Recitals
1. The Highway 133 Scenic and Historic Byway
Committee has completed the West Elk Loop
Scenic Byway Crested Butte to Carbondale Trail
Feasibility Report (2004; ~Byway Report") which
identities feasible trail alignments over McClure
and KebJer passes; and
2. The Byway Report proposes a connection
from Carbondale, up the Crystal to Redstone and
on to McClure Pass; and
3. The construction 01 a bicycle-pedestrian trail
along Highway 133 in the Crystal River drainage
has been a longstanding community interest as
recognized in Crystal River Valley Bicycle Trail
Study (pitkin County 1994) the Club 20 "Missing
Links" report (1996), the Pitkin County Crystal
River Master Plan (2003), and
4. The Town of Carbondale has constructed the
first Ie-gs of this trail which currently extend Irom
Highway 82 down Highway 133 to Snowmass
Drive; and
5. Pitkin County has previously entere-d into an
lGA with the Town of Carbondale and Garlield
County to design and permit Phase 1 01 the trail
as proposed in the Scenic Byway Report which
will extend the first 4.3 miles up the Crystal cun"
sistent with the Byway Report; and
6. Adoption of an lGA between Pitkin County
and Gunnison County in support ot the trail along
the general alignment identified in the Byway Re-
port will assist both Countle-s In funding and per-
mitting this trait
NOW, TIiERFFORE, BE IT RESOLVED, that
the Board of County Commissioners approves
the attached lnte-rgovernmental Agreement
which retognized the completion of the Crested
Butte to Carbondale Trail is in the utmost public
interest and pledges our cooperation with the ef-
forts of Gunnison County to complete this trail.

Board of Trustees is charged with the responsi-

bility of acquiring open space properties within
Pitkin County.
2. The Pitkin County Open Space and Trails
Board of Trustees has designated l'f'rtain types (If
prope-rhes as priority acquisitions, with scenic
lands. habitat lands, and agricultural lands each
as priorities.
3. The Crnwn Mountain Ranch (hereinafter refer-
red to as "the Property") is pussessed 01 out-
standing scenic, habitat and agricultural values.
4. The Property is a historic ranch that is impor-
tant habitat for such species as mule deer, elk.,
and golden eagles. Sopris Creek flows through
the Property and provides important habitat and
recreational resources.
5. The conservation of the property can be ach-
ieved while allowing two additional homesites in
preservation of the two existing residences on
the ranch.
6. On April 20, 20n6. the Ope-n Space and Trails
Board recommended an expenditure of up to
$2,250,00() lor the conservation and trail ease-
ments. and authorized up to $20,000 additional
expenditures for transaction costs.
7. During the reauthorization of the County Open
Space Program in the Jail of 1999, the County Fl.
nancial Advisory Board advised the County to
use Its bonding authority to secure the maximum
amount of desired open space during the first few
ye-ars of the reauthorized program.
8. The acquisition and financing agreement lor
the Property and the associated Property Tax
Bond Issue were not anticipated during the pre~
aration ot the year 200& budget so a supplemen-
tal budget appropriation is require-d for these
transactions.
NOW rnEREFORE, BE IT ORDAINED, by
the Board of County Commissioners 01 Pitkin
County, Colorado as lollows:
1. The Board approves an expenditure of up to
$2,250,000 on the Crown Mountain Conservation
and Trail Easements pursuant to the tt-1ms of the
Contract dated April II. 2006 (available lor public
inspection at the Pitkin County Clerk and Record-
er's olflce), and lurther authorizes the Open
Space Department to expend up to $20,000 on re-
lated transaction costs.
2. The Chair is authorized to execute the- con-
tract in substantially the form attached as Exhibit
A, and is authorized to execute sllch other docu.
ments as may be necessary to finalize this trans-
action. included any documents needed to securft
grant assistance lrom Grftat Outdoors Colorado.
3. The Board of County Commissioners hereby
declares its ollidal intent to reimburse current
expe-nditures from a future issuance of Pitkin
County general obligation bonds. The maximum
amount of bonds expected to be issued for this
project IS $2,38<J,OOO.
That adjustments be made to the year 2006 budg-
et as follows:

RECITALS
The City of Aspen ("Applicant") has applied to the Board
of County Commissioners 01 Pitkin County, Colorado
("'BOCC") to rezone approximately 23,871 square leet
from AFR-W to PUB (public). The land is adjacent to the
existing Maroon Creek Hydropower Plant, which is zoned
PUB. and includes areas previously under easement to
the Applicant lor operation of the Hydropower Plant
The property is located on the east side of Maroon Creek
Road.
The Pitkin County Planning and Zoning Commission
considered the proposed rezoning at a regularly
scheduled meeting on March 14, 2006, and recommended
approval by a vote of W
The BoeC considered the proposed rezoning at a duly
noticed public hearing on first reading on May 10, 2006,
and voted to approve the rezoning on second reading on
May24,2006.
The BOCC finds that the proposed rezoning is consistent
with the applicable provisions of the Pitkin County Land
Use Code.
NOW, THEREFORE, BE IT ORDAINED by
the Boce that it hereby rezones approximately 23,871
square feel from AFR-1O to PUB (public), as shown In
Exhibit A.
THIS ORDINANCE SHALL BECOME EFFECTIVE 30 DAYS
AFTER PUBLICATION FOLLOWING FINAL ADOPTION BY
