RE: 1041 Designations of Areas of State Interest WHEREAS, a public hearing to consider the designation of geologic hazard areas, floodplains, wildfire hazard areas, historic and archaeological areas, wildlife habitat areas, and areas around rapid or mass transit terminals, stations and fixed guideways was held on November 3, 1975, and WHEREAS, the Board has taken into consideration the Guidelines for Identification and Designation issued by the Colorado Land Use Commission and the intensity of current and foreseeable development pressures, and WHEREAS, Guidelines for Designation (model regulations) for specific matters of State interest have not yet been adopted by the Colorado Land Use Commission, and WHEREAS, the County has identified through the Environ- mental Resources Analysis, Colorado State University, 1974, certain environmental hazards including geologic, floodplain and wildfire hazards, and environmental resources including wildlife habitat and historic and archaeological resources, and WHEREAS, the County had identified a proposed mass transit alignment in the report, Light Rail Transit~ Community Criteria for Final Design, Citizen Transit Design Committee, July, 1975, and WHEREAS, the boundaries of the above-mentioned areas of State interest shall be as they appear on the following maps: A. Geologic Hazard Areas Ail potential geologic hazard areas mapped on the Colorado State University Environmental Resources Analysis (CSU/ERA) "Potential Geo- logic Hazards Maps". 2. Areas mapped as having slopes of 30% or greater on the CSU/ERA "Slope Maps." Avalanche areas mapped on the CSU/ERA "Snow Avalanche Areas Maps;" except that those areas mapped as "high and moderate hazard zones" on the "Snow Avalanche Hazard Zones Map," prepared by Art Mears for the Colorado Geological Survey (Aspen Quadrangle, 1975) shall replace the historic but not the potential avalanche area designation for the unincorporated area of Pitkin County in the study area covered. B. Wildfire Hazard Areas The areas mapped as severe wildfire hazard areas as denoted by "C" or "X" on the CSU/ERA "Wildfire Hazard Area Maps." C. Floodplain Hazard Areas 1. The intermediate regional flood areas as shown on maps accompanying the following reports: i Floodplain Information-Roarin$ Fork River, Castle and Hunter Creeks (Army Corps of Engineers, August, 1973. ii Floodplain Information-Roarin~ Fork River Above Aspen (Army Corps of Engineers, June 1974). D. Historic and Archaeological Resource Areas Areas lying within 1000 feet of the established boundary of the townsite of Independence, Redstone, Ruby and Ashcroft; the Osgood Mansion Property, and the Redstone Inn in Redstone; Independence Pass and Pearl Pass, all as shown on the Historic Sites Maps (Upper Roaring Fork and the High Valleys, Crystal River Valley) (Planning Office, 1975). E. Wildlife Habitat Areas 1. Ail areas mapped on the CSU/ERA "Wildlife Habitat Area Map." 2. The riparian areas as mapped on the CSU/ERA "Veg- etation Maps." The shoreland of Reudi Reservoir located in Pitkin County as mapped on the "Reudi Reservoir Map." (Planning Office, 1975). F. Areas Around Rapid or Mass Transit Terminals, Stations and Fixed Guideways Corridors around the proposed mass transit align- ments as shown on the "Transit Alignment Map" (Lower Roaring Fork) (Planning Office, 1975). WHEREAS, this Board finds that all of the above areas are matters of State interest because the rapid growth of this County in recent years has caused significant development pressures and that such development pressure has had an adverse effect on sensitive environmental resource areas, has caused danger to life and property in hazard areas, and has increased problems of con- gestion, pollution and excessive demand for public services and facilities, and that such development pressure is continuing, and areas, of the to the WHEREAS, mn¢ontrolled development in geologic hazard floodplains, and wildfire hazard areas may subject occupants development or the property itself to loss or danger due occurrence of these natural hazards, may create or worsen such conditions affecting adjacent or nearby development, or land, or may subject other persons or the County to dangers or expenses required to mitigate hazardous conditions, respond to emergencies created by such conditions or rehabilitate the develop- ment or lands, and FURTHER, that such dangers, loss or expenses may be avoided by controlling development in such areas so that any ment which is allowed to occur will take care to incorporate develop- design features based on sound engineering principles that will mitigate or avoid the hazardous condition and that any design features and construction techniques will not create or worsen such hazardous conditions, and WHEREAS, uncontrolled development in wildlife habitat and historic or archaeological areas may be destructive to valuable resources of the County which are vital to its tourist economy and to the aesthetic and recreational enjoyment of residents and visitors alike, and which constitute irreplaceable elements of its natural and cultural heritage, and FURTHER, that by controlling development in such areas the County can ensure that development will occur in a manner which allows man to function in harmony with such resources or more specifically, that development will not destroy the features of an area which make it suitable as a wildlife habitat, that any act- ivity or development be allowed to occur only to the extent that it is not disruptive to wildlife during periods of use of the habitat area, or that any alteration or development in an hsitoric site would not detract from but rather enhance the meaning of such site as representative of a period, style, occasion or unique activity, and WHEREAS, the Board has previously found that a coordinated system of mass transportation will enhance the County's tourist economy while helping to relieve the County of related problems of congestion, pollution and overburden of certain facilities and services, and, further, finds that uncontrolled development in areas around the facilities of its proposed mass transit system will adversely affect the public health, safety and welfare by increasing the public cost of aquisition and development of such a system, and further, that controlled development in such areas will facilitate the development of such a system in part- icular and County services in general in a coordinate manner, and WHEREAS, the advantages of development in a coordinated manner are also addressed in Section 2, Policies, of the proposed Pitkin County Land Use Code, in the Aspen Area General Plan, as amended, and in the Environmental Resources Analysis (Colorado State University, 1974), and revise, Comprehensive Land Use Code, which Code this Board, by taken on August 18, 1975, referred to the Planning and Commission on November 12, 1975 for comment, and WHEREAS, the County has a continuing project to combine, and improve its zoning and subdivision regulations into a action Zoning WHEREAS, a permit system and Guidelines for Administration for development within designated Areas of State Interest is inte- grated within this Code and the County intends to regulate the above matters of State Interest through adoption of such Code, and WHEREAS, the Board hereby directs the Planning Office, within two weeks, to revise and prepare the appropriate guide- lines taking into consideration any relevant new draft model regulations prepared by the Colorado Land Use Commission, and WHEREAS, the Board will consider the adoption of appropriate guidelines for administration in conjunction with its consideration of the Pitkin County Land Use Code after a public hearing which shall be noticed in the manner of a 1041 designation hearing. NOW, THEREFORE BE IT RESOLVED, by the Board of County Commissioners that geologic hazard areas, floodplain areas, wild- fire hazard areas, historic and archaeological areas, wildlife habitat areas, and areas around rapid or mass transit terminals, stations or guideways, all as mapped as referenced herein, be and hereby are designated as Areas of State Interest, and BE IT FURTHER RESOLVED, that as of this date, development applications within such designated areas shall not be acted upon by the Board or Planning and Zoning Commission until such time as the Board adopts the appropriate guidelines for administration.
