RE: Rejection of the 1041 Designation
of Mineral Resource Areas
WHEREAS, a public hearing to consider the designation
of mineral resource areas was held on November 3, 1975, and
WHEREAS, this Board has taken into consideration the
Guidelines for Identification and Designation issued by the
Colorado Land Use Commission and the intensity of current and
foreseeable development pressures, and
WHEREAS, Guidelines for Designation and Regulation for
specific matters of State interest have not yet been adopted by
the Colorado Land Use Commission, and
WHEREAS, the Board desires to regulate the extraction
and exploration of minerals so that any such activity is accomp-
lished in a manner which causes the least practicable environ-
mental disturbance, and
WHEREAS, the Board has determined that such regulation
may be accomplished more expeditiously by regulating the activity
of extraction and exploration rather than regulating all develop-
ment within $ineral resource areas, and
WHEREAS, the County has a continuing project to combine,
revise and improve its zoning and subdivision laws into a compre-
hensive Land Use Code, which Code this Board, by action taken on
August 18, 1975, referred to the Planning and Zoning Commission
on November 12, 1975, for comment, and

WHEREAS, said Land Use Code incorporates regulations for
the extraction and exploration of mineral resources, and
WHEREAS, the Colorado Land Use Commission has determined
that a local government may accomplish the goals set forth in
HB 1041 by incorporating the same kinds of criteria within its
zoning and subdivision regulations, and
WHEREAS, this Board desires to accomplish the above
mentioned goals through the adoption of the Pitkin County Land
Use Code and relevant regulations therein.
NOW, THEREFORE BE IT RESOLVED, by the Board of County
Commissioners that the designation of Mineral Resource Areas
be and hereby is rejected.
