The BOCC agreed that staff could administratively extend the deadlines for provision of housing. The Applicant has requested m~ opportunity to discuss with the BOCC the mitigation of 1.9 FTEs off-site, and the problems he has encountered in complying with this requirement. Staff has attached the work session memo for background. TO: THRU: FROM: RE: DATE: MEMORANDUM OF INTEREST Board of Cotmty Commissioners Cindy Houbffn~-U&nmunity Development Director Suzanne Wolff, Senior Pl~ner*~ AshcroR Ski Touring Area/Pine Creek Coo~ouse - Affordable Housing Mitigation September 27, 2005 SUMMARY: The Ar-SKI Master Plan approved by the BOCC for Ashcroft and the Pine Creek Cookhouse pursuant to Resolution No. 052-2001 requires the Applicant to mitigate for a total of 16.4 FTEs, "including 10 FTEs to comply with Resolution No. 79-46, 5 FTEs for the 1988 expansion, mad an additional 1.4 FTEs to be generated by the expansion of the Cookhouse." The Applicant was required to build housing on-site for 14.5 FTEs and to acquire or construct deed restricted housing off-site, provide a payment-in-lieu or financial security for 1.9 FTEs. The on-site housing required in the Master Plan is as follows: Unit Type 3-bedroom unit 8 person dorm 2 1-bedroom units Location Cookhouse area Moutezuma Mill Site King Cabin area # FTEs 3 FTEs 8 FTEs 3.5 FTEs Originally, prior to or concurrent with issuance of a CO for the Cookhouse, the 3-bedroom unit and the dormitory were to be completed and the off-site mitigation for 1.9 FTEs was to be acquired or constructed or a payment-in-lieu made. The one bedroom units were to be completed within 12 months of issuance of a CO for the Cookbouse. After the fire destroyed the old Cookhouse in the spring of 2003, the BOCC amended the prior approval pursuant to Resolution No. 111-2003 to accommodate an "interim affordable housing plan" and to delay the deadlines for construction of the on-site affordable housing units until two years from the date of issuance of the CO for the Cookhouse. In addition, the Applicant provided financial security for the 1,9 FTEs and an additional 0.8 FTEs in the amount of $548,391.20, to be held until the Applicant provides documentation of the purchase of an off-site unit to be deed restricted or until two years from the date of issuance of the CO, after which time the County could redeem the financial security. The County issued a conditional CO on December 31, 2003; the final CO was issued on March 23, 2004, once the conditions were met. The Applicant snbmitted building permit applications for some of the on-site units this summer; those permits have not yet been issued. The Applicant was ~nade aware of the recently adopted employee housing impact fee, and as a resnlt has proposed to reduce the amount of on-site housing and to pay the impact fee for the remaining FTEs for which mitigation is required. Tbe Applicant would construct the following housing on-site: Unit Type 2-bedroom unit 1 1-bedroom unit I 1-bedroom unit Location # FTEs King Cabin area Cookhouse area 2.25 FTEs Montezuma Mill Site 1.75 FTEs 1.75 FTEs These units would be constructed in the summer of 2006. The Applicant proposes to provide financial security for completion of the on-site housing by December 2006. In addition, the Applicant proposes to pay the applicable employee housing impact fee for the remaining 10.65 FTEs (16.4 FTEs total - 5.75 FTEs on-site), which would be a total of $90,982.95 (10.65 FTEs x $8,543/employee). Staff is prepared to accept the Applicant's proposal, and will amend the prior approvals administratively, unless directed by the BOCC to bring this issue before the BOCC for discossion. RECOM2VIENDATION: Staff recommends that the BOCC direct staffto amend the Ashcrofi/Pine Creek Cookhouse approvals to accommodate the Applicant's proposal to redoce the amount of on-site housing and to pay the impact fee for the remaining FTEs for which mitigation is reqoired. (AST) Re: Resolution No.: 052-2001 Ashcroft Ski Toudng AF-SKI Master Plan Amendment As a follow up to the meeting that you arranged with Lance Clarke, Ashcroft Ski Touring submits the following proposal for its required mitigation of employee housing. We are very excited about this proposal as it reduces the number people on site who would need over snow access to their housing and will reduce the density of the buildings therefore protecting critical view planes. 1) Cookhouse Area: one, 2-bedroom unit to be built summer 2006. This replaces the 3-bedroom schoolhouse, called the manager's house on the approval. This unit would qualify for 2.25 FTE's. 2) Montezuma Pamel: employee dorms to be replaced by one, 1-bedroom unit to be built, summer 2006. By having only one unit on this site, we dramatically protect the view-plane from the restaurant. This 1 -bedroom unit would mitigate 1.75 3) King Cabin Area: one, 1- bedroom Unit to be buitt, summer 2006. This 1- bedroom unit would mitigate 1.75 FTE's. 4) Offsite mitigation called for 1.9 FTE's, which would be payment in lieu. Ashcroft Ski Touring proposes to pay the mitigation rates for the difference between what we plan to build and what was originally proposed as mitigation. We will post a new letter of credit, which will be based on the housing that we have yet to build with a deadline of December 2006 for construction completion. This letter of credit wilt replace the existing letter of credit for our offsite mitigation. We will pay now the payment in lieu for the change in our employee housing plans.
