COUNTY, COLORADO, GRANTING AN APPEAL BY NANCY AND ANDREW
SHAPIRO OF A HEARING OFFICER DETERMINATION RELATED TO THE
BARNETT FAMILY TRUST, LOT 10, ASPEN OAKS SUBDIVISION

RECITALS
1. Nancy and Andrew Shapiro, 288 Aspen Oak Drive ("Appellants") have appealed to the
Board of County Commissioners of Pitkin County, Colorado ("BOCC') to overturn the Community
Development Hearing Officer's Determination No. 07-2005 regarding a 1041 Hazard Review
approval for the Barnett Family Trust property at Lot I 0, Aspen Oaks Subdivision.
2. The property is located at 39 Polecat Drive, West Buttermilk area.
3. Thc BOCC heard this application at public hearings on July 13, 2005, and October 26, 2005,
at which time evidence and testimony were presented with respect to the appeal.
4. The BOCC finds that the Hearing Officer's decision was discretionary and in error as the
property contains a location for development or redevelopment that would be less impactive and
more in keeping with Pitkin County standards for development than the approved site.
NOW, THEREFORE, BE IT RESOLVED by the BOCC that it hereby grants the
Shapiro appeal and overturns Hearing Officer Determination No. 07-2005.
