John Wilcox, hereafter "Applicant", as owner of Ashcroft Ski Touring, Inc., has applied to the Board of County Commissioners of Pitkin County, Colorado, hereafter "BOCC", to amend the Master Plan approval granted pursuant to BOCC Resolution Nos. 052-200 I and 111-2003 with regard to employee housing mitigation. The Applicant proposes to provide on-site employee housing for 8.25 FTEs (full time equivalent employees), consisting of one three-bedroom unit in the Cookhouse area, one I-bedroom unit on the Montezuma Millsite adjacent to the Cookhouse, and two I-bedroom units in the King Cabin area, and to pay the applicable housing impact fee for the remaining 8.15 FTEs pursuant to the provisions of Ordinance No. 023-2005. 2. The Ashcroft Ski Touring Area is located in the Aspen Ranger District ofthe White River National Forest, in Sections 3 1,32,5,6,7 and 8, Townships 1 I and 12 South, Range 84 West of the 6th P.M. 3. Ashcroft Ski Touring, Inc. is pennitted by the U.S. Forest Service to operate the Ashcroft Ski Touring Area. The Ski Touring Area is comprised of approximately 607 acres with 18.5 miles of nor die trails, and is zoned AF-SKI. 4. The BOCC approved the Ashcroft Ski Touring Ski Area AF-SKI Master Plan pursuant to Resolution No. 052-2001. The affordable housing mitigation provisions of Resolution No. 052- 2001 were amended pursuant to Resolution No. 111-2003 and Administrative Decision No. 111- 2005. 5. The BOCC heard this application at a regular meeting on July 12,2006, at which time evidence and testimony was presented with respect to the application. 6. The BOCC finds that it is appropriate to amend the employee housing plan, given the adoption of new regulations in 2005 and .in the interest of limiting impacts in the Ashcroft area by reducing the amount of housing provided on-site. NOW, THEREFORE, BE IT RESOLVED by the BOCC that it hereby approves the request to amend the employee housing mitigation plan required as part of the Ashcroft Ski Touring Area AF-SKI Master Plan as follows: 1. The conditions of Resolution No. 052-2001 and 111-2003 shall remain in full force and effect, except as provided herein. This Resolution shall replace and superceded Administrative Decision No. 111-2005. 2. Construct, deed restrict and obtain the Certificates of Occupancy for the following on-site employee housing units, which shall provide housing for 8.25 FTEs: 1. One three-bedroom unit adjacent to the Pine Creek Cookhouse; 2. One one-bedroom unit on the Montezuma Mill Site; and 3. Two one-bedroom units adjacent to the King Cabin. B. Provide housing for 1.9 FTEs, either by acquiring or constructing a Category 2 unit off-site or by a payment-in-Iieu at the Category 2 level. The Category 2 unit must be approved by the Housing Office, prior to acceptance as mitigation for the development. The County shall continue to hold the financial security provided in December, 2003 until the Applicant provides documentation of the purchase ofa deed restricted unit that is acceptable to the Housing Office or until April 1,2007, after which time the County may redeem the financial security. C. Pay an employee housing impact fee of$53,393.75 to the County to mitigate for 6.25 FTEs at the rate established in Ordinance No. 023-2005 of $8,543 per employee. 3. The Applicant shall adhere to all representations made in the application and in public meetings and hearings. 4. Failure to comply with these conditions of approval shall result in revocation of the approvals and penuits for the Pine Creek Cookhouse. APPROVED on the 12th day of July, 2006.
