Pursuant to our conversation yesterday, this is to confirm the
County's intention to address the following outstanding issues
regarding the Williams' Woods Project:
1. Electrical Inspection: We understand that no Final Inspection
or Certificate of Occupancy will be issued until the units have
passed a final electrical inspection.
2. Handicapped Access: Attached please find a note from David Brown
and myself regarding the handicapped ramp(s). These will be
installed in the originally-planned locations accessing units # 101
and 501 next spring when we pave the parking lot and other
pedestrian accessways.
3. Crawlspace Ladders: These are on order and will be installed per
the attached Project Change Order prior to, or immediately upon,
unit occupancy.
It is my understanding that the other issues raised by your
inspector at his last walk-through have been dealt with to your
satisfaction. As I noted yesterday, we hope to close on several
of the units (501, 503, 504) as early as Friday of this week and
I would appreciate some verification that these units are in
compliance with the Code by that time. Please let me know
immediately if there is anything further that we can do to this
end.

RESOLUTION OF THE BOARD OF COUNTY COMM28SIONERB OF PITRIN COUNTY,
COLORADO, GRANTING DETAILED.
APPROVAL OF THE
RUBEY LOT 6 SUBDIVISION, PUDJ 1041 HAZARD REVIEW AND REZONING
Resoiution No. 91-
WHEREAS, the Pitkin County Board of County Commissioners,
hereinafter "Applicant", has applied for approval of Detailed
Submission for the Rubey Lot 6 Subdivision; and
WHEREAS, the applicant is proposing the following:
1. Rezoning to Interim Zone of AR-2 and Final Zone of PMH;
2. Subdivision;
3. PUD Review;
4. 1041 Hazard Review for Slopes, Floodplain and Riparian
Area; and
WHEREAS, the request. is for 100 Employee Housing, to include
i8 townhomes on an eight acre site, currently zoned R-15 and R-30
PUD; and
WHEREAS, all units are to be deed restricted under current
Guidelines of the Aspen/Pitkin County Housing Authority for
category one and category two income levels; and
WHEREAS, said site is located on the east side of Hunter Creek
immediately north of the Hunter Creek Condominium complex as
described in Exhibit "A"; and
NHEREAS, the Pitkin County Board of County Commissioners has
entered into an agreement with the Hunter Creek Commons Corporation
regarding this project, including certain limitations on future
County construction on its property; and
WHEREAS, the Board of County Commissioners has considered the
overall parking provisions for the site, and determined that the
approximately 1.7 spaces/unit is adequate; and
WSEAEAS, the project received General Submission approval from
the Board of County Commissioners on April 2, 1991, pursuant to
Resolution No. 91-56; and
WHEREAS, the Pitkin County Planning and Zoning Commission,
hereinafter, "Commission", considered the Detailed Submission
application at a regularly scheduled meeting on June 25, 1991; and
WHEREAS, the Commission recommended approval of the Detailed
Submission., subject to conditions; and
WHEREAS, the Board reviewed the Detailed Submission at a
regularly scheduled meeting on July 9, 1991 at which time it was
determined that. the proposal was generally in compliance with
applicable sections of the Pitkin County Land Use Code; and
WHEREAS, at the Pitkin Planning and Zoning Commission's
suggestion the Board oommits to working cooperatively with RFTA to
identify long term transit alternatives for the Hunter Creek area;
and
WHEREAS, the Board commits to replace any plantings installed
pursuant to the approved landscape plan if they do not become
established, even after one full growing season; and
WHEREAS, the Board finds that the proposal is consistent with
the Pitkin County Housing Production Plan for employee housing.
NOW, THEREFORE, BE IT RESOLVED thaf the Board does hereby
grant Detailed Submission approval to the Rubey Lot 6 Townhome
proposal for subdivision, PUD, 1041 Hazard Review and Rezoning,

1. :Prior to issuance of a Certificate of Occupancy the applicant
shall submit Final Plat and Condominium documents for review

Excavation/Foundation Permits:
1. The applicant shall obtain approval of a fugitive dust control
~- plan from the Environmental Health Department and the Co orado
~_ Air Pollution Control Division prior to issuance of any
excavation permits.
2. Prior to issuance of any foundation permits., foundation design
v shall be certified by a professional engineer who shall review ~--
soils engineering studies at a site specific level to insure

proper foundation design in areas where buildings encroach on ~~°;~-~
slopes exceeding 15g. In addition, the following criteria ~~~,;,~ ,
shall be adhered to regarding mitigation of geologic hazards:
a. Cuts shall not be made into slopes steeper than thirty
percent (30~).
b. Cuts and fills, and grading and scraping shall be
confined to the minimum area needed for construction.
c. Steepness of cut and fill slopes shall be the minimum
which will insure stability and still allow revegetation.
d. Use mulches or temporary cover on exposed soil areas and
re-establish permanent vegetation and install erosion
control measures as 'soon as possible.
e. Incorporate natural drainage patterns into the
development plan.
3. Prior to issuance of an excavation permit, the applicant shall
submit water and sewer service agreements to the Planning
Department.
Prior to issuance of an excavation permit, the applicant shall
obtain an access permit from the City Engineering and Streets
Department.
5. Prior to issuance of an excavation permit, the applicant shall
place fen~cingg ~to delineate the limits of the construction area
in orderr~void disturbance of the "Conservation Parcel" and
vegetation outside of the building area.
Earth Moving Permit•
1. The. applicant shall obtain an earth moving permit from the
Building Department prior to commencement of earth moving
within. the Superfund Site. Said permit shall be reviewed by
the Building Department, the City Engineer and the
Environmental Health Department for final approval.
Buildina Permit:
1. Prior to issuance of a building permit, the applicant shall

1. Rezoning of the Rubey Lot 6 Parcel to the interim zone of AR-
2 may occur upon signature of the Detailed Submission
Resolution by the Board Chairman. The property shall be zoned
PMH upon the sale of the last unit and the release of all
construction debt encumbering the project.
2. Both parcels (Development and Conservation) shall be deed
restricted against further development. The Development parcel
is represented as slightly oversized on the detailed
submission exhibits in order to provide sufficient flexibility
to construct the project. The boundary of the parcel shall
be revised to reflect the actual extent of development and
shall be depicted on the Final Plat/Condominium Map which is
to be submitted upon the substantial completion of
construction. The Conservation parcel shall be retained
exclusively in its presen£ natural condition subject only to
the following:
a. Trail improvements represented by the applicant;
b. Other management improvements designed to enhance the
parcel's use for wildlife and/or to maintain the parcel's
natural condition;

10. PERFORMANCE STANDARDSS The following performance standards
sha11_be adhered to and applied to all activity or development
within the Site so as to maintain and ensure the integrity of
"the permanent remedy.
A. Excavation and Construction: Any disturbed soil or
,.material originating from below the permanent remedy
excavation limit or geo-textile liner that is to be
stored above ground shall be securely contained on and
covered with a durable non-permeable tarp so as to
prevent the leaching of contaminated material onto or
into the surface soil. Where such storage is to extend
beyond five (5) days, all stored soil or material
excavated from below the permanent remedy excavation
limit or geo-textile liner shall be securely fenced to
a height of not less than six (6) feet in addition to
• being covered as herein required. All soil or material
excavated from below the permanent remedy excavation
limit or geo-textile liner that is not to be backfilled
at the excavatio~~xrr site shall be removed to the permanent
repository ,~~hin the Site upon approval by the
Aspen/Pitkin Environmental Health Department. Disturbed
soil-or material need not be removed to the permanent
repository if the Aspen/Pitkin Environmental Health
Department finds than (1) the contamination of the soil
or material is less the 1,000 parts per million (ppm) of
total lead, or (2) that there exists a satisfactory
method of disposal do the excavation site and that; the
specific existing topography of the excavation site will
allow for same; and (3) that the remaining capacity of
the permanent repository favors disposal of the disturbed
soil and material at the excavation site..

B. Non-removal of contaminated material: No contaminated
soil or other material shall tie removed, placed, stored,
transported or disposed of outside the boundaries of the
Site without having first obtained any and all necessary
state and/or federal transportation and disposal permits.
C. Dust suppression: All activity or development shall be

accompanied by dust suppression measures such as the
application of water or other soil surfactant to minimize
the creation and release of dust and other particulates
into the air. The Aspen/Pitkin Environmental Health
Department may require air monitoring to insure the
effectiveness of dust suppression measures.
D. Vegetable and flower gardening or cultivation• No
vegetables or flowers shall be planted or cultivated
within the boundaries. of the Site except in garden beds
consisting of not less than eighteen (18) inches of
uncontaminated soil or clean fill measured vertically
from the permanent remedy excavation limit or geo-textile
liner. Clean fill and uncontaminated soil as used in
vegetable and flower beds shall not be borrowed or taken
,.from any other area within the Site.
~`'~~E. Landscaninc: All landscaping activity shall be limited
to a depth of no greater than one (1) foot below the
surface so as not to disturb or penetrate the permanent
remedy excavation limit or geo-textile liner, except for
common areas serving a condominium or apartment complex
where the maximum landscaping excavation depth shall be
six inches (6"). In the event landscaping activity
requires excavation or disturbance below the allowable
one foot or six inch depths, then all performance
standards as set forth in this section (Performance
Standards) shall be adhered to.
F. Restoration and maintenance• Upon completion of any
activity or development within the site the activity or
development site shall be restored to and maintained at
its previous remediated condition.
11. SOILS TESTING. Tlirector of the Aspen/Pitkin Environmental
Health Department may require any person undertaking to
conduct--activity or development within the Site to test any
soil or material to establish its total lead (Pb) content for
purposes of determining the application of any of the
provisions of this section. All testing shall utilize and
adhere to protocols established or approved by the United
States Environmental Protection Agency.
12. INSPECTION AND MAINTENANCE OF PERMANENT REMEDY. Iri addition
to all other requirements as set forth in this section,~the
following additional requirements shall apply to the usevand
maintenance of all lands within the Site, including butlnot
limited to lawns; play areas and parking lots. r
A. All areas within the Site shall be subject to inspection
by the Aspen/Pit]~in Environmental Health Department in
order to enforce the provisions of this Section.
Inspections shall be done with the consent of the
property owner or occupant. If consent .is denied,

inspection shall be obtained pursuant to court. order.
B. All areas within the Site shall be maintained with a
permanent vegetative or hard surface cover. Except as
allowed pursuant to a duly obtained permit issued under
-this section, no person shall. alter any part of a'
permanent vegetative or hard surface cover absent prior
notice to the Aspen/Pitkin Environmental Health
Department.
C. All areas within the Site shall be maintained in a manner
to minimize erosion of the permanent remedy, including
adequate provision for drainage and surface water run-
. off so as to prevent the formation of standing pools,
ditches or gullies.
~ D. 711 lawns and other vegetated areas within any
"'- condominium or apartment common area shall be
conspicuously posted to notify all persons of the
permitted use of such areas. Those areas not intended
for recreational use shall be restricted against all
other uses so as to prohibit or minimize pedestrian and
other traffic. Lawns and vegetated areas may be fenced
at the direction or approval of the Aspen/Pitkin
.Environmental Health Department. All fencing materials.
shall be approved by the Director and may include live
hedges. Fencing shall not be less than three feet, six
inches (3' 6") nor more than six feet (6') in height.
E. Any fence, wall or other barrier installed to limit or
prevent access to any area or location within the Site
shall be maintained in such a manner so as to insure its
effectiveness against trespass or other intrusion.
F. All homeowne~.~dssociations or persons charged with the
maintenance of any common area serving a condominium or
apartment complex shall submit to the Aspen/Pitkin
Environmental Health Department for its review. and
approval an annual maintenance plan for such common
area(s) and a corresponding budget on or before January
1 of each year following completion of full remediation
pursuant to the permanent remedy. Every maintenance plan
.shall include, at a minimum, regular monthly inspection
of all vegetative cover, fertilization of vegetation as
necessary; tegular grass .cutting and the replacement of
dead sod, trees and shrubbery, and the repair;; or
replacement of ,any damaged Fences, hedges and ~iard
surface covers. Every maintenance plan shall alsti be
secured by a bond or other acceptable financial security
guaranteeing the timely and full performance of all
maintenance. Such bond or other security shall provide
that the City of Aspen may draw upon same to undertake
required maintenance in the event an approved maintenance
plan is not being fully implemented. The City of Aspen

shall provide written notice to cure no less than ten
(1oj days prior to taking action as authorized herein to
enforce the terms of any maintenance plan.
No new outdoor playing field, playground, or other
recreational area shall be established or constructed
within the Site, nor shall existing playing fields,
playgrounds or recreational areas be expanded, without
the prior review and approval of the Director and the
Aspen/Pitkin Environmental Health Department.
13. APPEALS: Any person adversely affected or aggrieved by a
decision of the Director or the Aspen/Pitkin Environmental
Health Department made pursuant to this section may appeal
such decision to the Board of Appeals and Examiners pursuant
;,~ to the procedures as set forth in Division 2 of Article II of
Chapter 7 of the Municipal Code.
14. The work associated with this application shall comply and
conform to the requirements of Ordinance No i8 series of 1991
adopted, passed and approved , 1991, by the City

I have reviewed the application for Earthmoving Permit submitted
for this project and.. approve of it based upon the following
conditions•
1) .Approval is for work under the plans and specifications
submitted. The .applicant shall apply for and receive f
additional earthmoving permits for trail work to the Hunter
Creek Trail and for landscaping of `the project prior to
initiation of work on these items.
2) No financial assurance shall be required for the project.
This public project is bound to the requirements of the Pitkin
County Procurement Code and- selected contractors shall be ~/
required to place performance and payment bonds in the amount
of 100$ of the project cost.
3) Mr. Krizmanich's condition that the City issue a permit
regarding EPA procedures has apparently been satisfied by Tom
Dunlop's approval (highlighted in yellow) on the third page '~
of the permit.
4) Mr. Krizmanich's additional condition that the applicant
proceed at it's own risk shall also be included.

I want to thank you for taking time to write a letter pointing out your rnnceras about
mobile home wiring. Al Soron, out master electrician and electrical inspector has answered
some of your specific questions.
Just a brief description of how the mobile home (now':catied manufactured housing, due to
the federally mandated name change by `the department of Housing and Urban
Development) fits into the regulatory Process. `The Colorado Division of Housing was
created by the "Colorado Housing Act of 1970" and began certifying manufacturing plants
in ~ '1'i , rs _tlte bllixy of inspecting mobile homes to ANSI A 119.4.
On June 15, 19T6; H.T7.D:laiplemented the Manufactured Howie Construction ani"Safety
Standards. This act usurps all local, city, county and state authority over inspection of
manufactured homes. ,H.U:D. did update the code to the 1984 N.E.C, liut has not changed
since then.
The`Colorado Division of Housing and other states have recommended to H.U.D. the
adoption of cwrent N.E.C, but Ii.U.D. sites a lack of funding as a reason for not updating
the codes.

This letter is to reaffirm our discussions pertaining to
the Williams Woods. Townhomes and more specifically the
handicapped units.
The 1988 edition of Uniform Building Code was used to
plan check this project. Section 511 has minimum
requirements that xere called out in red ink during the
plan check. If the first tenant is handicapped, then
that unit would have to comply 100$ to sec. ,511 (88
U.s.c.).
However, if the first tenant is not handicapped, then
those items that could be readily changed could be
omitted prior to final inspections. 8gamples:
1. The blocking for grab bars would have to be
installed inside the walls, but the grab bars Nould
not have to be mounted unless you have a handicapped
tenant..
2. The 17~~ to 19~~ high pater closet would not be
required if you did not have a handicapped tenant.
3. Handicapped lavatory would only be required if there
was a handicapped tenant.

The following I hope will answer your questions about the factory built portion
of the Rubey Town house project. The washer/dryer area was not required to be
ventilated because the entry door was located adjacent to the washer/dryer area
and would provide adequate ventilation. The second floor half wall next to the
stairs measured over 36 3/4 inches from the plywood floor, which we felt would
meet the code when carpet and pad were installed.
Thera should be a three foot door in the handicapped adaptable bathroom. This
was pointed out in the plan check review and in tk:e_in-plant inspection and the
manufacturer failed to comply. --I have communicated with the manufacturer and
they know they must change the door.
If you have any other questions or problems with this or any other factory built
project please contact me.
