Home My WebLink About20060628brushcreektrail AGENDA ITEM SUMMARY REGULAR MEETING DATE: June 28, 2006 AGENDA ITEM TITLE: Resolution Approving an Intergovernmental Agreement with the Town of Snowmass Village for the Funding of the Brush Creek Trail Bridge STAFF RESPONSIBLE: Dale Will DESCRiPTION OF ISSUE: Pitkin County Open Space and Trails has begun construction on the much anticipated Brush Creek Trail! This bicycle and pedestrian trail will include asphalt and soft surface and run from the Town boundary to the Highway 82 underpass, linking the Snowmass trail system to the Rio Grande Trail via the Aspen Mass Trail. OST first budgeted for this trail project in 2003. However, various utility projects have presented a series of delays to our program's construction plans. Last year, we had the trail engineered and determined the need for two creek crossings. A new budget of$1.8 million was included in the 2006 budget. This updated budget figure anticipated two new bridges across Brush Creek. With news that sections of the Maroon Creek Pedestrian Bridge would be available, OST sought bids for constructing the trail using those bridge sections. While the proposed recycling of these bridge sections reduced the project cost, some parties objected to the use of the Maroon Creek Bridge up Brush Creek, for aesthetic reasons. A bridge design which is more complementary to what now occurs in Snowmass Village was estimated to cost up to an additional $180,000 over the cost of installing the Maroon Creek Bridge. In March, The Town of Snowmass Village sent a letter to the BOCC, requesting that the County select a bridge design that is more in keeping with Snowmass Village and its ranching history. That request came with an offer to pay for half ofthe additional cost of upgrading the bridge design, up to a maximum reimbursement of $90,000. The BOCC has expressed informal support for this proposal. The attached IGA, outlining the terms of this proposal, was approved by Snowmass Town Council on June 5th. RECOMMENDED BOCC ACTION: Approve the Resolution on first reading and set for public hearing on July 12, 2006. \ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH TOWN OF SNOWMASS VILLAGE FOR THE FUNDING OF THE BRUSH CREEK TRAIL BRIDGE RESOLUTION # -2006 Recitals 1. The Pitkin County Open Space and Tails Program was established pursuant to Article 13 of the Home Rule Charter, which purpose includes the construction of non- motorized trails; and 2. The 2006 Open Space and Trails (OST) Budget includes $1.8 million for the construction of the Brush Creek Trail, a bicycle and pedestrian trail from the Snowmass Town Boundary to Highway 82 3. The Brush Creek Trail, as designed by OST, includes the use two sections of the former Maroon Creek Pedestrian Bridge to span Brush Creek in two separate locations, at an estimated cost of $30,000 for each location; and 4. In a letter to the BOCC dated March 21, 2006, The Town of Snowmass Village (TOSV) requested a different bridge design for the upper creek crossing located on the Seven Star Open Space, which would be more appropriate for Snowmass Village; and 5. On June 5, 2006, TOSV signed an intergovernmental agreement, stating that TOSV will reimburse the County up to $90,000, to cover one half the differential in the cost of constructing a lower profile bridge and the cost of using the Maroon Creek Pedestrian Bridge on the Seven Star Open Space; and NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners approves the attached Intergovernmental Agreement, accepting reimbursement from TOSV for up to $90,000 to compensate the County for one half of the additional cost for an new bridge at Seven Star Open Space, with a more appropriate design for Snowmass Village. RECITALS 1. The County has adopted an Open Space and Trails Program pursuant to Article 13 of the Home Rule Charter under which funds are available for the construction of trails. 2. The County has plans to build a bicycle trail in the Brush Creek Valley from the Town Boundary to Highway 82. 3. The County initially proposed to utilize two sections of the old Maroon Creek pedestrian bridge, one of which would cross Brush Creek on the _" _______u___?even Star Open Space ("Seven Star Crossing") . .--..------.----------- ----- ----"---_..----- 4. The Town prefers that a new, low profile, bridge be used for the Seven Star Crossing. 5. AGREEMENT NOW, THEREFORE, for in consideration of the mutual promises and agreements of the parties and other good and valuable consideration, the adequacy of which is hereby acknowledged, the parties agree as follows: 1. The County will undertake all design and permitting for the Brush Creek Trail up to the Town's boundary, and will maintain such trail upon completion. y 2. The Town will reimburse the County up to $90,000, or one half the differential cost of using a new bridge at the Seven Star crossing, which ever sum is less. 3. The foregoing Agreement is approved by the Board of County Commissioners of Pitkin County, Colorado at its regular meeting held on the day of . 2006. 4.
