The proposed fees represent mi approximate 4% increase over the past year. The building fee increases are identical to the fee increases adopted by the City as required by the Intergovernmental Agreement between the City and county relative to building department activities. We are proposing tile fees become effective May 25, 2005, so that there will be an entire 12 month period with the existhag fee schedule. The Board approved the ordinmice on First Reading on March 9, 2005 RECOMMENDATION: Staffrecommends the Board adopt a motion approving the new fee ordinance on Second Reading. lancec/cases/fee ordmemo2nd,doc AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, ESTABLISHING FEES FOR THE COMMUNITY DEVELOPMENT DEPARTMENT AND REPEALING AND REPLACING ORDINANCE 018-2004 Ordinance No. -2005 RECITALS Pitkin County proposes to set fees for tile Community Development Department that are consistent and fair to the public and reflect the expense incurred in providing such services to the public. Certain fees currently charged for development review no lon.ger reflect the cost of providing the necessary levels of such services. The policy of the Pitkin County Board of County Commissioners is that development shall pay, in full, the cost of development review in Pitkin County. Long Range planning shall be funded through the general fund. Payments due to the County for obligations due to sales and tax are not regarded as fees and therefore not included in the Ordinance. The Ordinance does not reflect an encompassing fee schedule. Planning fees are proposed to be increased by 4% this year, with the fees to be reviewed annually rather than making large increases every several years. Tile Intergovernmental Agreement between tile County and file City of Aspen Community Development Departments requires that building fees be consistent witb the City of Aspen in order to make the building permitting process seamless for the public. Tile BOCC considered tile proposed fees at a first reading and public bearing on March 9, 2005, mid voted to approve the proposed fees on second reading oil March 23, 2005. NOW, THEREFORE, BE IT ORDAINED by tile BOCC that it does hereby adopt fees for tile Community Development Department as follows: 3. 4. 5. 6. 7. In the event that the fees that result from accumulation are found by the Community Development Director to be excessive in relation to the number of hours it is anticipated to require to process the application, the Community Development Department may waive or adjust the accumulation requirement. 2. Additional charges shall be billed on an hourly basis beyond the base fee only if the time exceeds the average by more than 20% in the processing of an application. 3. Public Notices for Code Amendments will be billed for actual costs. 4. Additional charges shall be computed at the rate of two hundred and twenty-four dollars ($224.00) per hour of additional Community Development Department staff time required The Community Development Department shall identify, prior to or at the time of snbmission of a land use application, whether an application is to be referred to the County Engineer, Wildlife Biologist, Housing Office, Environmental Health Department, Airport or RFTA. Additional charges will apply as shown below. 6. An applicant may request that the BOCC waive fees for projects serving a public purpose, proposed by a non-profit organization, or in order to dispute the fee charged. B. The total Fire Sprinkler Permit fee is the total of the permit and the plan check fees. Excavation/Foundation Fees 1. The excavation/foundation permit fee is 35% of the building permit fee.
