RECITALS
I, First Time Buttennilk LLC ("Applicant") has applied to tile Pitkin County Hearing Officer
("Hearing Officer") for scenic overlay approval for a single family residence.
2. The parcel is located on West Buttermilk Lane, directly adjacent to the Buttermilk ski area, and is
described as Lot 2, Buttermilk Meadows SubdivisionlPUJ:j:' "
3. The lot contains approximately 9 acres, is zoned AFR-I 0 and is located within the Urban Growth
Boundary.

4. The BOCC granted Conceptual Submission approval for the two lot subdivision/PUD pursuant to
Resolution No. 98-153. The BOCC granted DetailedSlll:>missionlFinal Plat approval for the
subdivisionlPUD pursuant to Resolution No. 232-2000; the vested"rights expired on November 15,2003.
The BOCC granted a one year extension of vested rights pursuant to Resolution No. 008-2004, which then
expired on November 15,2004. The Final Plat was recorded October 10,2005 in Plat Book 75 at Pages 99-
100. The PUD Guide was recorded concurrently as reception #516027.
5. The Hearing Officer considered this application at a dnly noticed public hearing on Jannary 17,
2006, at which time evidence and testimony were presented with respect to this application.
6. The Hearing Officer finds that the proposed development complies with the scenic overlay
provisions of the Land Use Code ("Code").
NOW THEREFORE BE IT RESdt ytDJ)ythe plikiriC~lll1tyCommunity Development
Hearing Officer that he does hereby approve the Buttermilk Meadows Lot 2 Scenic Overlay Review,
subject to the following conditions, which shall run with the land and be binding on all successors in
interest.
1. The Applicant shall submit a lighting plan specifYing the location, type and number of exterior fixtures
and demonstrating compliance with the County's lighting regulations, for review and approval by the
Community Development Department, prior to installation of exterior lighting fixtures. Exterior lighting
shall be prohibited on the east facade, except the minimum required to comply with the building code
adjacent to doorways.
2. The exterior of the residence shall be finished in natural, earth-tone (blend with the colors of the natural
surrounding environment) and non-reflective materials. Color and material samples shall be provided to
the Community Development Department for approval prior to issuance of a building permit.
3. The Applicant shall submit a final landscaping plan, for review and approval by the Community
Development Department, prior to issuance of a Certificate of Occupancy. Landscaping shall provide
r- screening and/or softening of the residence as seen from the highway.

4. Native shrubs and grasses shall be utilized for revegetation of disturbed areas. All disturbance caused
by construction shall be revegetated no later than one !lrowing season after completion of construction.
Existing vegetation shall be retained to the extent possible.
5. The Applicant shall adhere to all material representations made in the current or prior applications or in
public meetings or hearings and shall consider those representations to be conditions of approval, unless
amended by other conditions.
6. Statutory vested rights for the approval contained herein are grahted pursuant to tile Pitkin County Land
Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code,s
4-140 and C.R.S., g24-68-1 05. The statutory vested rights granted herein shall expire on January 17,
2009.
