Pursuant to Subsection 3-200-030 of the Pitk.in CQunty Land Use Code, the Community Development Director of Pitkin County, Colorado ("Director") may approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. Aspen Art Museum (hereafter, the "Applicant") has applied to the Director for approval of a Temporary Commercial Use/Special Event Permit to conduct the Mt. 66. The event will be staged on the Buttermilk Mountain for the purpose of releasing two large sculptures from the top of the Buttermilk Superpipe. The sculptures will travel down the Superpipe and be stopped at its base. Hours are 1 :30 PM - 3:30 PM. There will be 30 participants and approximately 200 spectators are expected. 3. The Aspen Ski Company has verbally portrayed safety measures in place for the event to the satisfaction of the Pitkin County Sheriff's Department. 4. The Pitkin County Sheriff's Department has approved the land-based transportation/safety and operation plan for the event and does not approve the helicopter transportation/safety and operation plan (Attachment A). 5. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 3-200-030 of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit for Mt. 66 at Buttermilk Mountain, subject to Applicant's compliance with each of the following conditions: 1. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. Applicant shall not be permitted to use a helicopter in aflY fashion during the course of the event. 3. Prior to the event, Applicant shall provide County Risk Management (to the attention of Kris Jewkes) with an adequate Certificate of Insurance which demonstrates that Applicant has secured General Liability Insurance. 7. Attachment A RE: Safety OPS. "MT66" The Sheriff's Office denies applicant's request to use helicopter operations as part of event staging or take down. The Sheriff's Office approves on-site safety plan as articulated to me, this date, by Hans Hohl, Buttermilk Mountain Manager. Details: A berm has been built at the bottom of the halfpipe. Two snowcats will be staged at that location, as well. Spectators will be kept at a distance of 100'. Hohl advises me that earlier this winter he had staged a dry run using one of the die and that it had not made it all the way down the pipe. A Safety and Operations Plan is required for planned events/activities because the emergency service infrastructure is funded by the Pitkin County taxpayers to offset unplanned events that pose a threat to life and property. As a result, any demand for services generated by a planned event/activity should be alleviated ahead of time by the event sponsor or organizer. Please provide the following information as it applies to your event. Note that some questions will not be applicable, or appropriate, given the nature and/or scale of your event Contact the Public Safety Council for additional informatiop or direction regarding these requirements. . The following statements assess the level of risk to the participant/citizens of the County by the event and its potential to affect normal public safety resources. (Check appropriate boxes.) The permittee is required by the Code to demonstrate that adequate provisions have been made for police supervision, public parking, insurance, site set-up, maintenance and clean-up, emergency services, and safety of operations. A permit will not be issued unless these requirements are satisfied. Special Events include, but are not limited to the following: => Public events for amusement or entertainment, such as concerts or festivals; => Fund-raising or non-commercial events to benefit nonprofit religious, educational, or community service organizations; and => Foot races and bike races. OTHER EVENTS AND USES: If you answered NO to ANY or ALL of the questions above, you must complete the attached application and submit the required fee and application (with all required attachments) to the Community Development Department for review. See Subsection 3-200-030 of the Pitkin County Land Use Code (the "Code"). 5/13/05 . Following review of the application, the Community Development Director will issue an Administrative Determination granting or denying the permit. The Board of County Commissioners reviews events of duration longer than 72 hours. Fee for application: $1344 (Major Events), $448 (Minor Events); make check payable to "Pitkin County Treasurer". Whether or not an event constitutes a "Major Event" or a "Minor Event" will be determined by staff at the time of submittal. The fee is based on 2 hours of staff time, for Minor Events, and 6 hours of staff time, for Major Events; if staff review time exceeds 2.4 hours for Minor Events, or 7.2 hours for Major Events, the applicant will be charged for time in excess of 2/6 hours at a rate of $224 per hour. 2. Map (sketch or site plan) of event site, detailing any temporary or permanent structures, street closures, all impacted properties (identifying owners), and parking, 3. Vicinity map. 4. Schedule of events/activities. 5. Detailed Safety and Operations Plan (see Attachment A). 6. The Sheriff's Office approves on-site safety plan as articulated to me, this date, by Hans Hohl, Buttermilk Mountain Manager. Details: . A berm has been built at the bottom of the halfpipe. Two snowcats will be staged at that location, as well. Spectators will be kept at a distance of 100'. Hohl advises me that earlier this winter he had staged a dry run using one of the die and thafit had not made it all the way down the pipe. Unfortunately, I can not open them on my home computer (you know I've been home sick for a week). This is the first I have been presented with them - which is part of the problem. Plans for an event such should have been submitted by the applicant over a month ago. The big picture is the validity of the Special Events Permit process, which has been designed to enhance safety and success for each Event, whether minor, moderate, major, or extreme. As the economies of local jurisdictions become more driven by Events, good, orderly planning becomes more important. Government employees are expected to serve the public - all the public. It is unreasonable for an Events applicant to put in a last-minute application and expect public servants (Community Development, Emergency Management, Sheriff's office, Fire Department, Airport Admin., Tower, etc.) to drop everything we're doing and treat a late application as an emergency. A late application is not an emergency; it is poor planning. My opinion is that we should expect all applicants to adhere to the Special Events Permit process. To best serve the public, we must hold all applicants to the same standards. After conversations with some of you, the timing of this submittal and lack of information concerning the event, makes it very difficult for us to approve it. Some of you may have picked up information on the proposed event on the front page of the Times. Overall the event consists of a helicopter picking two sculptures of dice weighing 250 pounds each, flying them over to Buttermilk and tossing them down the Superpipe. There are numerous safety concerns for an event like this which the applicant has not adequately addressed. Please read the application and provide comments via email so that I can document comments in a case file. Some of you may have picked up information oil the proposed event on the front page of the Times: Overall the event consists of a helicopter picking two sculptures of dice weighing 250 pounds each, flying them over to Buttermilk and tossing them down the Superpipe. There are numerous safety concerns for an event like this which the applicant has not adequately addressed. Please read the application and provide comments via email so that I can document comments in a case file. One clarification of note: the dice will NOT be tossed into the pipe by the helicopter, The helicopter is delivering the dice to the top of the half pipe where they will be loaded onto a fork lift. The helicopter will stage above the pipe on Spruce Flats. The fork lift will toss the dice into the pipe. To announce the tossing of the dice a patroller from Aspen Highlands will ignite a 2 Ib.avalanche bomb uphill of the pipe, in a closed area.
