WHEREAS, Ralph P. Melville and Marion B. Melville are
the present owners of Lots E, F, G, H, & I, Block 84, City and
Townsite of Aspen, having purchased the property in 1969, and
WHEREAS, on July 25, 1962 the Pitkin County Treasurer
issued certificate number 931, certifying that there were no back
taxes due upon Lots F, G, H, & I, Block 84 except for taxes due
for the year 1961, and
WHEREAS, in fact taxes were and are owed upon Lots F
and G for the years 1944 through 1951 in the amount of $119.62,
together with interest thereon in the amount of $253.62, and
WHEREAS, the Melvilles relied upon certificate number
931 when they purchased the property, and
WHEREAS, Section 39-10-115, C.R.S. 1973 provides that
any loss resulting to a person from an error in a tax certificate
is to be born by the county,
NOW, THEREFORE BE IT RESOLVED that the taxes in the
above amounts upon Lots F and G, Block 84, City and Townsite of
Aspen from 1944 through 1951 are hereby abated and cancelled
pursuant to law; a copy of this resolution shall be sent to the
Treasurer and to the Melvilles, who may record the instrument
to reflect the abatement of these taxes; and a copy shall be
forwarded to the Colorado Department of Property Taxation.
