RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,
COLORADO,APPROVING A TEMPORARY COMMERCIAL USE PERMIT FOR FOOD AND
WINE MAGAZINE FOR THE NIGHT-TIME USE OF THE GONDOLA AND THE SUNDECK
RESTAURANT FOR A PRIVATE PARTY ON FRIDAY,JUNE 9,2000
RECITALS
l. Food and Wine Magazine("Applicant")has applied to the Director for approval for night-time use of
the gondola and the Sundeck Restaurant on Aspen Mountain for a private party on Friday, June 9,2000, from
6:00- 10:30 PM.
2. Pursuant to Section 3-200-030 of the Pitkin County Land Use Code,the Community Development
Director("Director")may approve a temporary use permit for commercial activities or special events, if an
applicant demonstrates that adequate provisions have been made for police supervision,public parking,
insurance, site set-up,maintenance and clean-up,emergency services and safety of operations.
3. Night-time use of the gondola and the Sundeck was approved as part of the Aspen Mountain Master
Plan, pursuant to Resolution No.98-80,however,the Master Plan specifies that the summer season starts on
July 1. Therefore,the Director has opted to forward this request to the BOCC for review, since this event is
not authorized under the Master Plan.
4. The County's Risk Manager has reviewed and approved the insurance certificate for the event.
5. Medical or other emergencies, including evacuation of the gondola,will be handled pursuant to
the Aspen Mountain Summer Medical Emergency Treatment/Evacuation Plan, the Aspen Mountain
Gondola Evacuation Plan and the Mountain Disaster Plan. The Aspen/Pitkin County Public Safety
Council has determined that these plans are adequate.
6. The Sundeck Restaurant has a valid liquor license.
7. The BOCC finds that the proposed event benefits the entire community and complies with the
applicable standards of the Code with regard to temporary commercial uses.
NOW,THEREFORE,BE IT RESOLVED by the BOCC that it hereby approves the Food and
Wine Temporary Use Permit,subject to the following conditions.

1. Downloading of the gondola shall occur from 9:30— 10:30 PM,and the gondola shall be closed by
10:30 PM.
2. The event shall count as one of the events allowed during the summer season.
3. The Applicant shall publish notice of the event in the local newspapers at least 30 days prior to
the event.
4. Access to the Sundeck for the event by guests, staff and event personnel shall be provided by the
gondola only. Access to the event via Little Annie, Midnight Mine or Summer Roads is not
permitted.
5. Music shall not be allowed outside of the Sundeck after 7:00 PM, nor inside the Sundeck after
9:00 PM.
6. Alcohol is prohibited on the gondola for the ride down.
7. All fire alarm and fire sprinkler systems shall be on line at least one week prior to the event.
8. The Applicant shall comply with the following recommendations of the Chemical Dependency
Task Force:
A. A variety of foods and non-alcoholic beverages shall be available throughout the event.
B. All servers shall attend a training to learn how to identify when a participant has had too
much to drink.
C. Develop a plan to handle situations wherein a participant has had too much to drink.
D. Provide alternative modes of transportation home from the event.
E. If children will attend the event, provide a safe place for them to play,which is away
from the serving of alcohol and is supervised by responsible, non-drinking adults.
