RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,
COLORADO, GRANTING A CONSTRAINED SITE TDR FOR LOT F, CRYSTAL RIVER
P ARK SUBDIVISION SECOND ADDITION (AS AMENDED) TO JAMES AND CHRISTINE
VAUGHN

RECITALS
1. James and Christine Vaughn, Applicant, have applied to the Pitkin County Department of Community
Development for a constrained site determination and to the Pitkin County Board of County
Commissioners (BaCC) to determine whether one or more constrained site Transferable
Development Rights (TDRs) should be granted.
2. The lot for which the determination is requested is described as Lot F, Crystal River Park
Subdivision Second Addition (as amended).
3. The lot contains 2.26 acres and is a nonconforming size lot in the RS-30 zone district.
4. The HaCC approved the Crystal River Park Subdivision Composite Plat (including First and Second
Additions thereto) in July of 1966. The BaCC then approved an amendment to the Plat in 2000 (Plat
Book 57 at Page 32), which vacated a portion of Ruby Mountain Drive and merged Lots 10, 11 and
12 (at the request of the owners).
5. The Community Development Department has determined that the lot is "undevelopable or severely
constrained" pursuant to the Land Use Code, based on the following:
A. Approximately 71 % of the lot is comprised of slopes in excess of 30%.
B. The lot is subject to severe debris flow and rockfall hazards, slope instability and severe wildife
hazard.
C. Portions of the lot are within mapped, but not field verified, avalanche hazard areas.
6. The BaCC reviewed the request for a determination as to whether one or more constrained lot TDRs
will be granted at a public meeting on June 14, 2006, at which time evidence and testimony were
presented with respect to this application.
7. The BaCC determined that one constrained site TDR shall be granted to Lot F.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Pitkin
County, Colorado, that due to the fact that the Community Development Department has determined that
Lot F, Crystal River Park Subdivision Second Addition (as amended) is undevelopable or severely
constrained under the Pitkin County Land Use Code, one constrained site TDR shall be granted to the
Applicant or successors in interest for Lot F.
