DESCRIPTION OF ISSUE: The attached resolution and intergovernmental agreement
formalizes the terms and conditions of Pitldn County's contribution of $2500 to the Carbondale
Rural & Fire Protection District in connection with the District's purchase of a mobile command
center. The pumhase has been made as part of the relief effort to Pearlington, Mississippi, and
the agreement provides the terms for use of that command center in Pitkin County.
There have been no changes since first reading.
RECONEVIENDED ACTION: After the public heating, approve the attached Resolution on
second reading.

AGREEMENT WITH THE CARBONDALE RURAL & FIRE PROTECTION DISTRICT

Recitals
1. The Board of County Commissioners has authorized a contribution of $2500 and staff
assistance to the Carbondale Rural & Fire Protection District (the "District") for the purchase of
a mobile emergency command unit.
2. The District has purchased the mobile emergency command unit and is currently using it
in connection with its relief and recovery efforts in Pearlington, Mississippi.
3. The attached Intergovernmental Agreement between the Board and the District sets forth
the agreement of the parties concerning the Pitkin County's contribution to the relief effort and
its future use of the mobile emergency command unit.
4. It is in the best interests of Pitkin County to approve the Intergovernmental Agreement.
Now, therefore, be it resolved, that the Board of County Commissioners of Pitkin County,
Colorado hereby approves and authorizes the Chair to sign the attached intergovernmental
agreement with the District.

THE INTERGOVERNMENTAL AGREEMENT
BETWEEN THE CARBONDALE AND RURAL FIRE PROTECTION DISTRICT
AND THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO
CONCERNING CONTRIBUTION TO THE PLAN TO
PROVIDE AID TO THE COMMUNITY OF PEARLINGTON, MISSISSIPPI
PARTIES
THIS iNTERGOVERNMENTAL AGREEMENT (the "Agreement") is made this __
day of _, 2005, by and between the Carbondale and Rural Fire Protection District
(CRFPD), a special district organized under the laws of Colorado, and The Board of County
Commissioners of Pitkin County, Colorado, a Colorado home rule county (Pitkin County) (the
"Governments").
RECITALS
1. The Governments are duly formed governmental entities governed by Boards elected
by qualified electors in the political boundaries of the Governments.
2. Pitkin County desires to contribute to the effort commenced by CRFPD and the
Town of Carbondale to supply aid to the community of Pearlington, Mississippi, a majority of
which was recently destroyed by Hurricane Katrina.
3. CRFPD has requested aid from other governments in the Roaring Fork Valley to
purchase a trailer to be used as a mobile emergency command unit in Pearlington, and has
promised that the trailer will be available to jurisdictions in the Roaring Fork Valley as the
Roaring Fork Valley Emergency Command Unit.
4. Pitkin County has pledged $2500 as a financial contribution and another $2500 in in-
kind services and wishes to assure that its financial contribution provides a benefit to the County.
5. This Agreement is entered into, inter alia, pursuant to Section 29-1-201, et seq.,
C.R.S., and Article XIV, Section 10, of the Colorado Constitution.
6. The Governments have determined it is in the best interests of the citizens of the
respective jurisdictions of the Governments to enter into this Intergovernmental Agreement.
OBLIGATIONS OF PARTIES
NOW, THEREFORE, the Governments agree as follows:
1. Purpose. The purpose of this Intergovernmental Agreement is to establish the agreement
between the Governments concerning Pitkin County'S financial contribution to CRFPD.
2. Participation. Pitkin County agrees to provide $2500.00 to CRFPD-Katrina fund, to be
utilized solely for the purchase of the emergency command unit. In addition, Pitkin County shall
provide $2500 of in kind service to assist with the overall Pearlington aid effort, a portion of
which has been provided prior to this agreement. The in kind services shall be requested and
provided through the Pitkin County Manager.
3. Financial/Accounting. CRFPD will abide by and comply with all constitutional
requirements concerning state and local government expenditures and procedures in connection
with Pitkin County's financial contribution.
4. Use of Emergency Command Unit. CRFPD agrees to make the mobile command unit
available for use in Pitkin County at the request of any Incident Commander so long as it is not
being used for incident command purposes by CRFPD or another jurisdiction at the time of the
request.
5. Entire Agreement. This Agreement contains the entire understanding of the parties.
This Agreement may not be modified or amended except by writing, signed by all of the parties
hereto.
6. Governing Law. The interpretation, construction and performance of the Agreement
shall be governed by the laws of the State of Colorado. In the event of any litigation, jurisdiction
and venue shall be with the courts of Pitkin County, Colorado.
