RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO, GRANTING VISUALLY CONSTRAINED LOT TORs
FOR THE ASPEN MASS SUBDIVISION

RECITALS
1. The City of Aspen and Pitkin County (Applicants) have applied to the Pitlcin County
Department of Community Development for a visually constrained lot determination and
to the Pitkin County Board of County Commissioners (BOCC) for determination
whether one visually constrained lot Transferable Development Right (TDR) should be
granted per each existing development right.
2. The property for which the determination is requested is the three lot Aspen Mass
Subdivision on Highway 82; Parcel Identification #s 264321101801, 264321101802,
264321101803.
3. The Department of Community Development has determined that the lots are visually
constrained pursuant to the Pitkin County Land Use Code. The visual constraints relate to
the proximity to Highway 82, and the beneficial aspects of enhancing the open space
corridor outside the Urban Growth Boundary.
4. The BOCC reviewed the request for a determination as to whether one visually
constrained lot TDR will be granted per each development right at a public meeting on
March 22, 2006, at which time evidence and testimony were presented with respect to
this application.
5. The BOCC determined that three visually constrained lot TDRs (one per development
right) shall be granted for the Aspen Mass Subdivision; one to Pitkin County and two to
the City of Aspen.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Pitkin County, Colorado, that due to the fact that the Aspen Mass
Subdivision has been determined by the Community Development Department to be
visually constrained under the Pitkin County Land Use Code that three visually
constrained lot TDRs shall be granted to the Applicants or successors in interest.
