.M. Jelinek Lot 9W (Crystal Island Ranch Subdivision/PUD): CIR 7 Rauch, LLC and Richard Jelinek are requesting 5,000 square feet of floor area in the Crystal Area. The parcel is located four miles south of Carbondale, Colorado, is accessed from Highway 133 via Thomas Road, and is legally described as Lot 9W, a parcel of land situated in the E½ of Section 22 in Township 8 South, Range 88 West of the 6"~ P.M. 3. There are 10,000 square feet of floor area available in the Crystal Area for the 2004 residential GMQS competition for new subdivisions and newly created 35+ acre parcels. The Commission gave the Jelinek Lot 1E application a score of 49 points and the Jelinek Lot 9W application a score of 53 points. Both applications met the minimum threshold score of 48 points, and, therefore, are eligible for the requested development allotments. 5. Pursuant to Section 4-60-060 of the Code, the Comnaissioh's scores were forwarded by resolution to tbe Board of County Commissioners ("BOCC") at a regular meeting on Decelnber 15, 2004. 6. No appeals to tbe scoring have been filed witbin the required time frame. NOW, THEREFORE BE IT RESOLVED by the BOCC that it does hereby allocate 5,000 square feet of floor area to Jelinek Lot 1E and 5,000 square feet of floor area to Jelinek Lot 9W as a result of the 2004 Rural Area Residential GMQS competition for new subdivision lots and newly created 35+ acre parcels. This allocation is conditioned upon recordation ora covenant docume~ting the represeutatious made in the application for the additional square footage. This covenant shall be reviewed aud approved by Community Developmeut Department and recorded against the properties, prior to issuance of a building permit to ntilize the awarded floor area. Tbis grant of allotments is contingent upon final approval and recordation of the final plat of the Crystal Island Ranch Subdivision/PUD. Resolution No. -2005 Page 2 Statutory vested rights for approval granted herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to exceptions set forth in Pitkin County Land Use Code Section 4-140 and C.R.S. 24-68-105. The vested rights for this approval shall expire on January 12, 2008.
