BOARD OF COMMISSIONERS
Resolution 75-~7
WHEREAS, Martin Heller, through his representative Robin
Molny, has made application for Special Review approval of the duplex living
unit in Woody Creek, and
WHEREAS, Mr. Heller has received a set-back variance from the
Pitkin County Board of Adjustment due to terrain hardships for construction
of this building, and
WHEREAS, said additional living unit is of minimal size -
480 square feet - and proposes to be constructed only for long-term
caretaker type use, and
WHEREAS, the Pitkin County Planning and Zoning Commission has
reviewed said application at their April 2, 1975, meeting.
NOW, THEREFORE BE IT RESOLVED that the Pitkin County ComMissioners
approve said application with the following condition:
That no building permit will issue until the Pitkin County
Co~nissioners receive an approved covenant limiting it to
long term rental only and to occupancy by a caretaker or
other person employed on the premises.
