RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO,
DENYING THE DWIGHT APPEAL
OF A DENIED BUILDING PERMIT APPLICATION
Resolution No.033-2006
RECITALS
1. Mr. Barton Dwight, ("Appellant") has appealed to the Board of County Commissioners of Pitkin
County, Colorado ("BOCC") to consider the Zoning Officer's denial of Building Permit Application #
0136.2005.prgr, to construct a detached garage.
2. The application was denied because it exceeded the maximum allowed floor area of 4,000 as
established by the Upper Frying Pan Overlay in Section 3-40-260 of the Land Use Code.

3. The subject property is located at Lot 7,'South Shore Subdivision, aka 1700 South Shore Drive,
Basalt.
4. The BOCC heard this request at a public meeting on February 08,2006, at which time evidence and
testimony were presented with respect to the application.
5. The BOCC fmds that the construction of the detached garage will exceed the allowed floor area for the
overlay area.
NOW, THEREFORE, BE IT RESOLVED by the BOCC that it hereby upholds the denial of
Building Permit Application # 0136.2005.prgr.
