ROWARS, hereinafter referred to as "Rowazs") and THE BOARD OF COUNTY COMMISSIONERS. OF PITKIN COUNTY hereinafter referred to as "BOCC". WITNESSETH: WHEREAS, Rowars has caused a gazebo structure to be constructed upon real property owned by BOCC in Pitkin County, Colorado, and WHEREAS, Rowazs and BOCC are desirous of memorializing their agreement regarding the removal of this structure from the BOCC property, NOW, THEREFORE, in consideration of the mutual covenants and conditions contained herein, the parties agree as follows: i. Removal of Gazebo. Rowazs shall have until July 1, 1998 in order to remove the gazebo from the BOCC property. Prior to said removal, Rowazs shall apply for and receive the appropriate demolition permit from the appropriate officials of Pitkin County allowing the removal of said structure. All of the costs of removal of the structure and restoration of the property to its original condition shall be borne by Rowars. 2. Security for the Performance of Rowars' Oblieations. As security for the performance of Rowars' obligations hereunder, Rowars shall depos4 with the BOCC the sum of Three Hundred Dollazs ($300.00), that being the estimated amount of the cost of the removal of the gazebo as made by Greg Kazaus, Builder. Greg Karaus' estimated cost of the removal is attached hereto as Exhibit A and incorporated herein by this reference. Upon the removal of the gazebo from the BOCC property on or before July 1, 1998, this amount shall be refunded immediately to Rowars by the BOCC. 3. Failure to Remove Gazebo. In the event that Rowazs fails to remove the gazebo on or before July 1, 1998, the BOCC may immediately cause the removal of said gazebo without further notice to Rowazs. After removal, the materials from the gazebo may be deposited upon the driveway of Rowars' adjacent property. Rowars shallbe responsible for all of the costs of the removal. of said gazebo and the restoration of the land to its natural state.. The cost of said removal and restoration may be deducted by the BOCC from the Three Hundred Dollazs ($300.00) delivered to it simultaneously herewith by Rowazs. Upon the removal of the gazebo and the restoration, any remaining funds shall then be returned to Rowars by the BOCC. 4. Removal of Other Items on BOCC Property. Rowars agrees that the BOCC may remove the basketball standazd presently located on the BOCC property near Rowazs' home without any objection from Rowars. Attorneys' Fees. In the event of any litigation or arbitration between the parties arising from the terms of this Agreement, the prevailing party shall be entitled to collect all of its reasonable attorneys' fees, litigation expenses and court costs. 6. Specific Performance. In the event of default hereunder, the parties shall have such remedies as aze available to them pursuant to the Contract and at law or in equity including, but not limited to, the right of specific performance. 7. Binding Effect. The terms and conditions of this Agreement shall extend to and be binding on the heirs, successors, legal representatives and the assigns of the parties hereto. 8. Entire Agreement. This Agreement contains the complete understanding of the parties and it is specifically agreed all discussions, oral or otherwise, shall be deemed to be merged herein. DATE: July 1, 1997 SiJivili LARY: The applicant is requesting approval of an 8040 Greenline Review in order to build an addition to an zxisting residence at 131 Smuggler Mountain Road. The proposed addirion would extend the existing dining room area eight (8) feet to the south as well as add a second floor above the existing gazage. The dining area addition would. include approximately 1~~ square feet of floor area. The new second door above the gazage would encompass approximateiy 487 squaze .feet of floor area and would accommodate a study and work-out area. There is also a small amount of storage area that would be added between the existing garage and the existing bedroom. LOCATION: Lot 7 of the Sunny Park Notch Subdivision is located at lit Smuggler Mountain Road in the City of Aspen. The lot is bounded by an existing residence to the south, vacant land to the north and east, and Sesame Street and Pazk Circle to the west. (See vicinity map on sheet Al of the bluelines). ZONING: Moderate-Density Residential (R-15/PUD) LOT SIZES: Lot 7 of the Sunny Park Vorrh Subdivision (131 Smuggler Mountain Road) = 16,191 square feet of which 1,423 square feet are on 20°.!o to 30%v slopes, and another 5,983 square feet aze on slopes in excess of 30%, resulting in a net azea of 8,496 square feet from which to calculate the allowable floor azea of the lot. These. calculations are preliminary and will be subject to verification by the City's Zoning Administrator during review of the building permit application. ALLOWABLE F_~R: _ Based on the above described calculations of lot area, 3.939 squaze feex of floor azea will be allowed on the subject pazcel (this F.aR calculation is an estimate only; it may not take into account all slope reductions, .sub-grade azeas, or garage area calculations). REVIEW PROCEDURE: As the proposed development falls within 160 feet of the 8040' elevation contour and does not. meet ..the exemption provisions of Section 26.68.030(B) of the code, an 8040 Greenline Review is rauired. 8040 Greeaine Review is an Environmentally Sensitive :area (ESA) review and is, therefore, cone-step process culminating in a public meeting before the Planning and Zoning Commission. The following sections of the code are. applicable to the 8040. Greenline; Section 36.68.030(C), $040 Greenline Review. Standards; and, Section 26?8A50, Moderate- Density Residential (R-15). BACKGROUi`ID: The proposed additions to the Rowans Residence were reviewed by staff against the Residehtial Design Review Standazds of Section 26.58.040. Staff found the proposed design to comply with all but one of the design standards, namely standard 26.58.040((F)(12), Volume. Under the "volume" standazd, the applicant is left with three (3) options when it is determined. that the proposed design does not comply: first, the applicant can choose to redesign the proposal to comply with the standazd; next, the applicant can appeal staffs finding to the Desiga Review Appeal Committee or other appropriate board; lastly, the applicant can choose to accept a floor area penalty which would count the area in violation twice (2:1). The applicant has chosen to accept the floor azea penalty (third option); consequently, the area of the dining room (164 square feet) will be double-counted as 308 square feet of floor azea. These eleven (11) standazds and taff's responses follow. 1. The parcel on which the proposed development is to be located is suitable for development, considering its slope, ground stability characrerisrics, including mine subsistence and the possibility of mud flotiv, rock falls and avalanche dangers. If the parcel is found to contain hazardous or toxic soils. the applicant shall stabilize and revegetate the soils, on :vhere neczssary, cause them to be removed from the site to a location acceptable to the city. RESPONSE: The parcel has not been found to .contain hazardous or toxic soils. The footprint of the existing building would expand by just 1 L square feet or so into an area already covered by the existing deck. There aze no known hazards existing in *.he area proposed for development, and the parcel is considered to be suitable for development. 3. The proposed development does not have a sign cant adverse affect on the natural watershed, runoff, drainage. soil erosion or have consequent effects on water pollution. RESPONSE: The proposed development would not have a significant adverse affect on the natural watershed, nor cause increased runot~ drainage or soil eroson.,..The proposed addition to the building footprint at the dining azea is within the footprint of the existing deck. The proposed development would be Located well outside of the flood plain of the Roaring Fork River. Staff does not feel that the proposed development would have a si~tificant adverse impact on the natural watershed, runoff, drainage, or soil erosion, nor would it have consequent effects on water pollution. „, 3. The proposed development does not have a significant adverse affect on the air quality in the city. RESPONSE: There should be no significant impacts on air quality from the proposed development. 'The proposed additions would contain no wood burning devices. The design and focation of any proposed development, road or trail is compatible with the terrain on the parcel o>~which the proposed development is to be located. RESPONSE: The design and location of the proposed additions are compatible with the terrain based on the fact that there is an existing structure, the construction of which addressed ground stability issues and soil conditions. The applicant has indicated that the existing foundation is adequate to support the load of a second story above the garage. The dining area addition is well within an essentially flat area and will pose no problems related to terrain. Also, the proposed design of the addition is a continuation of the existing design in terms of plate heights, roof type and fmish materials. 5. .dny grading will minimiae, to the extent practicable. disturbance to the terrain. vegetation and natural features. RESPONSE: The applicant has represented that, in the azeas .where. zxcavation is required, the existing grades will be maintained to the extent allowed by building codes and standazd building practices. RESPONSE: Because there is an existing residence, no new roads would be required. The development would not include any "cut and fill" and grading would be minimized. In addition, the project has been designed to minimize the visual impact of the additions by maintaining roof lines and types, and ensuring that new roof ridge lines are below the highest point of the existing house. Staff believes than. the proposed development plan complies with this standazd, i. Building height and bulk will be minimized and the structure will be designed to blend into the open charaazer of the mountain. RESPONSE: As mentioned in the staff response to the preceding standard, the project has been designed to minimize. the, visual impact of the additions by maintaining roof ` lines and types, and ensuring that new roof ridge lines aze below the highest point of the existing house. The roof and site plan show drains appearing to empty onto the slope and the drywell to be downhill on the slope causing a saturation problem on the hillside. The Planning and Engineering Offices would like to see revised plans. 2. Jim Gibbard requested that the Plans Checker in the Building Department review in detail the foundation design to be sure that it complies with Condition #1. We noted that Mr. Pattillo's stamp is on the drawing, as required, but we did not analyze if the Foundation Plan on sheet S-1 shows the structural capacity to bridge any weak zones. On Sheet S-1 I circled the general area where a depression exists, representing a potential weak zone. 3. We suggest that the applicant be required to present their plan for utility alignment and revegetation as part of the building permit application, to insure compliance with conditions #5 and #6. 4. SITE DATA: Lot Size: 15,191 square feet Proposed House: 2,700 square feet Max. Allowable FAR: 4,093' square feet APPLICANT'S REQIIEST: Marvin and Barbara Goldenson, contract purchasers of Lot 7, request 8040 Greenline Review approval to build a single family house. The house would be located on an upper bench on the lot and accessed through the County on the Smuggler Mountain Road. BACKGROUND: The Sunny Park North Subdivision was created through approval of the County Board of County Commissioners in 1965, and was annexed into the City through the Berumen Annexation in 1966. Lot 7, owned by Pitkin County, was reconfigured to add 6,900 s.f. to the north of the platted lot and subtract 6,900 s.f. to the south where Park Circle goes through. The subdivision exception to accomplish this change was approved by City Council on January 26, 1987. Included in the conditions of approval. for the subdivision exception were: (1) the applicant will submit a specific building envelope as part of the 8040 review and (2) the 8040 Review will include an additional subsurface investigation made on .the. site. of development to evaluate the risk of subsi= dence due to underground mining, pursuant to recommendations made by Chen and Associates in'"Subsoil Study and Underground Mine Works Review: Proposed Residence Lot 7, Sunny Park North," dated December_30, 1987. APPLICABLE SECTION OF THE MUNICIPAL CODE: Development within fifty (50) yards below the 8,040 elevation is subject to a special review by the Planning and Zoning Commission according to Section 24-6.2 of the Municipal Code. PROBLEM DISCUSSION: ~--~, A. Referral Comments: 1. Engineering following points um (attached): ~~. ~ h ' Department: Jim Gibbard addressed the of concern in his August 11, 1987 memorand- a. The Engineering Department advises following the recommendations of the geotechnical reports prepared by Chen and Associates, Banner and Associates, and Pattillo Associates. The northwest corner of the proposed building is located over a depression that was referred to in the Banner report as a possible capped shaft or air vent. As recommended by Pattillo Associ- ates, the foundation should be designed with the structural capacity to bridge any weak zones. b. The Engineering Department can accept the proposed alignment of the utility lines (see attached map), but would like to see a revegetation plan for the area of their excavation which would include the replanting of the existing Service Berry and Potentilla bushes. c. Roof drains should be installed on the west edge of the west sloping roof and the runoff should be diverted to drywells located far enough away from the edge of the slope to prevent a saturation problem on the hillside. 2. Fire Marshal: Wayne Vandemark commented in a July 24, 1987 memorandum that he strongly suggests that a residential sprinkler system be incorporated in the design of this structure because it will be in a potential wild fire area. 3. Water Department: In a letter dated July 9, 1987 Jim Markalunas verified that water pressure is sufficient at 8,000 feet elevation and water can be provided to the Lot 7 building site. B. Staff Comments: The Planning Office has the following comments with regard to the 8040 Greenline review criteria: Criteria: (1) Whether there exists sufficient water pressure and other utilities to service the intended development. Response: Sufficient water pressure and other utilities (sewer, gas and electric) appear to exist to service the intended development. Location of the utilities will be discussed below regarding concern for disturbance of the terrain. Criteria: (2) The existence of adequate roads to insure fire protection, snow removal and road maintenance. 2 L ~""~ , ,€""~, , Response: Access to the house up the Smuggler Mountain Road should be adequate. The County committed to plow snow and ..maintain the road up to the driveway into the property. Even though the road is steep, fire protection can be provided according to the Fire Marshal. Regarding fire safety of the house, please note that the Fire Marshal suggests installation of a sprinkler system, however, it dad not recommend that a sprinkler be Yequired as part of this review. Criteria: The suitability of the site for development considering the slope, ground instability and possiblity of mud flow, rock falls and avalanche dangers. Response: One of the key concerns in developing Lot 7 is the potential. for ground subsidence due to mining cavities. Following through with the private geotechncal recommenda- tions and the Engineering Department comments, the 'founds- tion should be designed by a qualified structural engineer to achieve the structural capacity to bridge any weak zones. No mud flow or avalanche dangers have been identified on the site. Criteria: (4) The affects of the development on the natural watershed, runoff, drainage, soil erosion and concequent effects on water pollution; and (7) whether the proposed grading will result in the least disturbance to the terrain; vegetation and natural land features... Response: With regard to disturbance of the terrain, we have identified the following concerns: (a) keeping the structure on the relatively flat bench and off the hillside, (b) run-off from the west facing roof-that could channelize down the hillside, (c) trenching the utilities down the hillside and (d) revegetation of disturbed areas. We agree with the applicant that disturbance of the terrain is minimized by building on the flat bench area, contrasting with the development on the hillside of houses on Sunny Park North Lots 3 and 5. Treatment of runoff recommended by the Engineering Department should be incorporated in the building plans. Two utility trenches would come down the hillside, 2 1/2' wide and 3' wide respectively. The proposed utility ditch alignments are" acceptable, in our opinion, if proper revegetation is accomplished. The applicant's commitment to backfill the ditches immediately, seeding with a mixture o~ natural vegetation and covering with hay should be imple- mented along with the suggestion by Engineering to trans- plant existing service berry and potentilla bushes to those 3 e~1. i A F:..-.': disturbed areas. Native vegetation, including aspen trees, should be replan- ted where disturbed around the house and along the western edge of the bench. Criteria: (5) The possible effects on air quality in the area and citywide. Response: Only one wood-burning device is proposed. This commitment will minimize air pollution impacts. Criteria: (6) The design and location of proposed structure and its compatibility with the terrain; (8) The placement and clustering of structures so as to minimize roads, cutting and grading, and increase the open space and preserve the mountain as a scenic resource; and (9) The reduction of building height and bulk to maintain the open character of the mountain. Response: The design of the house to be located on the bench, stepped back away from the edge of the hillside, and with rooflines mainly corresponding to the angles of the hillsides will reduce visual impacts and will be largely compatible with the terrain in our opinion. Perspective studies done by the applicant indicate that the proposed house should not be visible from most locations in Aspen; and it will be less visible. than the Lots 3 and 5 houses on the same hillside. The applicant stated woodsiding and either a metal or shake roof will be used. We suggest that a shake roof would be more in keeping with the character of the mountain. We recommend earthtone colors of all building materials. The building envelope (see Exhibit C) is very suitable for development in that it is very flat as opposed to other lots in the neighborhood. The Subsoil Study by Chen & Associates of 30 December 1986 (Exhibit D) and the ;eotechnical Report on subsidence probability and development potential of Lot #7 (see Exhibit E) point out no unusual soil conditions on this lot. Exhibit E states as its conclusion "Based on..........4spen." A feasability study by our own structural engineer, Platillo & Associates (Exhibit F) clearly points out the lack of problems concerning development as regards soils and drainage. The possibilities of mud flow, rock fall and avalanche danger are virtually non-exis- tant. The proposed development will have very minimal impact on soil erosion, runoff etc. This is due to the flat nature of the building envelope, the fact that it does not lie in a natural drainage, and the fact that the building itself will need no drainage requirements other than those accepted as standard proceedure for this area (i.e. standard footer drains and positive drainage away from the building). G 1 _ Page 3 The utilities will run from the building envelope in a westerly direction to the property line, Precaution will be taken to minimize disruption to the natural vegetation on this slope, Backflling and reseeding will commence immediately upon completion of the back- filling and will proceed as follows: carefully grade disturbed areas, seed with native grass mix, cover with layer of hay. 5. The proposed structure contains only one wood burning device and this will add .less air pollution than many existing residences. 6, There will be no new road cuts caused by this develop- ment. Access to the garage will require only a 20' driveway constructed at present grade, The design and location of the proposed structure has been designed to be compatible with the terrain as explained below. 7, The proposed grading around the finished structure will return the grade to very near its natural state, At no place within or around the structure will there be a retaining situation of more than approximately 4 feet. .(see Exhibits C and G) $. The placement of the structure results in no additional roads and very minimal cutting and grading around the house. This is again due to the flat nature of the building envelope which avoids the steeper portions of the western portions of the lot, 9. The height and bulk of the building are both well below standards set by the city. The highest roof line is approximately four feet below the 25 ft limit. The total square footage requested (2700 Ft2 + garage) is significantly less than the 4506 Ft2 allowed by code, Furthermore, the roof planes have been designed to blend with the hillside. Eaves are kept low and roof pitches run parallel to the hillside on the west. It should be emphasized that the building will be built on a flat bench and will be a great deal less prominent than other buildings on this slope. C=~ ' i ::I INTRODt7CTiON ~' I i; rr i', ii The purpose of this study was to determine whether there was a ~ suitable building site"in the upper portion of Lot 7 which was not subject to subsidence problems or," if there was a small chance of subsidence problems, how these could be mitigated_by special design or other techniques. The literature included the i Resource Engineering geotechnical report for Centennial which ~ dealt with some problems to the north of this site, the Western Engineers geotechnical report on Lots 3 and 5 to the south of Lot 1 7, the geologic field study by Dr. Nicholas Lampiris on Lots 3 and 5, and the preliminary soils investigation by Chen & Associates on Lot 7. In addition, aerial. photographs and geologic mapping of the area in general were studied. There are two sink-like depressions, although quite small, on or directly adjacent to'Lot 7, so it was decided that a drilling program would be cost effective to determine with maximum surety that the lot would be developable fora typical sin doer mm Was dwelling of 3000 square feet or less. The drilling p g open-ended and was directed by Dr. Lampiris in the field as data i became available through the drilling. A total of three holes ', were drilled either within or just out of the proposed building ~ footprint (see accompanying location map). GEOLOGY The geology at the site consists of the Quaternary age moraine deposits which contain silts, sands, cobbles and boulders in an unstratified and unsorted manner deposited directly upon, in this area, Precambrian quartz monzonite and Paleozoic units such as the Beldon Shale, and Leadville Limestone. `Just as"on Aspen Mountain, the Smuggler Mountain area~is complexly faulted with normal and reverse faults, making it very difficult to_,predict without drilling what units are in the subsurface.(see copy of the geologic map by Bryant, 1972). Obviously, since Aspen was an historic silver mining town, silver and other metals such as lead, copper and zinc were taken from the ground in this area as evidenced by many of the mine workings on the Smuggler Mountain hillside. The Molly Gibson mine had at least two shafts, one of which, it is presumed, is near, if not on, Lot 7; however, that is not clear in my mind because the small depression near drill hole #3 does not seem extensive enough to have .been a entry shaft f.o the Molly Gibson:mine. It may, however, have been `an air vent for some underground. workings. i ;~ ,~~ ~ _ .. n. ; ., .~,, ~ ; . , HISTORICAL DATA The Western, Engineers, Resource Engineering and Chen reports discuss the general mining history of this area and deal to some` extent with the mining history in and around Lot 7. Their data comes from existing maps and also from conversations with Steffen Albouy, a local miner with .claims in this area of Smuggler Mountain. Their general conclusions can be seen in detail either in the previously mentioned recent reports or by studying the geologic and mining history. In summary, they conclude that there are no near surface tunnels in this area, and that geophysical methods employed by Western Engineers in and around this area indicate that there is only the potential for one tunnel in this area. It would be near the base of the hill at the west end of Lot 7, not affecting the potential building site. There are apparently no historic maps that show tunneling ! directly under the site, although it is possible. that at great depth some unmapped tunnels or drifts may have crossed in the direction of Lot 7. Once again, the purpose of the drilling ~ program was to determine whether there are a,ny significant ~ tunnels, stopes, or other voids within a reasonable distance below the proposed building footprint. DRILLING PROGRAM The Sheldon Drilling Company was engaged by the County to work under our supervision to drill the necessary holes to determine whether the site was suitable for the development of a single family dwelling. Three holes were drilled. Hole #1_attained a total depth of 120 feet (see driller's letter). `Phe overburden at the site was approximately 20 feet thick, followed by what appeared to be 50 feet of weathered granite with the remaining 60 feet in solid granitic rock. No voids were entered. Drill hole#2 went to a total depth of 115 feet with very similar results except that a few feet of black shale, presumably the Beldon Formation of Mississippian age, was entered at the base of the hole. This is an unusual situation, meaning that Precambrian age granite has been. faulted .over much younger age shale. Another interpretation is that granitic bedrock was never actually entered and that the driller was picking up a very thick and compact sequence of boulders which appeared to be granite bedrock. This is not likely in the driller's opinion. Granitic boulders and the accompanying sands and cobbles of a glacial deposit drill much differently than granitic bedrock. It should be pointed out the terms granite and granitic are loosely used in this report for the actual rock which is called a_quartz monzonite. It contains lower percentages of the black, mafic minerals such as hornblende and biotite. ,Again, no voids were encountered.. :~ ...~-~ ~~ ~~ ~. . ~ E At this point, we felt fairly comfortable that there„were no significant voids within a reasonable distance below the proposed building site, but we were still concerned with the presumed sinkhole as shown on the. accompanying map. Therefore, a drill hole was put down-very close; if not actually on, the edge of the depression to see if it was a plugged air shaft or merely an old _. prospect pit. The drilling proceeded 40 feet in what was either granitic rubble or weathered granite bedrock. The most likely explanation is .that there was initially granitic rubble filling up some depression, and then'the granite bedrock waS entered. There was no evidence at this site of any voids, although it still must remain a possibility. For this reason, we'feel it is important that the County require a cement plug to fill this depression in the unlikely event that it is a capped air vent or shaft. Development should not be allowed in the immediate vicinity of this feature.. EVALUATION OF SUBSIDENCE POTENTIAL There are several scenarios which must be evaluated: 1. That no voids were entered, and that none exist between or .adjacent to any of the drill holes, and that further, there are no significant voids. within 100 feet of the base of the two deep drill holes which were put down. This is the best case scenario ~. in which there are no restrictions to development at the surface as planned. 2. Drill holes encountered no voids but tunnels may exist between or adjacent to the drill holes which would'be on the order of 8 X 10 feet .in cross section. TYAis is an acceptable situation which will be shows to be safe by 'another look at the historical data and by rock strength calculations based on the presence of one. or two tunnels or drifts bwneath the site. 3. There are no tunnels within the, depth drilled.in the first two holes, but there may be tunneling or even large stoping at depths exceeding 120 feet below the .Lot 7 proposed building site. This scenario also is acceptable based on the engineering calculations to follow. 4. This scenario is based on the assumption that the drilling interpretation was not entirely correct and that more 'overburden was penetrated than is now assumed. Suggestions as to net gain or loss of weight at the surface attributable to a new structure, and perhaps some special foundation design criteria nclu""ding longer grade beams than are usually required for a home of the planned size will follow. 5. If more mining is done under this site in .the future, then this report and .evaluation is_void. ~~ CONCLUSION Based on our engineer's calculations (see attached) and my own interpretation of the data, I see a very low risk of subsidence of the building site. There is a higher risk in areas of downtown Aspen. The recommendations of our engineer and my own suggestions should be .followed. REFERENCES 1. Conclusions: ~~ Since the foregoing computations were. based on .assumptions, they must be considered approximate. If no underground openings exist except deeper than the bottom of the two deep drill holes, the computations show that the site is safe. The massive granite easily spans the 10 foot opening with small deflection and stress. The material above the theoretical granite beam was assumed to act strictly as dead load in the computations while actually this would not be the case. There may exist above the theoretical beam other layers which also act as beams which would contribute to the strength of the mass overlying the opening. Also the overburden near the surface would exhibit a bridging action which would reduce the direct dead load on the theoretical beam thereby reducing the stress and deflection which are already smal L If the opening is below the water table, it is probably filled with water which would resist subsidence. If underground openings exist closer to the surface than the bottom of the deep holes, the depth of the theoretical granite beam would be reduced but also the depth of cover`'would be reduced thereby reducing the stress and deflection. The computations show that a 10 foot deep granite beam will also span a 10 foot wide opening. If large stoping exists at depths deeper than the bottom of the ' drill holes, caving, if it occurs is predicted at extending from 35 feet to 50 feet above the stope and fracturing of the rock above the caved portion is predicted at extending from 150 feet to 200 feet above the stope. However, because of"the massive granite which appears to underly the site, it appears to be unlikely that such caving has or would occur. The above values vary with the mined height, which is unknown. In order to reduce the disturbance to existing underground conditions, we suggest that an amount of material, as from a basement excavation, equal to the weight of the structure be removed from the site. PURPOSE AND SCOPE OF STUDY This report presents the results of a subsoil. study and underground mine works review for a proposed residence to be located. on Lot. 7, Sunny Park tdorth, Park Circle, Aspen, Colo- 1 rado. The study was conducted for the purpose of developing foundation recommendations and included a revie,w,of mine records maps. The project site is shown on Fig. 1. The study was conducted in accordance with orar• _Agreerneht for Prof~ssiohal I Engineering Services to Pitkin County Planning, dated December 8, 1986. I ` A field exploration program consisting of exploratory borings and a field reconnaissance was conducted. to obtain information on j subsurface conditions. The results of the field exploration and laboratory testing are presented herein. A review of information on mine workings in the area of the site was made to evaluate the potential for mine related f4 subsidence. ., This report has been prepared to summarize the data obtained ~ during this study and to present our conclusions and recommen- [. dations based on the proposed construction, the. subsurface conditions encountered and the mine workings information re- viewed. If building and grading plans for the residence are signifi- cantly different from those assumed above, we should be notified to reevaluate the recommendations presented in this repbrt, SITE CONDITIONS The subject property consists of a vacant lot near the end of Park Circle as shown on Fig. 1. Park Circle has been connected to .Park. Avenue and the lot is separated-from the road by the Salvation Ditch. The central portion of the lot appears to have been 'graded relatively flat, Thee western part of the lot is a steep slope down to Park Avenue. We understand the proposed building site is within the flatter part of the ot. The Smug- gler T~line is located northeast of the property and access onto the lot is from Smuggler Mountain Road. At the time of .our field work, the lot was covered with about 1 1/2 feet of snow. Vegetation generally consists of scrub brush, grass and weeds. Two relatively broad surface depressions are located on either side of the general building area, The depressions appear to be a few to several feet deep, 4Te under- stand the depressions are probably related to past mihing activities in the area. The Salvation Ditch, which is ih a culvert, crosses the toe. of the steep slope adjacent to the western part of tl~e lot, ~il~ ry'4ma+Wm.NM1'/~wPLw u. ~ ' ~"mYVYti ' ~~ r .,, ~ _~`- SUBSOIL CONDITIONS ~. The subsoil conditions in the proposed building area were evaluated by drilling two exploratory borings at the approximate locations shown on Fig. 1. The borings were drilled to a depth sufficient for foundation analysis and were not intended to evaluate mine subsidence potential below the site. Graphic logs of the subsurface profiles encountered are. shown on Fig. 2. As indicated by the logs, the subsurface profile encountered is ~~ relatively uniform and consists of medium dense to dense silty S sands and gravels with cobbles and boulders. Subsoil studies ." performed_in_the area and on adjacent lots indicate a similar subsurface profile. The drilling with continuous flight auger was relatively difficult due to the material size and density and practical refusal to augers was experienced at a depth of 15 feet at Hole 1. Free water was not encountered in the borings to the maximum depth drilled, 26 feet, and the soils were generally 1! slightly moist. ~=~-' ::.. Samples taken from the borings were returned to our labora- tory for review by the project engineer and testing. The results (X. ; of moisture content and classification testing performed on the , ;~ samples are presented in Figs. 4 and 5 and summarized in Table I. The gradation analyses were performed on_ material smaller than 1 1/2 inches. REVIEW OF MItJE WORKINGS AND SUBSIDENCE POTENTIAL The scope of our study included a review of published data on the abandoned .mine workings in the project area, a review of _. ._. _ _ _....__.. a p -5- subsidence eveluations~ for adjacent properties, and a general review of published data on the site geology. Site Geoloav: The site i:s located on the northern slope of the Roaring Fork Valley. Regional geologic mapping (Bryant, 1971) indicates the surficial soils on the site ar•e glacial morraine deposits, poorly sorted materials. ranging from silt to boulder sized. The underlying bedrock geology includes a complexly ';~ faulted series of Cambrian to Permian-age sedimentary rocks and i Precambrian igneous rocks. Mineralization of the bedrock with.. silver, lead ahd zinc. atEracted intense mining activity in the ~ project area, mainly intermittently in the years between 1879 and ~ 1935. Some minor mining activity has continued in the general area to the present time. Mine Records Review: Maps of the major mining in the project area indicate the site i.s in arr area of extensive mine develop- ment (Rohlfing, 1943 and Bryant, 1972). Mines in the area ~ followed a steeply, northwestward dipping ore zone and included '~ at least fifteen levels, extending at least a thousand feet deep, with miles of tunnels and hundreds of stopes. Although it is .difficult to accurately locate the mi`rle workings with respect to ,, the property, it appears that the site is in the vicinity of the workings of the ffollie Gibson Mine, Most of the minhg appears to lie north of the site . s Surface Indications of Mining Activity: As shown on' Fig. 1, there are two depressions in the ground surface near the_ site. It is likely that these features are a "result of subsurface mining. The depression near the northern lot line has been Chen&Associates i ` ~*' -Ci' ., identified as the location of tFe Mollie GiUson !11 shaft (Llestern Engineers, Inc., 1986). The depression near the eastern property line may be related to an air shaft or incline portal. Potential Impacts of Subsurface Minim: Based oh published data, the potential impacts that the underground mines may have on site development cannot be accurately determined. The uhderground mining in the area is extensive and mine maps often do not accurately portray the extent of mining. The risk for• ground subsidence and damage to structures built on the site may be high. Additional subsurface investigatiohs uti izing deep drill holes are recommended to better evaluate subsidence risks on the site. Sinkholes often occur abruptly in the area of mine shafts, due. to collapse of bridged soil and debris used to backfill the openings. If the site is not developed, the Afollie Gibson shaft may still be a hazard because of this collapse potential. FOUNDATION RECOMMENDATTONS The undisturbed ..natural soils encountered in the exploratory borings should be suitable to support a spread footing foundation of a residential structure. Settlement potential of the struc- ture due to foundation loading on the soil is expected to be relatively low. Subsidence potential risks due to underground r:~ine works are presented in the "Review of Mine [dorkings and Subsidence Potential" section of this report. The owner should consider the mine related risks in the development plans for the lot. (1) Footings placed on the undisturbed natural soils should be designed for an allowable soil bearing pressure of 3,000 psf. We expect. settlement of foundations designed and constructed as discussed in this section will be less than 1 inch. (2) Spread footings should have a minimum width of T6 inches fdr continuous footings and 2tl inches for isolated pads. (3) Foundation walls acting as retaining structures should be designed to resist a lateral earth pressure corresponding to an equivalent fluid unit weight of at least 40 pef. The. foundation walls should be backfilled with granular soil like the on-site soils and compacted to at least 90 percent of standard Proctor density at a moisture content near opti- mum. The lateral earth pressure assumes a 'relatively hdri- zontal backslppe grade and a drained condition. (4) Exterior footings and footings beneath unheated areas should be provided with adequate soil. cover above, their bearing r, elevation for frost protection. Placement of foundations at least 42 inches below. the exterior grade is typically used in this area. (5) Continuous foundation walls should be reinforced top and bottorn to span an unsupported length of at least 10 feet. (6) Areas of loose, disturbed and topsoil materials encountered within the foundation excavation should be removed and the footing bearing level lowered to adequate natural bearing material. ~, (7) A represehtatibe of ttie soil engineer should observe all i; footing excavations prior to concrete placement, i~ FLOOR SLABS The natural on-site soils are suitable to support lightly to moderately loaded slab-on-grade construction (neglecting mine subsidence potential)., To reduce the effects. of some differen- tial movement, floor slabs should be separated from all bearing walls. and columns with expansion joints which allow unrestrained vertical movement. Floor slab control joints should be used to reduce damage due to shrinkage cracking. 6Je suggest joints be provided on the order of 15 feet on center. The requirements for slab reinforcement should be established by the designer based on experience and the intended slab use. A thin layer offree-draining gravel may be placed beneath the slabs, This material should consist of minus 2-inch, aggre- gate with less than 50 percent passing the No. 4 sieve and less than 12 percent passing the No. 200 sieve. Fill-placed beneath floor slabs should be a granular mate- rial. The soil engineer should evaluate the suitability of proposed fill materials. Fill should be placed ahd compacted to Chen &Associates _g. .. ~~_ at least 95 percent of the eiazimum`standard Proctor density near optimum moisture content. We expect the on-site soils, devoid of vegetation, topsoil and oversized rocks, can be used as fill material. SURFACE DRAINAGE The following drainage precautions should be observed during construction and maintained at all tunes after the residence has been completed. (1) Excessive wetting or drying of the foundation excava£ons and { underslab areas should be .avoided during construction. (2) Exterior backfill should be adjusted to near optimum moisture and compacted to at least 95 perneht of the maximum standard ; Proctor density in pavement areas and to at least 90 percent of the maximum standard Proctor density in .landscape areas. If no underground openings exist except deeper than the bottom of the two deep drill holes, the computations show that. the site,is safe. The massive granite easily spans the 10 foot opening with small deflection and stress. "The material above the ,theoretical granite beam was assumed to'act strictly as'dead load in the computations while actually this would not be the case. There may exist above the theoretica beam other layers which also act as beams. which would contribute to the strength of the ,mass overlying the opening. Also the overburden near the surface would exhibit a bridging action which would reduce the direct dead load on the theoretical beam"thereby reducing the stres5`and deflection which are already small. If the opening is below the water table, it is probably filled with water which would resist subsidence. If underground openings exist closer to the surface than the. bottom of the deep holes, the depth of the theoretical granite beam would be reduced but also the depth of cover would be reduced thereby reducing the stress and deflection. The computations show that a 10 foot deep granite beam will also span a 10 foot wide opening. If large stoping exists at depths deeper than the bottom of the drill holes, caving, if it occurs is predicted at extending from 35 feet to 50 feet above the stope and fracturing of the rock above the caved portion is predicted at extending from 150 feet. to 200 feet above the stop e. However, because. of the massive granite which appears to underly the site, it appears to be unlikely that such caving has or would occur. ,The above values vary with the mined height, which is unknown. In order to reduce the disturbancg,to existing underground conditions, we suggest that an amount of material, as from a basement excavation, equal to the weight of the structure be removed from the site.
