HomeMy WebLinkAboutbocc.res.061.1975 RESOLUTION BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO NO. 75- 61 Re-designation of Trails WHEREAS, Pitkin County is cooperating with the City of Aspen, private property owners who grant trail easements over their land, the federal government, the State of Colorado, and the U.S. Forest Service in the creation, maintenance, regulation and policing of county pedestrian, bicycle and equestrian roads, hereinafter called the Pitkin County Trail System, and WHEREAS, the Pitkin County Trail System is defined as those trails heretofore designated as Pitkin County secondary roads by resolution No. 75-3 of the Board of County Commissioners of Pitkin County, Colorado and dated January 20, 1975 (hereinafter referred to as resolution 75-3), and therein set forth as Pitkin County secondary roads on the Pitkin County Trail System map on file at offices of the City/County Planner and the Pitkin County Land Use Administrator; and WHEREAS, the County Trail System serves the public purposes of recreation, tourism, emergency access, commuting, enjoyment of nature and the reduction of reliance upon the automobile and other motorized vehicles, and WHEREAS, Pitkin County is desirous of continuing the maintenance of the rules and regulations heretofore adopted by Resolution No. 75-3 concerning the use of the Pitkin County trail system as therein defined, under the more clearly defined authority of House Bill No. 1395, NOW, THEREFORE, BE IT RESOLVED: 1. That the trails and designated trail-head parking lots that are part of the Pitkin County Trail System, as set forth on the Pitkin County Trail System map, hereto- fore designated as Pitkin County secondary roads by reso-¥~ lution No. 75-3 are hereby declared to be, and are~de~ ignated as, Pitkin County Trails. 2. That the rules and regulations concerning the use of the Pitkin County Trail System adopted by resolution No. 75-3 of the Board of County Commissioners and dated 20, 1975, shall continue to be in full force and January effect in all particulars, ~[~s hereinafter ~~-~' upon the Pitkin County Trails as herein defined. 3. That the following continue to be the rules and regulations concerning the use of the Pitkin County Trail System: (a) That no motorized vehicles whatsoever including automobiles, motorbikes, motorcycles, motorscooters, go-carts, snowmobiles and the like, except County Maintenance, Police, Fire, Ambulance and emergency vehicles are permitted to use the Pitkin County Trail System. The Sheriff's Office, County Manager, County Road Supervisor, Ambulance Service, Aspen Police Department and Aspen Fire Department shall have keys to the entrance gates, and in the event of an emergency, shall have the discretion to permit emergency vehicles to enter upon the trails. Special permission may be granted by the County Manager for special events upon the Pitkin County Trail System wherein it may be necessary or desirable for motorized vehicles to enter upon the trail system for a limited time to be specified in a permit; provided, however, that such special permits shall not conflict with pro- visions of easements across private property. Horse-drawn vehicles, bicycle-drawn vehicles, sleigh-type vehicles, and the like shall be allowed to use the trails by special permit only, said special permit to be granted, in his discretion, by the County Manager. (b) That the special conditions and provisions which constitute limitations of usage of trail ease- ments granted to the County or to the United States Forest Service by private landowners, which special provisions shall be posted, shall be enforced under the provisions of this resolution as if they were set forth herein. (c) That, where it is so specifically posted, it shall be unlawful to leave the trail at such points as the trail passes on or through private property. The County shall enforce and prosecute any violation of this rule under paragraph 4 hereof, and, if necessary, as a trespass on behalf of both the County as holder of the easement and on behalf of the owner of the land trespassed upon. (d) That where posted, dogs shall not be per- mitted, and where posted, dogs shall be on a leash at all times. (e) That trail users shall stop at all roads and yield to any automobile traffic, unless posted otherwise. The County will also post signs along automobile roads warning of a trail crossing. (f) That bicycles shall yield to horses and pedestrians, horses shall yield to pedestrians, and both shall reduce their speed to a safe and cautious speed when passing bicycles, horses or pedestrians, whether said passing is oncoming or overtaking. All users of the trail shall obey any posted warning, caution or other signs. Horses shall be restricted to the unpaved portions of the trail unless otherwise posted. Users of the paved trails shall keep to the right half of the pavement at all times. Bicycles and horses shall travel at a safe speed at all times. (g) That the following are unlawful if done on the trails or if done on adjacent property if access thereto is achieved through the trail system: loud noises; the use of horns and bells; the use of firearms or fireworks; littering; obstructing the trail system; defacing, cutting, blazing or carving of the trees, fences or vegetation on the trail system or adjacent properties or of the trail signs, markers, bridges or structures; camping and campfires, except in designated areas; and overnight camping. (h) That persons who use the trail system after dark, especially during the late night and early morning hours, shall be especially careful to avoid making noises that might disturb residents near the trail system. (i) That persons who witness violations of these rules and regulations should report such violations to the County by calling 925-6527, or 925-3232. -4- 4. That these rules and regulations may be amended from time to time by the Pitkin County Board of Commissioners. These rules shall apply to existing trails and parks, and to such trails and parks as are from time to time added to the Pitkin County trail system and designated on the official map thereof. 5. That it is a class 3 misdemeanor for any person to violate any of the provisions of this resolution. Any person convicted of a class 3 misdemeanor is punishable in county court, pursuant to Section 18-1-106, C.R.S. 1973, by a fine of from $50.00 to $750.00, or by imprisonment for up to six months, or both. 6. That, pursuant to Section 29-7-101(b), C.R.S. 1973, as amended, it shall be the duty of the sheriff, his under-sheriff and deputies to enforce these rules and regulations.
