RESOLUTION NO. 0;;0 -2006 1. Whereas, the; Board wishes to protect resident homeowners in the Smuggler Mountain Superfund Si e's ability to redevelop their property without unreasonable fees associated with the Sup fund Site; and 2. Whereas, Re olution #94-102 sets fees for material from the Smuggler Mountain Superfund Si e to be equal to standard contemporary tipping fees charged at the landfill, which are c endy $21 per cubic yard for similar material; and 3. Whereas, tipp ng fees for contaminated material are among the highest fees charged at the landfill and ar likely to continue to rise over time; and 4. Whereas, Co ty residents who develop elsewhere and do not have contaminated material are n t subject to contaminated material fees; I NOW, THEREFbRE, be it resolved by the Board of County Commissioners of Pitkin County, Colorado that tipping fees for projects within the Smuggler Mountain Super Fund site, where owners of thiproperty are also the resident, shall be equal to fees paid for non- contaminated soils fo the first 450 cubic yards. Tipping fees for soils in excess of 450 cubic yards or for projects here the owner is not the resident shall be equal to the fees charged for similar contaminated raterials.
