Resolution #75-98
RE: 1041 Designation of Activities of State Interest
WHEREAS, a public hearing to consider the designation
of certain activities as matters of State Interest was held on
November 3, 1975, and
WHEREAS, the activities considered include:
Site selection and construction of major new
domestic water and sewage treatment systems
major extensions of existing domestic water
sewage treatment systems,
and
and
2. Site selection and development of solid waste
disposal sites,
3- Site selection of airports,
4. Site selection of rapid or mass transit terminals,
stations and fixed guideways,
5. Site selection of arterial highways and interchanges
and collector highways,
6. Site selection and construction of major facilities
of a public utility,
7. Site selection and development of new communities,
8. Efficient utilization of municipal and industrial water
projects, and
9. Conduct of nuclear detonations, and
WHEREAS, the Board has taken into consideration the

for specific matters of State Interest have not yet been adopted by the
Colorado Land Use Commission, and

WHEREAS, the conduct of such activities in a coordinated
manner will reduce the negative impact of development pressures
and assure that the growth of the County occurs in an orderly manner
consistent with County policies and regulations, and
WHEREAS, the advantages of development in a coordinated
manner are also addressed in Section 2, Policies, of the proposed
Pitkin County Land Use Code, in the Aspen Area General Plan, as
amended, and in the Environmental Resources Analysis (Colorado
State University, 1974) and
WHEREAS, the County has a continuing project to combine,
revise and improve its zoning and subdivision regulations into a
Comprehensive Land Use Code, which Code this Board, by action
taken on August 18, 1975, referred to the Planning and Zoning
Commission on November 12, 1975, for comment, and
WHEREAS, a permit system and Guidelines for Administration
for designated activities of State Interest are integrated within
this Code and the County intends to regulate the above matters
of State Interest through adoption of such Code, and
WHEREAS, the Board hereby directs the Planning Office,
within two weeksTto revise and prepare the appropriate guidelines
taking into consideration any relevant new draft model regulations
prepared by the Colorado Land Use Commission, and
WHEREAS, the Board will consider the adoption of
appropriate guidelines for administration in conjunction with its
consideration of the Pitkin County Land Use Code after a public
hearing which shall be noticed in the manner of a 1041 designation
hearing.
NOW, THEREFORE BE IT RESOLVED, by the Board of County
Commissioners that site selection and construction of major new
domestic water and sewage treatment systems and major extensions
of existing domestic water and sewage treatment systems, site
selection and development of solid waste disposal sites, site
selection of airports, site selection of rapid or mass transit
terminals, stations and fixed guideways, site selection of arterial
highways and interchanges and collector highways, site selection and
construction of major facilities of a public utility, site selection
and development of new communities, efficient utilization of
municipal and industrial water projects, and conduct of nuclear
detonations be and hereby are designated as Activities of State
Interest, and
BE IT FURTHER RESOLVED that as of this date a permit for
the conduct of any such activity shall not be acted upon by the
Board or the Planning and Zoning Commission until such time as the
Board adopts the appropriate guidelines for administration.
