APPROVING THE S1EMEL APPEAL
OF A DENIED BUILDING PERMIT APPLICATION

RECITALS
1. Mr. Carlton Siemel and Ms. Sallie Golden ("Appellants") have appealed to the Board of County
Commissioners of Pitkin County, Colorado ("BOCC") to consider the Zoning Officer's denial of Bnilding
Permit Change Order Application # 1402.2004, to change the access to an area "below grade".
2. The application was denied because it did not comply with the Zoning Officer's interpretation of the
de£mition of Floor Area with regard to how "below grade" areas can be accessed and still be exempt from
floor area calculations.
3. The subject property is located at 701 Meadowood Drive and is otherwise known as Lot 3, Block 2,
Filing 1, Meadowood Subdivision.
4. The BOCC heard this request at a public meeting on February 23, 2005, continued it to March 9, then
again to April 13, 2005, at which times evidence and testimony were presented with respect to the
application.
5. The BOCC finds that the Applicants acted in good faith in trying to understand the below grade
regulation and in desi~ening their residence in accordance with that understanding.
NOW, THEREFORE, BE IT RESOLVED by the BOCC that it hereby upholds the Sierael.appeal
of the Zoning Officer's denial of Building Permit Application # 1402.2004.
