AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,
COLORADO, ESTABLISHING FEES FOR THE COMMUNITY DEVELOPMENT
DEPARTMENT AND REPEALING AND REPLACING ORDINANCE 011-2005

RECITALS
1. Pitkin County proposes to set fees for the Community Development Department that are
consistent and fair to the public and reflect the expense incurred in providing such services to the
public.
2. Certain fees currently charged for development review no longer reflect the cost of providing the
necessary levels of such services. The policy of the Pitkin County Board of County
Commissioners is that development shall pay, in full, the cost of development review in Pitkin
County. Long Range planning shall be funded through the general fund.
3. Payments due to the County for obligations due to sales and tax are not regarded as fees and
therefore not included in the Ordinance. The Ordinance does not reflect an encompassing fee
schedule.
4. Planning fees are proposed to be increased by 3% this year, with the fees to be reviewed annually
rather than making large increases every several years.
5. The Intergovernmental Agreement between the County and the City of Aspen Community
Development Departments requires that building fees be consistent with the City of Aspen in
order to make the building pennitting process seamless for the public.
6. The BOCC considered the proposed fees at a first reading on July 12,2006, and voted to approve
the proposed fees on second reading and public hearing on:14.I'12-(, ,2006.
7. The BOCC finds that adoption of this ordinance is necessary for the immediate preservation
of the public health, safety and welfare of the citizens of Pitkin County and, therefore,
declares this ordinance to be effective immediately.
NOW, THEREFORE, BE IT ORDAINED by the BOCC that it does hereby adopt fees for the
Community Development Department as follows:
1. Planning, Zoning and Referral Agency fees shall be based on the attached fee schedule
(Exhibit A).
2. Building permit fees shall be based on the attached fee schedule (Exhibit B).
3. Mechanical permit fees shall be based on the attached fee schedule (Exhibit C).
4. Plumbing penn it fees shall be based on the attached fee schedule (Exhibit D).
5. International Fnel Gas Code explained in Exhibit E.
6. National Electric Code Permit Fees penn it fees eXplained in Exhibit F.
7. Contractor Licensing Fees shall be based on the attached fee schedule (Exhibit G).

The following guidelines shall be used for the administration of the fee structure set forth above:
1. Fees charged for the processing of applications, which fall into more than one type of
application, shall be cumulative. In the event that the fees that result from accumulation are
found by the Community Development Director to be excessive in relation to the number of
hours it is anticipated to require to process the application, the Community Development
Department may waive or adjust the accumulation requirement.
2. Additional charges shall be billed on an hourly basis beyond the base fee only if the time exceeds
the average by more than 20% in the processing of an application.
3. Public Notices for Code Amendments will be billed for actual costs.
4. Additional charges shall be computed at the rate of two hundred and thirty-one dollars ($231) per
hour of additional Community Development Department staff time required
5. The Community Development Department shall identify, prior to or at the time of submission of
a land use application, whether an application is to be referred to the Planning Engineer, Housing
Office, Environmental Health and Natural Resources Department, Floodplain Administrator,

Airport or RFT A. Additional charges will apply as shown below. Other agencies may require
additional fees for review of land use applications, which fees must be paid separately.
6. An applicant may request that the BOCC waive fees for projects serving a public purpose,
proposed by a non-profit organization, or in order to dispute the fee charged.
B. ZONING REVIEW FEES: Zoning shall be charged the following fees for the services listed:

The fee for each permit shall be based on construction valuation and shall be as set forth in Table
I-A.
Plan Check Fees
A plan check fee shall be paid at the time of submitting the submittal documents for plan review.
Said plan review fee shall be 65 percent of the building permit fee as shown in Table I-A
Energy Code Fees
Energy code review fees are based on the building permit fee and equal 10% of the total building
permit fee, with a minimum charge of$25.00.

Fire Sprinkler Fees
Fire sprinkler fees are based on the valuation of the fire sprinkler system and calculated according to the
Building Permit Fee schedule. The total Fire Sprinkler Pennit fee is the total of the pennit and the plan
check fees.
Excavation/Foundation Fees
The excavation/foundation pennit fee is 35% of the building permit fee.
