Ordinance Repealing and Re-enacting
Revisions to Title 10 of the Pitkin County Code,
Final Read and Public Hearing

DESCRIPTION OF ISSUE: Tn late 2004, the County began a review of
Title 10 of the County Code, in response to the recently completed Master Plan,
to ensure consistency in airport documents. Tn early 2005, the County retained
the services of Kaplan Kirsch and Rockwell to assist in this review. The primary
intent of the review and update is to ensure that our Code is in compliance with
federal aviation law as well as the County's grant assurance obligations to the
Federal Aviation Administration. Additional goals include updating terminology,
definitions and other language throughout the document, and ensuring that the
document reflects current County and Airport policies and needs. The entire
document was reviewed, with an emphasis on definitions, general regulations,
safety, noise and minimum standards, customer service.
Due to the length of the document (approximately 80 pages), copies are
available for review on request at the Clerk and Recorder's office.
At the .~une 27th work session regarding the update of Title 10, clarification was
requested on our airport's 1.60,000 pound weight limit for aircraft with a dual
tandem landing gear configuration.
Tn the Airport Facilities Directory it publishes for pilots, the FAA is required to list
weight bearing capacities for different landing gear configurations, since aircraft
with varying numbers of wheels distribute their weight over a different
"footprint", and can thus operate at different maximum weights on the same
runway. Based on the engineered strength of our runway, the FAA has
published a 100,000 dual wheel gear weight limit, which is equivalent to a
160,000 pound aircraft with a dual tandem configuration, which they also
publish.
Tt is very important to note, however, that there are no aircraft currently
operating or in known to be in development that would be in this higher weight
category which have wingspans of 95' of less. From an aircraft engineering

standpoint, is highly improbable that there ever will be; you simply can't lift
160,000 pounds of aircraft with just 95 feet of wingspan,
Inclusion of the 160,000 pound weight limit for aircraft with a dual tandem
landing gear configuration in our operating restriction resolution ensures that we
are consistent with this FAA-required and published weight information.
This revised copy also incorporates the comments of Aspen Base Operation
discussed at the June 28th work session, along with comments from the County
Attorney's office.
STAFF RECOMMENDAT~'ON: Motion to pass on final reading and publish for
adoption, an Ordinance repealing and re-enacting Title 10 of the Pitkin County
Code.

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO REPEALING AND RE-ENACTING TITLE
10 (AIRPORT REGULATIONS) OF THE PITKIN COUNTY CODE
Ordinance No. -2005
Recitals
Title 10 of the Pitkin County Code promulgates regulations and
procedures for the operation and use of the Aspen/Pitkin County Airport.
The Board of County Commissioners ("BOCC") desires to review and
update Title 10 of the Pitkin County Code to ensure it currency, as well as
its consistency and compliance with Federal Aviation Regulations, the
County's federal grant obligations, and local rules and regulations.
Airport staff, in conjunction with internal and external legal counsel,
participated in the review and preparation of the revised version of Title
10.
The BOCC finds that the revised version of Title 10of the Pitkin County
Code will promote safe, efficient and compliant operation of the
Aspen/Pitkin County Airport.
The BOCC considered this amendment at first reading at a public meeting
on July 13, 2005 and approved the amendment on second reading at a
duly noticed public hearing on July 27, 2005.
NOW, THEREFORE, BE IT ORDAINED by the Board of County
Commissioners of Pitkin County, that it hereby repeals and replaces Title 10
(Airport Regulations) of the Pitkin County Code.
A copy of the Ordinance with the attached regulations is available for
public inspection in the office of the Airport Manager, 233 East Airport Road,
Aspen, CO 81611 and the Office of the Clerk and Recorder 530 East Main
Street, Aspen, CO 81611
THIS ORDINANCE SHALL BECOME EFFECTIVE 30 DAYS AFTER
PUBLICATION FOLLOWING FINAL ADOPTION BY THE BOARD OF COUNTY
COMMISSIONERS.
