HomeMy WebLinkAboutbocc.res.073.2006 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH TOWN OF SNOWMASS VILLAGE FOR THE FUNDING OF THE BRUSH CREEK TRAIL BRIDGE RESOLUTION #CW3'-2006 Recitals I. The Pitkin County Open Space and Tails Program was established pursuant to Article 13 of the Home Rule Charter, which purpose includes the construction of non- motorized trails; and 2. The 2006 Open Space and Trails (OST) Budget includes $1.8 million for the construction ofthe Brush Creek Trail, a bicycle and pedestrian trail from the Snowmass Town Boundary to Highway 82 3. The Brush Creek Trail, as designed by OST, includes the use two sections of the former Maroon Creek Pedestrian Bridge to span Brush Creek in two separate locations, at an estimated cost of $30,000 for each location; and 4. In a letter to the BOCC dated March 21, 2006, The Town of Snowmass Village (TOSV) requested a different bridge design for the upper creek crossing located on the Seven Star Open Space, which would be more appropriate for Snowmass Village; and 5. On June 5, 2006, TOSV signed an intergovernmental agreement, stating that TOSV will reimburse the County up to $90,000, to cover one half the differential in the cost of constructing a lower profile bridge and the cost of using the Maroon Creek Pedestrian Bridge on the Seven Star Open Space; and NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners approves the attached Intergovernmental Agreement, accepting reimbursement from TOSV for up to $90,000 to compensate the County for one half of the additional cost for an new bridge at Seven Star Open Space, with a more appropriate design for Snowmass Village. Irelahd, Chau ounty Manager: Ift:ti.::::-/1 Coun~anager ;1 / lhr.! ki Open Space Director Approved as to Form: ,---- ----, ~ ~/- ~ nty Attorney J- INTERGOVERNMENTAL AGREEMENT For Town of Snowmass Village funding of the Brush Creek Trail Bridge THIS GOVERNMENTAL AGREEMENT (the "Agreement") is made this 5th day of June 2006 by and between the Board of County Commissioners of Pitkin County Colorado, whose address is 530 East Main St., Aspen Colorado 81611 (the "County") and the Town of Snowmass Village ("Town"). RECITALS 1. The County has adopted an Open Space and Trails Program pursuant to Article 13 of the Home Rule Charter under which funds are available for the construction of trails. 2. The County has plans to build a bicycle trail in the Brush Creek Valley from the Town Boundary to Highway 82. 3. The County initially proposed to utilize two sections of the old Maroon Creek pedestrian bridge, one of which would cross Brush Creek on the Seven Star Open Space ("Seven Star Crossing") 4. The Town prefers that a new, low profile, bridge be used for the Seven Star Crossing. 5. The County has determined that the cost difference of using a new bridge at this location will be up to $180,000. 6. The Town would like to contribute up to $90,000 to the Brush Creek Trail project to ensure that the Seven Star Crossing is a low profile bridge design in keeping with the Town's ranching heritage. AGREEMENT NOW, THEREFORE, for in consideration of the mutual promises and agreements of the parties and other good and valuable consideration, the adequacy of which is hereby acknowledged, the parties agree as follows: 1. The County will undertake all design and permitting for the Brush Creek Trail up to the Town's boundary, and will maintain such trail upon completion. :7 2. The Town will reimburse the County up to $90,000, or one half the differential cost of using a new bridge at the Seven Star crossing, which ever sum is less. 3. The foregoing Agreement is approved by the Board of County Commissioners of Pitkin founty, Colorado at its regular meeting held on the /J't., day of dvt..y ,2006. 4. The foregoing Agreement is approved by the Town of Snowmass Village Town Council at its regular meeting held on the 5th day of June 2006. 5. In witness whereof the parties hereto have caused this agreement to be executed as of the day and year first written.
