Howard Ross CApplicant") applied to the Pitkin County Board of County Commissioners CBOCC") to appeal a tinding of the Hearing Officer that an effluent pipe may not be installed below the cxisting staircase, which is located on slopes in excess of 45%, where development is prohibited by Section3-80-050.C.I.c.i of the Code. 2. The parcel is located at 8386 Upper River Road, upstream of Little Texas, and is more specitically described in Exhibit A. 3. The parcel contains approximately 2.7 acres. The portion of the parcel that is below Upper River Road is zoned AFR-I 0 and the portion above the road is zoned RS-20. 4. The Hearing Officer granted 1041 hazard review approval to establish a building envelope to replace the existing residence on August 25,2005, pursuant to Determination No. 26-2005. As part of this Determination, the Hearing Officer found that an effluent pipe may not be installed below the existing staircase, which is located on slopes in excess of 45%, where development is prohibited by Section3- 80-050.C.I.c.i of the Code. 5. The BOCC considered the appeal at a duly noticed public hearing on November 16,2005, at which time evidence and testimony were presented with respect to this application. 6. The BOCC finds that the functioning ofthe septic system could be compromised by use of a longer, more circuitous line, which is of considerable concern given the proximity ofthe septic system to the Roaring Fork River. 7. The BOCC further finds that installation of the line below the stairs will cause less harm and disturbance than ifthe line was installed within the existing driveway. NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners that it does hereby approve the Ross Appeal of Hearing Officer Determination No. 26-2005 to allow installation of an effluent line on slopes in excess of 45%, subject to the following conditions, which shall run with the land and be binding on all successors in interest. I. The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings. 2. The conditions of Hearing Officer Determination No. 26-2005 shall remain in full force and effect. 3. The existing staircase shall be replaced, and the effluent line shall be installed below the staircase. Appropriate construction techniques shall be employed to ensure that the stability of the slope is not affected. Disruption of vegetation shall be minimized, as the vegetation plays a part in stabilizing the slope. Larger trees shall not be removed. The time during which the trench is left open shall be minimized and the trench backfill shall be compacted.
