RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,
COLORADO APPROVING THE PRESERVE SUBDIVISION AMENDMENT TO THE
PROTECTIVE COVENANTS
Resolution No. 99-#9/e
RECITALS
1. The Preserve PUD Homeowners Association has applied to the Board of County Commissioners to
amend the Preserve PUD protective covenants to permit dogs in the subdivision and to allow the
residents of the subdivision to have dogs subject to certain restrictions.
2. The Board of County Commissioners heard this application at a public hearing on August 25, 1999 at
which time evidence and testimony were presented with respect to this application. During this
meeting the Board of County Commissioners directed the Applicant to make specific changes to the
amended protective covenants. On December 1, 1999 the Board of County Commissioners reviewed
the protective covenants to determine if they reflect the changes they suggested.
3. The Board of County Commissioners finds that the proposed amendment meet the relevant standards
in Code Section 3-200-080. Thus, pursuant to Code Section 3-200-080,the Board of County
Commissioners approves the proposed amendments to the protective covenants subject to final
review by the Planning Staff.
NOW,THEREFORE,BE IT RESOLVED by the Board that it does hereby grant approval of the
Preserve Subdivision amendment to the restrictive covenants subject to the following conditions which
shall run with the land and be binding on all successors in interest:
1. The applicant shall adhere to all material representations made during the application process.
2. Prior to recording of the amended protective covenants,the Applicant shall compile the list of dogs
that meet the specified criteria.
3. Prior to recording of the amended protective covenants,the Applicant shall clarify Section 1.4 of the
covenants regarding the use of money collected through fines. Section 1.2 should clearly state that
dogs are not allowed under any circumstance in Northstar Preserve. The final draft of the amended
covenants shall be reviewed and approved by the Planning Staff.
4. Prior to the issuance of any building permits in the Preserve Subdivision,the Applicant shall record
the amended protective covenants with the list of registered dogs as an exhibit at the County Clerk
and Recorder's office.
