Robert and Gail Stanger,"Applicant," submitted an application to Pitkin County,to compete in the 1999 metro area residential GMQS competition for one allotment to construct a new free market residence. 2. The parcel is located on Smuggler Mountain Road,and is more specifically described in Exhibit A. 3. The parcel is zoned AFR-10 and contains approximately 16 acres. 4. On January 25,2000,the Growth Management Commission("Commission")held a duly noticed public hearing at which time evidence and testimony was presented with respect to the Stanger application, and scored the application based on the standards provided in Section 3-160-050(C)of the Land Use Code ("Code"). 5. The Commission gave the Stanger application a total score of 10.25 points,which did not meet the minimum threshold score of 12 points. In addition,the application did not meet the minimum threshold score of 3 points in any of the four growth management scoring categories. 6. The Applicant submitted an appeal of the Commission's scoring tothe Community Development Director, asserting that their due process rights were violated in the Commission's hearing. 7. The BOCC heard the Applicant's appeal at special meetings on February 29 and April It, 2000, and found that the Applicant's appeal raised doubts as to the fairness of the Growth Management Commission's scoring process and that the Applicant's due process rights were violated in the Commission's scoring of the application(refer to BOCC Resolution No.d 7//-2000). 8. The BOCC determined that the appropriate remedy in granting the appeal was to rescore the application,which occurred at a special meeting on April 11,2000. The BOCC gave the Stanger application a total score of 13 points,which meets the minimum threshold score of 12 points. However,the application did not meet the minimum threshold score of 3 points in one of the four growth management scoring categories as required by Section 4-60-065(B)(7)of the Code, and,therefore, is not eligible to receive a GMQS allotment. The tally of the BOCC's scores is attached as Exhibit B. NOW,THEREFORE,BE IT RESOLVED by the BOCC that it does hereby deny one metro area GMQS allotment to the Stanger residence.
