Re: Rubey Estates Subdivision
Sketch Plan
WHEREAS, Mr. Charles Brandt, represently the Rubey Estate

has applied for sketch plan subdivision approval pursuant to the
Pitkin County Subdivision Regulations for a five (5) lot subdivision
consisting of four (4) five acre plus sites and one (1) 14+ acre

site, and
WHEREAS, the property is generally located behind the
Aspen Valley Hospital and is zoned R-30, P.U.D., and
WHEREAS, on November 19, 1975, the Pitkin County Planning
and Zoning Commission conducted a site inspection of the property, and
I
WHEREAS, a preliminary geologic report has been submitted
by the applicant which has been reviewed by the Colorado Geologic
Survey who agrees that no significant geologic problems exist on the
site which would prohibit residential development, and
WHEREAS, the Pitkin County Planning and Zoning Commission
has determined that the sketch plan application is consistent with the
standards set forth in the Pitkin County Subdivision Regulations as
outlined in Section 6.4 in that the project is of low density
minimizing public costs; no natural hazards exist which would prohibit
residential development; the project will be served by City water and
public sewer; the natural environment will be minimally affected; etc.,

WHEREAS, the Rubey Estate Subdi vi s i on appeans to be in
conflict with the housing policy adopted by the Pitkin County
Commissioners by not providing for employee housing,
NOW THEREFORE BE IT RESOLVED, that the Pitkin County
Commissioners hereby approve the Rubey Estate Sketch Plan subject to
the following conditions:
1. Water service be provided by the City of Aspen and
subject generally to the conditions of the City
Engineer's letter of November 11, 1975.
2. Sewer service be provided by Aspen Metro Sanitation
District.

3. The trail system requirements as stated in Dave (I
Russell's letter of November 19, 1975.
4. Compliance with recommendations of the Salvation
Ditch Company regarding surveys, easements, and
location of structures, and appropriate reservations
for the Gary Cooper Ditch.
5. Receipt and approval of a detailed geologic report as
recommended by the Lincoln-DeVore geologic report as
confirmed by Dave Shelton of the Colorado Geologic
Survey. Such report to include specific location
of homesites to minimize geologic and environmental
impacts.
6. Restriction of development from floodplain areas.
7. Additional conditions which may be imposed as a result
of a more detailed analysis at the preliminary plat
stage.

8. Compliance by the applicant with his representation that
his conflict with the housing policy will be resolved with
! the Housing Officer prior to the next stage of approval.
