COUNTY, COLORADO, APPROVING A TEMPORARY COMMERCIAL USE
PERMIT FOR CHERYL SOVICH TO OPERATE A LANDSCAPING BUSINESS
FROM THE ASPEN QUICK MART FOR THE SUMMER OF 2005

RECITALS
Pursuant to Subsection 3-200-030 of the Pitkin County Land Use Code,
the Board of County Commissioners of Pitkin County, Colorado ("Board")
may approve a Temporary Commercial Use Permit for commercial
activities or special events of more than 72 hours duration.
Cheryl Sovich (hereafter, the "Applicant") has applied for approval of a
Temporary Commercial Use Permit to operate a wholesale landscape
business from the Aspen Quick Mart site at 31336 Highway 82 for the
summer of 2005.
The Board considered this application at a duly noticed public hearing on
April 13, 2005, at which time evidence and testimony were presented.
The Board finds that, to the extent applicable, the application complies
with the standards in Subsection 3-200-030 of the Land Use Code.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY THAT the Cheryl Sovich Temporary
Commercial Use Permit is approved, subject to Applicant's compliance with each
of the following conditions:
1. Applicant shall adhere to all material representations made in, or in
connection with, the application.
2. There shall be no retail sales or signage associated with the use,
except to note that there are no retail sales on the premises.
3. The dates of operation are limited to from April 15, 2005, to October
15, 2005.
4. At the completion of operations the site shall be restored to its previous
condition.
5. Daily hours of operation are limited to from 7:00 am to 7:00 pm.
6. Employee commuting shall be consolidated to a maximum of four
vehicles to preserve parking for the Quick Mart.
