The number of trips being generated by this project has been recalculated based on the final project which was reduced. from 17 to 13 units. The. number.of trips generated by this development is based on ITE Trin Generation, 6s' Edition for single family ownership Residential Condominiums/Townhouse (230) and is 5.86 trips per unit. A reduction of 2 trips/unit has been granted for being with '/z mile of a transit stop. 13 X 5.86 = 76 13 X -2 = - 26 50 trips will be generated by this development and must be mitigated. 50 trips X .0281bs of PM 10 generated per trip = 1.41bs of PM10 generated/day Review of the project: 1) Paving the pazking lot to prevent mud carry out onto adjacent roadway mitigated .224 lbs of PM10 The interior road, Fabia Loop, and 26 parking spaces and 2 drop off spaces (based on 2/23/04 plans) were paved as part of this project. Stillwater Rd was already paved to Hwy 82. It can be assumed that 70 trips per day on Stillwater Rd (50 from the employee housing units and 10 each from the ,two private homes, Horn & Resnick). The formula that has been traditionally used is # VT/day X # of pazking lot exits X the factor of.0016 (average emissions factor) = lb of PM10/day credit for paving the interior road and pazking lots. 2) There is no credit for PM10 mitigation for the concrete sidewalks within the project. The interior sidewalks do not connect to any exterior sidewalks or trail. There aze no sidewalks and no path or trail along Stillwater Rd to make it safe or easy to access the bus stop on the other side of Hwy 82 at Mountain Valley subdivision. 3) There is no credit for PM10 mitigation for foot path and steps constructed from the upper parking lot down the berm to Stillwater Rd. The length is approximately 70 feet. The path does not connect to another path or sidewalk and it ends on Stillwater Rd .The path and steps are steep and would not be easy to use in the winter. A county trail is directly across the street but the trail goes. east toward Independence Pass. There is no immediate trail west towards Aspen . 4) Providing covered bike storage to encourage biking to town instead of driving will mitigated 2 trips per unit for a total of 26 trips per day (26 X .028 #/Trip = .7261bs of PM10). Each of the 13 units was provided anextra-large storage unit to store personal items including bikes. Fabienne Benedict, (hereafter "Applicant"), has applied to the Board of County Commissioners of Pitkin County, (hereafter !~ "Board"), to subdivide the Stillwater Ranch into aix lots.. 2. The subject property is zoned AFR-2, PUD. 3. The property is located adjacent to and east of the City of ', Aspen, southwest of Highway 82, more specifically described in Exhibit "A", attached hereto .r 4. The Planning and Zoning Commission reviewed this application at their regularly scheduled public hearing 'on January 18, 1994, and recommended General Submission approval subject to conditions. 5. The Board granted five GMQS allotments to the applicant by Resolution No. 94-125. i 6. .The Board. heard the General Submission application at a regularly scheduled and noticed public hearing on August 30, 1994, at which time. evidence and testimony was presented in regard to this application. 7. The Planning and Zoning Commission reviewed the Detailed and ~!, i Final Plat application at their regularly scheduled public meeting ', on November 8, 1994, and recommended approval subject to conditions. 8. NOW, THEREFORE, BE IT RESOLVED by the Board of County ' Commissioners that it_hereby grants Detailed and Final Plat approval to the applicant subject to the following conditions: !, 1. All utility extensions .shall be located_ underground, and appropriate easements shall be dedicated to the various. public ', and private utilities as may be required. All utility ' extensions .shall be located in the property's existing road ' system. to minimize site disturbance.. If utility extensions are proposed outside of approved road alignments, these extensions shall be shown for review andrapproval at Detailed'i Submission. 2. All development on Lots. l through 5 shall be limited to ', access roads, the individual driveways, utility extensions, l irrigation ditches, fences meeting Division of Wildlife requirements. and the building envelopes. No disturbance, I' including vegetation removal, (unless required by the County l' for fire protection)- shall occur `outside these areas. Landscaping outside of building envelopes may be permitted ~, upon approval by the Planning Department. 3. The applicant shall dedicate a fishing easement along the southerly bank of the river to include the river and five feet ~ of bank above the high water mark. All residences. shall be connected to the Aspen Consolidated Sanitation Districts (ACSD) main sewer line that runs through ', .the property. The owners of said lots shall pay the normal ', connection fees, along with .an additional prorated surcharge that will be used to recover the costs of repairing a.' downstream constraint. The pro rata share shall be determined ' by the ACSD. The protective covenants for the Stillwater Ranch Subdivision,, shall be revised to permanently restrict the use of the Open ', Space Parcel to agricultural uses and_ improvements,. the pasturing of horses and related .uses and improvements, and such other open space uses and improvements as may be approved ', from time. to time by the Stillwater Ranch Homeowners '~ Association, and the continuation of existing uses. The 'I covenants shall. also prohibit further subdivision of the Open '' Space Parcel, although a lot line adjustment shall be permitted between the_Open Space Parcel and the Out Parcel if County and landowner approval can be obtained,..... On or before March 1, 1995, the applicant shall form a' Homeowners' Association comprised of the owners of the six (6) lots in the Stillwater Ranch Subdivision, and shall convey the Open Space Parcel to the Homeowners' Association. The deed 13 14 m u 15 n h i m m ti r~ shall reserve. the exclusive use, control and expense of the Open Space Parcel to Fabienne Benedict and Fredric A. Benedict for the rest of their lives. Removal of mature vegetation outside of any building envelope on Lots l through 5 is prohibited except as provided for in ~' Condition 2 above. Removal of mature trees within .the building envelopes shall require approval of a tree removal plan by the Planning Office. Mature trees means any deciduous tree of six-inch caliper at diameter-breast-height or any evergreen taller than six feet in height. The northern boundary of the building envelope on Lot l shall ', be relocated twenty (20) feet to the south to reduce potential ''. visual impacts. The applicant may relocate the eastern and/or western boundaries of the building envelope so as to maintain ', the size of the building envelope. The building height on Lot 1 shall be limited to a maximum of 20. feet measured from existing grade or finished grade, whichever is .lower, to the top of a flat roof or the midpoint of a pitched roof. fihe ridge of a pitched roof shall .not exceed 25 feet above existing or finished grade, whichever is ~' lower. 16.
