EARTHMOVING PERMIT REQUIREMENTS
1.01 General
1.01.01 Purpose. The purpose of these requirem s '~~,,,Ldb`
establish engineering, inspection and perms ting
policies by which excavation, grading or fill
.procedures (hereinafter referred to as
"Earthmoving") may be properly controlled.
1.01.02 Permits Required. No person shall begin
earthmoving work, except as specifically exempted
herein, without first, obtaining a Earthmoving
permit from the County. A separate permit will be
required for each site or parcel of land. A
permit will not be required for the following:
a. Excavations less than 4 feet in depth
and fills less than 4 feet in height
which are not intended to support
structures, do not exceed 50 cubic yards
on any one lot, parcel or property, and
do not obstruct a drainage course.
b. Excavations for basements, footings,
retaining walls, or other structures
authorized by a valid Building Permit.
This shall not. exempt any fill or
excavation having an unsupported height
greater than 4 feet after the completion
of said structures.
c. Cemeteries, mining, quarrying,
excavating, processing, and stockpiling
of rock, sand, gravel, aggregate, or
clay commercially where established and.
provided for by law, including but not.
limited to the Pitkin County Land Use
Code, given that such operations
affect lateral support or undu ~
increase the stresses in or pre,~sure
upon any adj scent or c ntg`~y~us
property. ~ ~°~~, ~~+ ~-'
d. Public works construction, pro ~,de~^stka~
the public entity conducting e °A3~k~
submits a plan to the County de ~t~ ng
earthmoving sites (cuts and fills
that the earthmoving sites have received
any other permits required by other
jurisdictions or agehcies (see paragraph
1
g. Site: Any lot or parcel of land or
contiguous combiYaton thereof.
1.02 Permit Reouirements. To receive a permit, each applicant is
required to submit a permit application form and any
associated plans or specifications required by the County.
The applicant is advised to meet. with County zoning and
engineering staff members prior to application submission to
insure that the site is compatible with applicable land use
or development policies (i.e. scenic impacts., 1041 hazards,
subdivision modifications).
1.02.01 plans and Specifications. When required by the
permit application, two sets of plans and
specifications shall be submitted for review by
the County. These plans and specifications shall
be prepared and signed by a qualified Civil
Engineer duly licensed by the State of Colorado
and shall show the following:
°a. Location map.
b. Property lines.
c. Land description and name and address of
..owner,
d. Location of all buildings, structures,
roads, or existing cut or fill slopes
°'within 30 feet on either side of the
property lines.
e. Accurate contours showing the existing
topography (and streams, roads, existing
"'vegetation densities and types, etc.)
with 5' contour intervals or 1'e ~ ~
f. Extent and the slopes of a 1 p oposed
earthmoving shown by cont ursF~r by
lope limits and cross secti Mqn~sm~~s` ~~yy~'g
g. An estimate of the qu' t%~.+~,oY
- excavation and fill involved. ~.~~ ~` ~~
h. Detailed plans of all drainage ~~~ ~~
.walls, cribbing, dams or other
protective devices to be constructed in
Connection with, or as a part of, the
.proposed work.
i. A map showing the drainage area and
estimated. runoff affecting the site.

e: Liability. Neither the issuance of a
permit nor compliance with the
provisions hereof or with any conditions
imposed in the permit issued hereunder
.shall relieve the developer from the
full responsibility for any damage
whatsoever to other persons or property,
nor impose any liability upon any
official, appointee, or employee of
Pitkih County for damage to persons or
property.

Denial of Permit. A permit will not be issued in
any `case where the work as proposed by the
applicant will not comply to the requirements
contained herein, or if the proposed work is not
consistent. with land. use or development policies
currently 'adopted by the County. If it can be
shown to the satisfaction of the County that
compliance to requirements can be attained by the
construction. of_:reta.ining structures, drainage
devices, or by other means, the permit may be
issued with the condition that such work be
performed.
The developer has the right to appeal any decision
made _by the County concerning the approval or
denial of the permit. Any appeal must be made to
the. County no later than ten (l0) calendar days
after approval or denial of the permit. The
County gill respond to. the appeal in a timely
manner. All decisions made within the response
are final.
Comnllance with-. Plans and___RecTUirements. All
permits issued .hereunder shall be presumed to
include the provision. that the applica 's
agent, contractors i~r'~ employees;,,°shall _~
.the proposed work in accordance with t e approv e
plans and .specifications and in com ian~ with
all .applicable requirements. If it i d teed
by the County that the conditions. pr -d~°"~,ot
conform to .those .stated in the. permi ~ o ~,,~d~r~
.approved plans, work may be stopped un a ~a~
is obtained for a revised earthmoving - n ~ich
will conform to the existing conditio 1`~tF~
modifications of the approved earthmoving p ans
must be approved by the County in writing.
Modifications which affect basic tract design or
land use must first be reviewed and approved by
the County Planning Office or Commission, as

%-' and the County shall recbvex- them provided notice
of noncompliance is given in writing to the
developer by the County. The surety executing
such bond or deposit shall continue to be firmly
bound under a continuing obligation for the
payment of all necessary costs and expenses that
may be incurred or expended by Pitkin County in
causing any unsatisfactory work to be corrected or
any unfinished work to be completed. In the eveht
of default, the County shall have the right to go
onto the premises to perform the required work.
In the case of a cash deposit, said deposit or any
unused portion thereof shall be refunded. Other
securities, such as cash payment or letter's of
credit, shall be approved, by the County Attorneys
Office prior to permit issuance.
1.04 Standards.
1.04.01 Cuts. Cut slopes shall net be steeper than 1-1/2
horizontal to 1 vertical unless approved by the
County, wh'o'may require that the developer furnish
a qualified "engineer's or geologist's report
certifying that the site has been investigated and
indicating that the proposed deviation from
_..-standards will fulfill the intent of these
specific :`.ions. Flatter slopes may be required if
needed f'~r'stability and safety.
.Cut slopes exceeding 40-feet in vertical height
'measured from 'the lower toe of the slope shall be
terraced. Drainage terraces are to be a minimum
of 6 feet wide and 1 foot deep, and sloped at a
minimum of 4°s in the direction of flow. Terraces
shall. be cut every 30 feet vertically, except that
where only one terrace is required it shall be
approximately mid-height. e,r.~
1.04.02 Fills. Fill slopes shall not be steeper tYian 1-
1/2 horizontal to 1 vertical unless ap rov,~ by
the County, who may require the dev lope to
furnish a qualified engineer's or g o~~•oq~st~~
report certifying that the site ~". }~•ezn
investigated and indicating that the ~'pro~b''se€~
deviation will fulfill the intent o`°r,the~
specifications. Flatter slopes may be requi~."~~s~g
needed for stability and safety. All fills sh`al`Y`
"'" be compacted to a minimum of 90% of maximum
density as per the latest ASTM or AASHO test
methods.

Fill placed on or above the top of an existing or
proposed cut or natural slope steeper than 3
horizontal to l vertical shall be set back from
the top edge of the slope a minimum distance on
cut or fill slopes steeper than 2 horizontal to 1
vertical. The setbacks given are minimum and may
be increased by the County if considered necessary
for safety or stability.
1.04.04 Reveaetation. The developer shall be responsible
for complete revegetation of the earthmoving site.
Said revegetation shall co-,form to the adopted
Pitkin County 'Landscape Guidelines, which are
available upon request. Unl"e5s"otherwise approved
by the County, revegetation of the site shall be
accomplished by'reseeding with a native grass mix
comparable to those described within the County
Landscape Guidelines. Preparatory to the seeding,
at least four (4) inches of native topsoil shall
be placed and tilled to the desired line and grade
except where, in the opinion bf the County, the
,existing site conditions will apt require topsoil
coverage. In any case, the top four (4) inches of
soil must be free of rocks and other-foreign
matter before reseeding begins:
hydraulic seeding shall be the. preferred method
employed. by the developer. All seed shall be
.furnished in bags or other containers clearly
labeled to show the... name _and address,,of the
supplier, the seed name,' the lot nunber, -net
weight, origin, the percent weed content, the
guaranteed percentage of purity and germination,
and the pounds of pure live seed of each seed
species in the container. All brands f
shall be free from such noxious seeds '
or Canadian Thistle,. European Bindwe Johnson
.Grass and Leafy Spurge. The devel er ~~"y be
required to submit tq the. Count ®a~~~"i ned
statement certifying that the seed ~r~x'~he~is
from a lot that has been tested by ~re't~c%c~iii
laboratory for seed testing within six~6) °~~uth°3'
prior to the date of :delivery. Seed' cY~'has
become wef, moldy, or otherwise damaged ~ '
or in storage will not be acceptable.
Seed types and amount of pure live seed required
per acre'. shall be_ in conformance with the
surrounding native grasses and be determined by
the developer. The County may review the proposed
seed mix or its compatibility with the surrounding
vegetation and approve it before use.

the developer's expense. Tests shall be taken at
locations designated by the County .and shall be
performed by an independent testing firm approved
by the County. Certified copies of the test data
are to be furnished upon request to the County.
Inspection shall include but need not be limited
to preparation of surface for fills, retaining
walls, drainage devices, etc. The developer or
his agent shall notify the County at least one (1)
day in advance of each required inspection. Final
approval shall not be given until all work,
including installation of all drainage structures
and their pro£ective devices, has been
satisfactorily completed and all required data or
reports have been submitted.
Final ReAOrts. Upon completion of the work, the
following reports or data may be required:
a. For supe~-,i;r:e-d- earthmoving, a report
from the ::eve'_aper's engineer certifying
that all earthmoving work has been
completed in conformance with the
approved plans and applicable
requirements, accompanied by "as-built"
plans of the completed work.

This is to inform you that your application for an Earthmoving Permit, submitted to the
Aspen/Pitkin Regional Building Department on April 19, 1993, will not be approved at this
time. The permit requested that you conduct the following activities on or along a public road
(Smuggler Mountain Road, County Road #21):
1) Remove three (3) lazge boulders which have slid on to the driving surface and excavate
into the uphill bank of the road to place the boulders as a retaining wall;
2) grade road platform and bazrow ditch to control water run-off;
3) .remove small boulders from barrow ditch;
4) Fill inroad platform to grade, adjusting Silverbrick driveway.
Pitkin County considers Smuggler Mountain Road a public road. Therefore, Pitkin County
believes that it is solely responsible for the maintenance and upkeep of the road based upon
existing County Road management plans. Therefore, any work done to the road will be done
by Pitkin County road crews and will be done at the county's discretion.
