ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY,COLORADO,REZONING THE FOLLOWING PROPERTIES FROM
RURAL/REMOTE TO AFR-10: DEARHAMER,DE GIUSTI,F PAN LLP,LIME CREEK
COLONY LLP,DUSTMAN AND DLUGOS

RECITALS
1. Stanley Dearhamer("Applicant")has applied to the Board of County Commissioners of Pitkin
County,Colorado("BOCC")to rezone the portion of his property that is zoned Rural/Remote to AFR-10.
2. The Applicant's property contains 163.8 acres and is located northeast of Thomasville and extends
from the Frying Pan River up Lime Creek and along Lime Creek Road,and is more specifically described in
Exhibit A.
3. The Pitkin County Planning and Zoning Commission considered the proposed rezoning at a
regularly scheduled meeting on November 9, 1999,and recommended approval by a vote of 5-0.
4. The Commission also recommended that the six other properties that are surrounded by the
Dearhamer property also be rezoned from Rural/Remote to AFR-10. Therefore,this rezoning would also
affect the metes and bounds parcels owned by Oghi and Barbara DeGiusti,Dale and Gale Coombs, F Pan
LLP, and Lime Creek Colony LLP,which are more specifically described in Exhibit B;Parcel 1,Justman/
Dearhamer Subdivision Exemption,owned by RobertJustman; and Lot 1,Dlugos/Dearhamer Subdivision
Exemption,owned by Thomas P.Dlugos.
5. The BOCC considered the proposed rezoning at a duly noticed public hearing on first reading on
January 12,2000, and voted to approve the proposed amendments on second reading on February 9, 2000.
6. The BOCC finds that the properties are accessed and traversed by a winter maintained public road /
(Lime Creek Road),and,therefore, a mapping error resulted in the rezoning of these properties from
AFR-10 to Rural/Remote in 1995.
7. The BOCC further finds that the proposed rezoning is consistent with the applicable provisions of
the Pitkin County Land Use Code.

NOW,THEREFORE,BE IT ORDAINED by the BOCC that it hereby rezones a portion of the
Dearhamer property,and the De Giusti,Coombs,F Pan LLP,Lime Creek Colony LLP,Justman and Dlugos
properties,from Rural/Remote to AFR-10.
NOTICE OF PUBLIC HEARING published in the Aspen Times Weekly on the 1 lth day of
December, 1999 and the I st day of January, 2000.
INTRODUCED AND FIRST READ AT A PUBLIC HEARING on the 12th day of January,
2000.
APPROVED AND ADOPTED AFTER SECOND READING on the 9th day of February,2000.
PUBLISHED AFTER ADOPTION in the Aspen Times Weekly on the 14 day of F b�,
2000.
