HomeMy WebLinkAboutbocc.res.048.1975 PITKIN COUNTY BOARD OF COMMISSIONERS RESOLUTION 75--f~/ WHEREAS, Douglas Tompkins has applied for Special Review approval of a duplex housing structure in the Woody Creek area pursuant to the procedures outlined in the Pitkin County Zoning Resolution, and WHEREAS, the Pitkin County Planning and Zoning Commission has reviewed said application at their April 9, 1975 meeting, and WHEREAS, Mr. Tompkins has received a variance from the ?itkin County Board of Adjustment for a duplex unit from the non-conforming lot section of the Pitkin County Zoning Resolution and such variance constitutes a use variance which appears to be not within the powers of the Board of Adjustment, and WHEREAS, proof of right of access and use to the Lemoy Subdivision road was not presented at the Public Hearing and thus it cannot be shown that the proposed use is a logical and contiguous extension of existing road facilities, and WHEREAS, maintenance agreements to include Mr. Tompkins' property for use of the Lemoy Subdivision road have not been developed and WHEREAS, definite provision has not been made for a water supply that is sufficient in terms of quality, dependability, quality and fire protection capability, and WHEREAS, the proposed use is inconsist~t with a conti~guous and orderly pattern of development within the County. NOW, THEREFORE BE IT RESOLVED that the Pitkin County Commissioners hereby deny the Special Review Application of Douglas Tompkins for a duplex dwelling unit.
