Aspen Valley Land Trust("Applicant")applied to the Board of County Commissioners of Pitkin County, Colorado('BOCC")to rezone a portion of U.S. Forest Service lands(referred to as the"Devaney parcel")from AF-SKI to AFR-10 in order to develop a single family residence and accessory structures. Development on the Devaney parcel is proposed as part of a land exchange that will transfer the Ryan parcel,an inholding,from private to public ownership and retire its development rights. 2. The majority of the parcel is currently zoned AF SKI, since it is within the permit boundary for the Ashcroft Ski Touring Area. The remainder of the parcel is zoned AFR-10. The parcel contains approximately 35 acres. 3. Said parcel is located on the west side of Castle Creek Road,adjacent to and north of the Toklat property,and is more specifically described in Exhibit A. 4. The Planning and Zoning Commission heard the rezoning request at a regularly scheduled meeting on April 4,2000,and recommended approval. 5. The BOCC reviewed the request for rezoning to AFR 10 on first reading at a duly noticed public hearing on May 24,2000,and on second reading at a public meeting on June 14,2000. 6. The BOCC finds that the rezoning is in the public interest,as it will accommodate the land exchange that will preserve the Ryan parcel,where development is considered incompatible with the surrounding area and detrimental to the ski area and the Ashcroft historic town-site. 7. The BOCC further finds that the rezoning is consistent with the intent of the AFX 10 zone district, is compatible with surrounding development and the community character,will not result in significant adverse impacts on the natural environment,and complies with the applicable criteria of the Land Use Code. 111111111111111111111111111111111111111 III 111111111 IN Ordinance N4 -2000 445449 07/25/2000 11:14A ORDINANC DAVIS SILVI Page2 2 of 3 R 0.00 D 0.00 N 0.00 PITKIN COUNTY CO NOW,THEREFORE,BE IT ORDAINED by the BOCC that it hereby rezones a portion of the Devaney parcel from AF-SKI to AFR-10,subject to the rezoning being effective upon the successful completion of the federal land exchange,whereby Aspen Valley Land Trust's ownership in the Ryan parcel is transferred by recorded deed to the United States Forest Service and the Devaney parcel is acquired by AVLT by recorded deed.
