By Resolution No. 88-47, the Board of County Commissioners of Pitkin County, Colorado (BOCC), granted a special review use permit to Elam Construction, Incorporated (Applicant) for the Elam Sand and Gravel Pit and Asphalt /Hot Mix/Concrete plant pursuant to Section 3-210.10 (formerly Section 3-6) of the Pitkin County Land Use Code. 2. By Resolution No. 99-69 The BOCC extended the special review approval for 10 years, until April 14, 2009. 3. Resolution No. 99-69 requires an annual review of the Elam operations at a public hearing for compliance with all terms and conditions of the resolution and subsequent resolutions. 4. On May 10, 2000, the BOCC held the annual review of the Elam Sand and Gravel Pit special review permit for the operation year of 1999, and continued the public hearing to June 14, 2000. At both meetings members of the public had opportunity to voice their comments. 5. The BOCC determined that the Applicant has been operating in compliance with the terms of Resolution No. 99-69. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners of Pitkin County, Colorado, hereby finds Elam Construction, Incorporated to be in compliance with their current special review permit, subject to the following conditions: 1. All material representations made by the applicant in the application, in subsequent correspondence, and at the public hearing shall be adhered to and considered conditions of approval. 2. The applicant shall continue to be bound by all conditions of Resolution No. 99-66, unless modified by terms of this resolution. 3. Drain lines, nozzles, and shut off valves in the fuel storage area shall be repaired. Fuel storage in the pit shall be located in a containment basin capable of retaining contents of the primary storage vessels These improvements shall be made to the Resolution No 905-2000 11111111111111111111111 III 1111111111111 III 1111111111111 Page 2 2 of 6 R 0.00 D 0.00 N 0.00 PITKINDAVIS COUNTYILVI CO satisfaction of the Environmental Health Department within 30 days of approval of this resolution. 4. The Lafarge concrete operation shall construct an approved, contained truck wash bay by July 1, 2000. This facility shall be approved by the Environmental Health Department. 5. The asphalt plant and rock crusher must be permitted by the Colorado Department of Public Health and Environment and must stay in compliance with conditions of the permit. 6. Fugitive dust from the pit operations must be contained to maintain compliance with applicable state standards. 7. Crusher operations shall be limited to the dates of April 1 through November 25 of each year. Any required extensions beyond these dates must be approved in writing by the Woody Creek Caucus. Also, the Applicant will investigate the possibility of "baffling" crusher noise. 8. Any non Elam-owned trucks on site shall be of two principal contractors only (Ute City and Reliable) and shall be stored out of public view. The storage area shall include plug-in engine block heaters. 9. Any acceptance of off-site soil brought to the pit shall be subject to the protocol detailed in Attachment 1. 10. Standing water in the pit shall be subject to testing according to a protocol to be developed by Elam and approved by the Environmental Health Department and the Woody Creek Caucus within 60 days of the approval of this resolution. Free liquids or sludge. • Solid waste (i.e., tires, branches/logs, appliances, scrap wood/steel, domestic rubbish, construction debris other than steel fee concrete and asphalt rubble suitable for re-cycling, etc.) • Biomedical waste. • Petroleum hydrocarbon, or antifreeze, contamination. • Heavy metals (i.g., cadmium, chromium, lead) contamination above background levels. • Radioactive materials or mill tailings. • PCBs (polychlorinated biphenyls) or pesticides. • Asbestos or asbestos in building materials (ACM). To insure that all the material delivered to the facility from outside areas Is clean and inert from the above listed items, the following procedure is implemented: 1. The Individual or company delivering material to the facility is required to sign an affidavit certifying that the material is: clean and inert, the originating 2-2a-OC; 10 av1;_iam �ons- Inc. ;970 24= 771c source of the material, and the estimated volume. At the discretion of the facility operator, the certification may also include an environmental audit of the source site prepared by a Colorado Registered Professional Engineer or a Registered Environmental Manager. 2. During the stockpiling process, the facility manager, and those individuals who operate the stockpiling equipment, will conduct constant visual and olfactory analysis of the delivered material on a truck by truck basis. At a minimum, the visual evaluation will identify that the soil does not have any stained/discolored soils (an indicator of potential hydrocarbon contamination), hazardous substances, or other solid waste. 3. In the event that contaminated material is identified, all work in the immediate area will cease and a Colorado Registered Professional Engineer or a Registered Environmental Manager will be contacted by the facility operator. The listed qualified individual(s) will prepare, supervise and implement a Remediation and Disposal Plan conducted in accordance with the requirements of the governing regulatory agencies. During the analysis process for the companies annual review of the activities occurring at the facility during 1999/2000, it was determined that a certain amount of testing be conducted not only on soil brought to the site, but on any standing water which might be evident throughout the year. The following changes are suggested to the current policy: Anyone delivering soil to the Vagneur Gravel Pit will provide documentation that it is clean and inert prior to disposal utilizing the following protocol which will be provided to the customer prior to delivery: 1. At Man Z least one composite sample will be taken for each load accepted and =M for each 1000 cubic yards thereafter. 2. The laboratory analysis will include the name of the transporter, land owner and the location of the origin of the soil. Elam Construction, Inc. will maintain records and make them available for public inspection. Supervision of the above presented protocol will be under the direction of Elam Construction, Inc. staff personnel who is a "Certified Hazardous Materials Manager". The above listed analysis and methods will be used to test any standing water which may exist from time to time within the facility. Grab samples will be taken once a month.
