(a) On any work requiring a building permit(s), the permit(s) shall be issued only to licensed contractors, authorized representatives of licensed contractors, and owner-builders. (b) For purposes of this article, an "owner-builder" is an individual personally engaged in the construction (new or remodel) of asingle-family residence or accessory building for his or her own use. The following requirements shall apply to owner-builders seeking permits for construction: (1) The owner-builder shall not be issued more than one building permit for new home construction in any two year period and not more than one building permit at a time; (Z) The owner-builder has read applicable regulations and provisions of this article and applicable state law and affirmed in writing that the proposed project will comply with all such requirements; (3) It is the responsibility of the owner-builder to see that all paid personnel shall be covered by worker's compensation insurance as required by state law; (4) The owner-builder must be present at the worksite during all inspections and conferences with the Building Division, unless prior arrangements have been made with the building officials. In the event that any of the requirements listed above are not met at any time during the course of a permitted project, the Chief Building Official may suspend or revoke the owner-builder's permit. In the case of a suspended building permit the owner-builder shall have a reasonable time to correct the problem. If not corrected within the time period, the permit may be revoked. In the case of either a suspended or revoked building permit, the owner-builder may ask for a review at the next scheduled building code Board of Appeals meeting. All of the foregoing representations are true and correct. The owner-builder acknowledges and intends reliance on the representations in this affidavit as a basis for the issuance of a building permit for the project. Main Aspen, CO 81611 Attn: Patsy Newbury Dear Patsy: Tom Kurt and I made an inspection of the existing foundation at the Ashcroft geodistic cabin in the Castle Creek Valley of Pitkin County, Colorado, on Friday, May 30, 1980. The Kurts propose to remove the existing structure and use the original foundation for the base of a new log cabin. The existing main floor and framing will remain, and a second floor added with new roof. The new loading to the footings will not exceed a soil bearing pressure of 2,000 pounds per square foot on the 18 inch wide footing. The soils are gravelly with cobbles and boulders in a silty sand matrix. This type of soil normally has a maximum allowable bearing capacity of 3,000 pounds per square foot. The existing foundation and cabin has been there for about S years. No free water at the site was visible and the crawl space soils are not wet, other than water that has leaked through from the exterior deck. The west end of the north foundation wall is exposed above the ground. The concrete block wall is about 6'-0" high, has been water proofed with hot mopped asphalt coating applied at least 3 years ago. The wall sits on a concrete footing 18" deep and 18" wide. The west corner of the north wall was dug out to the bottom of the footing, about 24" below natural grade. The 18" deep footing then runs along the west wall with top of footing at ground line. The footing shows no signs of stress or settlement nor does the block foundation wall have any cracks. It can be said there has been no frost heave although the bottom of the footing is only 18" below grade. Mr. Kurt showed me some shoring foundations that he had done in 1979 where he had been concerned with the sluffi'ng out. of earth below a portion of the north wall footing. The new concrete foundation shoring will prevent further stuffing and undermining of the original footing. The new construction will reveal the east foundation which could not be seen at this time as the crawl space would not allow a full inspection and the grade at the building is now covered with concrete slab. If any signs of stress in the foundation are uncovered at excavation then repairs can be made at that time. No plans or details of the original building are available. This inspection has not revealed reasons why the existing foundation could not be used for the proposed building. In my opinion the foundation has served its purpose up to this time and has shown no signs of stress or failure. To be sure that this gets directly to you, I am sending it by certified mail. This envelope includes: (1) Heat loss equation performed by Drake Jacobs at Ball & Associates in Aspen. The original of the heat loss equation was hand carried to you with the blueprints by my wife. (2) Standard bacteriological water test performed by the Colorado Department of Health. A copy of this was also hand carried to you with the blueprints by my wife. (3) Water rights order ordered by Judge George Lohr, Water Judge, for 0.10 cfs from Waterfall Creek which flows through the property. (4) A description of the Nordic windows specified which shows that they meet e ress requirements. At least one of these windows is in each bedroom. The smaller windows you noticed were on the north side of the house, to reduce heat loss on the cold side. All three bedrooms have three outside walls and the win- dows on at least one side meet the egress requirements. These windows were recommended by Drake Jacobs. I have contacted both Tom Duesterberg and Bob Nelson since our call. Tom will inspect the foundation with me in early May and give a report; and, Bob Nelson is going to check with his predecessor to see what he remembers about the septic tank, since he has no records of it. Please understand that we are making a serious effort to beautify the Ashcroft area by removing the domes and replacing them with a cabin.
