RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, GRANTING SPECIAL REVIEW, SCENIC OVERLAY REVIEW AND GMQS EXEMPTION OF COMMERCIAL DEVELOPMENTS WITH NEGLIGIBLE GROWTH IMPACTS AND CHANGES IN USE TO THE KAJX ROARING FORK RADIO SITE ON SMUGGLER MOUNTAIN Resolution No. -2002 RECITALS KAJX Roazing Fork Public Radio ("Applicant") has applied to the Pitkin County Board of County Commissioners ("BOCC") to consider a Special Review, Scenic Overlay Review and GMQS Exemption of Commercial Developments with Negligible Growth Impacts and Changes in Use pursuant to Sections 3-60-040, 3-210-020 and 3-150-150 of the Land Use Code to approve and allow the installation of a new equipment structure for an existing radio transmitter facility. 2. The property is located on Smuggler Mountain approximately 1 mile up Smuggler Mountain Road, and is specifically described in Attachment A. The property is zoned AFR-10 and contains approximately 0.52 acres. 4. The BOCC heard this applicafion at a duly noticed public hearing on September 25, 2002, at which time evidence and testimony were presented with respect to this application. The BOCC has determined that the proposed development meets the criteria established in Sections 3-60-040, 3-150-150 and 3-210 -020 of the Land Use Code, and therefore found the proposal to be appropriate. NOW THEREFORE BE IT RESOLVED by the Pitkin County Boazd of County Commissioners that it does hereby grant Special Review, Scenic Overlay Review and GMQS Exemption of Commercial Developments with Negligible Growth Impacts and Changes in Use to the I{AJX Radio Transmission Facility on Smuggler Mountain subject to the following conditions, which shall run with the land and be binding on all successors in interest. 1. The Applicant shall adhere to all material representations made in the application and in the public meetings. 2. Prior to submittal of any building permit applications, the Applicant shall record a 24 x 36 inch mylaz Site Plan in accordance to Section 5-70-040 of the Land Use Code. The site plan shall also be submitted in a digital format for integration into the County Resolution No. _-2002 Page 2 Geographic Information System (GIS). The site plan shall designate a development area for the radio facility that will be approved by Community Development prior to recordation. 3. The structure shall be no larger than 36 square feet and 8 feet in height. The structure shall be painted a color to blend with the natural surroundings. Scrub Oak shall be planted at the base of the structure to assure proper screening of the facility. A landscape plan shall be reviewed and approved by Community Development prior to uilding permit submission. There shall be no increase in the height or number of antennas at the site without further Special Review.. 4. The Applicant shall agree to use the site for potential co-location of other transmitting facilities (i.e. telecommunication facilities), subject to further Special Review. The Applicant shall sign no lease agreement with the property owner that has a lease term of 20 years or greater. 6. The Applicant shall submit a Drainage and Erosion Control Plan to be reviewed and approved by the County Engineer. 7. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 4-140 and C.R.S., § 24-68-105. Galena Street Aspen, Colorado 81611 Re: Letter of Request for Special Review, Scenic Overlay Review, and GMQS Exemption for an Essential Community Facility Dear Tamara: On behalf of KAJX Roaring Fork Public Radio, I am writing to request that the Pitkin County conduct the necessazy reviews to approve the existing radio transmission site located on Smuggler Mountain, to approve a new structure to house the existing equipment required for the tower, and to approve the allowance of additional carriers to co-locate on the site. On 23 October 1990, the site was granted temporary use by the Board of County Cqmmissioners via Resolution No. 90-111. This approval was limited to temporary use in order to permit KAJX to take advantage of an FCC grant for placement of a new transmitter, which had a limited time frame. KAJX was required to return with a permanent application within one year. On 30 November 1990, the County Planning & Zoning Commission heard at first reading the application for a permanent rezoning of the site and recommended approval with conditions. This was followed by a hearing before the BOCC on 12 February 1991. Cindy Houben, functioning as staff planner reviewing the application, indicated that the issues identified by the Planning Commission were antenna height and the size of the requested structure for housing the equipment. At the time, KAJX has requested a structure lazge enough to co-house other possible users in the same structure. The Planning Commission ruled that the size of the structure should be limited to 300 s.f. and the antenna tower should be painted to camouflage its presence. These physical design issues' appeazed to be sufficiently resolved. However, concerns emerged with respect to the lease granted to Kt1JX by Wilk Wilkinson. It was felt that the lease might confer upon Mr. Wilkinson unintended development privileges, and that the lease should be revised. The public hearing for second reading scheduled for 2 April 1991 was tabled. On 11 June 1991,then-County Attorney Tim Whitsitt stated that staff was trying to work with Mr. Wilkinson to obtain more acceptable terms for a lease. The. application was tabled indefmitely and apparently fell by the wayside. It should be noted that on 28 April 1991, County Attorney Whitsitt had prepared a revised "Transmitter Site Lease," which was intended to meet the requirements of the County. It was sent to Mr. Willcinson and Sy Coleman, who was representing KAJX at the time. At the same time, they are seeking approval, based on the Planning ~' Commission's original authorization fora 300 s.f. building, which would incorporate the existing .equipment box into a small shed to allow maintenance to occur inside the structure. This is ,,~,., necessary to ensure the safety of the equipment, since maintenance is frequently required to be performed during stormy weather. It appeazs that a small enlazgement of the structure would be sufficient to meet their needs and would still remain well screened from Smuggler Mountain A^; Road. ~„3 The existing equipment box and radio tower are located at the top of an access road branching off of Smuggler Mountain Road. The existing equipment box is a structure 4'x6'x4' tall. It is painted white, and is shielded from view by surrounding scrub oak and the topography of the site. Moreover, little can be seen of the two adjacent antennas on the site from either the road or ~ the town below. Attached are photos taken from Smuggler Mountain Road, along with a catalog cut of the proposed shed. We believe that the antennas have been effectively camouflaged, and ~""? that the proposed 6'x 6'x 8' shed could remain almost as hidden as the existing equipment box. Subsequent to the 1991 application, this site has been mapped within the Scenic Foreground ~ designation. However, the impact of the transmitter antenna on the site is now well understood. With respect to a somewhat larger building to house the equipment, any intrusion on the scenic ~""' quality of this site would be mitigated by the planting of scrub oak. ~..,, On behalf of KAJX, we would ask if the prior application could be simply "taken off the table" and returned for a final heazing by the BOCC. It would be appreciated if staff could review this '`~'' approach for appropriateness, rather than requiring this essential public facility to proceed ~'"' through the entire hearing process over again. To this end, the County will provide notification of pending applications to the affected adjoining property owners, homeowners associations, and neighborhood caucus groups. Response: The existing neighborhood for the site consists of open space and recreational trails. The site is suitably remote and screened from these pathways 2-120 Scenic Quality It is the policy of the County to preserve its natural, rural scenery for the benefit of its residents and the continued viability of its resort economy. To preserve scenic quality, the County will prohibit or require mitigation of the visual impacts of land uses and " development. ^~ Response: The proposed structure will not cause disruption to scenic quality due to the proposed color, screen planting, and the limited height of 8 ft. From the adjacent public '-~ roadway, the existing structure is barely visible. The proposed structure will be taller, but -~ will be mitigated by the planting of native vegetation for screening. _ 2-160 Wildlife Management It is the policy ofthe County to identify and protect all wildlife habitat for the preservation of wildlife and prohibit land use patterns which would disrupt such habitat. Response: The antenna facility does not appear to have any effect on wildlife. All minor disturbances due to construction will be re-vegetated with scrub oak and native grasses, as these species are the dominant vegetation in this area. 2-280 Compatibility with Public Lands It is the policy of the County to preserve and protect public lands from the impacts of incompatible development by promoting land uses within and nearby public lands which are compatible with the public use of those lands and with the preservation of the natural environment. Response: There is an adjacent ROW to public lands that many people use, both to hike ~-. Smuggler Mountain and as access to the Hunter Creek drainage and other remote areas. ~~ This ROW will not be adversely affected because of the limited use of this site. As stated in Wildlife, and Scenic Quality, this antenna and equipment structure will not impact the preservation of the natural environment. The eight foot height and small size of the structure is the minimum required to provide for servicing the equipment at the antenna site. 77xe antenna size pnd form is as technically required for the propagation of the KAJX signal. 4. The proposed structure and existing antenna do not break the. ridgeline. S. The site is not on the highest ground or most visible portion of the site from Highway 82. 6. The site is located at the greatest distance from Highway 82, without breaking the ridgeline above. 7. Natural vegetation has been and will be preserved on the site; additional oak plantings will be undertaken for screening of the proposed new structure. 8. No exterior lighting is provided. 9. Landform and earthmoving is not required as part of this application. 10. The antenna location is not located within any Scenic Viewplane. 11. No identified 1041 issues conflict with these provisions. ,-, --. 3. Responses to Section 3-150-140 GMQS Exemption of an Essential Community Facility ~-~ A. General: Response: KAJX Roaring Fork Public Radio addresses all issues in this section. It is a fundamental community radio service, it is available to the general public, -, particularly the local community, and it is not a growth generator, but an informational system. B.
