HomeMy WebLinkAboutbocc.res.091.1975REcorded ~2 PM Ember 9, 1975 Reception no PIIKIN COUNTY BOARD OF COMMISSIONERS RESOLUTION NO. 75-91 Julie Hane Recorder , oo, 306 SPEER SUBDIVISION EXEMPTION October 6. 1975 WHEREAS, Mr. David Speer has applied for an exemption from the definition of the term "subdivision" pursuant to Section 1.4 (B) of the Pitkin County Subdivision Regulations in order to divide a 42.59 acre parcel located in Little Woody Creek into two separate parcels consisting of 32.58 acres and 10.01 acres, and WHEREAS, each parcel consists of an existing single family residence serviced by separate wells, sewer systems, and access roads, and WHEREAS, the Pitkin County Sanitarian has inspected water and sewer systems for both existing residences and found them to be in conformance to local health regulations, and WHEREAS, residents of the Little Woody Creek area have expressed no opposition to the granting of this exemption provided the below listed restrictions are imposed and strictly enforced, and WHEREAS, the Pitkin County Planning and Zoning Commission on August 6, 1975, approved the exemption request subject to conditions which are incorporated in this resolution, NOW THEREFORE BE IT RESOLVED, that the Pitkin County Com- missioners hereby approve the exemption request for David Speer with the following conditions and restrictions: 1. No further subdivision of the property be allowed; 2. No further guest houses or dwelling units be constructed; 3. That the existing residences not be leased for less than six (6) months; COMMISSIONERS RESOLUTION SPEER SUBDIVISION EXEMPTION 306 4. That all water rights appurtenant to the property be retained within the Little Woody Creek drain- age basin, or, with the consent of the Board of County Commission of Pitkin County, retained elsewhere in the Roaring Fork basin; 5. That no structures of any kind shall be con- structed to the south of the Little Woody Creek Road except those solely for agricultural or fam use, if then permitted by zoning; and 6. That the exemption resolution be filed of record together with the declaration of protective covenants in the office of the Pitkin County Clerk and Recorder.
