SPECIAL MEETING
SEPTEMBER 20, 2005

CALL TO ORDER: Chairperson Kay-Clapper called the special meeting of the
Board of County Commissioners to order at 3:50 PM.
BOCC COMMISSION MEMBERS PRESENT: Commissioners Patti Kay-
Clapper, Dorothea Farris, Mick Ireland, Jack Hatfield and Michael Owsley
BOCC COMMISSION MEMBERS ABSENT: None

RESOLUTION DENYING AN ABATEMENT PETITION FOR PROPERTY TAX
REFUND SUBMITTED BY THE MCDONALD FAMILY TRUST - MOTION TO
APPROVE RECALCULATION OF ABATEMENT PETITION FOR PROPERTY
TAX REFUND

The applicant's, Scott and Caroline McDonald, stated that their taxes went up
immensely over previous years. They argued that there was too much allocation
to the commercial portion of their property over the residential portion. Mr. Scott
submitted a monthly statement showing rent and utility amounts on this property.
Said statement is attached to the meeting packet for September 20, 2005 and
shown as Exhibit "A".
Assessor's office staff person Larry Fite explained the basis of the denial to the
board as mirrored in his recommendation sheet as shown in his packet material
for September 20, 2005. Included in that material were the new parcel value
proration worksheet and State statutes shown in connection with this abatement.

Mr. Fite informed the board that his recommendation is that the total allocation
between residential and commercial should remain the way it is.
Additional discussion ensued.
Commissioner Farris stated that as this was already debated in 2003
she would motion to agree with the staff recommendation for denial.
Commissioner Owsley seconded the motion.
As there were discussions on recalculating the amount, Commissioner Ireland
suggested that a recalculation be done now in order to show the taxpayers the
difference.
Mr. Fite said that he would go back to his office and do the recalculations and
return.
The motion to agree with staff's recommendation to deny was held off until
Mr. Fite could return with those recalculations.
At 4:47 PM, Mr. Fite returned to the board with his recalculations. The rental
income generated the new commercial value of $232,300.00 with the balance of
$682,700 as residential.
The difference in taxes from the reallocation came out to a $900.00 advantage to
the taxpayer as the amount was lowered by the recalculation.
At this time, Chairperson Kay-Clapper called the original motion to deny.
Motion failed 4 to 1 with Commissioner Farris being the only one voting
aye.
Therefore, Commissioner Ireland moved to approve the abatement using
the Assessor's recalculated figures in the amount of $908.26 which
represents an assessed value of $29,890.00. Commissioner Hatfield
seconded the motion. Motion passed 4 to I with Commissioner Farris
voting nay.
RESOLUTION DENYING AN ABATEMENT PETITION FOR PROPERTY TAX
REFUND SUBMITTED BY CHARLES MARQUSEE - MOTION TO ACCEPT
STAFF'S RECOMMENDATION AND DENY THE ABATEMENT PETITION FOR
PROPERTY TAX REFUND

Ms. Payne proceeded with her presentation as outlined in her abatement
recommendation in the meeting packet for September 20, 2005. Staff is
recommending denial based on sales from 2000 to 2002 and the cost to cure and
relocate problem utility easements and driveway.

The applicant was not present. His arguments in support of his abatement can
be found in his May 28, 2005 letter to the Assessor in the September 20, 2005
meeting packet.
Commissioner Farris moved to accept staff's recommendation to deny the
Charles Marqusee abatement petition for property tax refund. Chairperson
Patty Kay-Clapper seconded the motion. Motion passed 5 to 0.
ADJOURNMENT:
Commissioner Hatfield moved to adjourn the special meeting at 4:59 PM.
Commissioner Ireland seconded the motion. Motion passed 5 to 0.
