COLORADO, ALLOCATING 2005 RURAL AREA GMQS ALLOTMENTS FOR ADDITIONAL
FLOOR AREA

RECITALS
On October 25, 2005, the Planning and Zoning Commission ("Commission") held a duly noticed public
hearing, at which time evidence and testimony were presented with respect to Rural Area Growth
Management applications.
2. The Commission reviewed the following applications for the 2005 Rural Area GMQS competition for
additional floor area:
Lester: requesting an additional 4,250 square feet of floor area for a property located on Castle
Creek Road; described as Cora May Lode and Cora May No. 2 Lode Mining Claims, USMS
#6817.
· McCluskey: requesting an additional 4,950 square feet of floor area for a property located at
45184 Highway 82; described as a parcel of land in Section 28, Township 10 South, Range 84
West of the Sixth P.M.
· Oxenberg: requesting an additional 5,000 square feet of additional floor area for a property
located at 45196 Highway 82; described as a parcel of land in Section 28, Township 10 South,
Range 84 West of the Sixth P.M.
3. There were 25,000 square feet available in the Rural Area for the competition for additional floor area.
The applicants requested a total of 14,200 square feet.
4. The Commission scored the applications as follows:
· Lester: 53 points
· McCluskey: 52 points
· Oxenberg: 52 points
All of the applications met the minimum threshold score of 48 points AND achieved the minimum
threshold score for each scoring category, as required to be eligible for an allotment.
Pursuant to Section 4-60-060 of the Code, the Commission's scores were forwarded by resolution to
the Board of County Commissioners ("BOCC") on November 2, 2005.
7. No appeals of the Commission's scores were filed within the required 14 day appeal poriod.
NOW, THEREFORE BE IT RESOLVED by the BOCC that it does hereby allocate a total of
14,200 square feet of floor area to be divided among the following properties as shown for the 2005 Rural
Area GMQS competition for additional floor area:
· Lester: 4,250 square feet of floor area
· McCluskey: 4,950 square feet of floor area
· Oxenberg: 5,000 square feet of floor area

This allocation is conditioned upon recordation of a covenant documenting the representations made in the
application for the additional square footage. This covenant shall be reviewed and approved by
Community Development Department and recorded against the property, prior to issuance of a building
permit to utilize the awarded floor area.
APPROVED AND ADOPTED ON THE 7m day of December, 2005.
