RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO,
AUTHORIZING EXECUTION OF A COOPERATIVE WORK AGREEMENT
WITH THE UNITED STATES FOREST SERVICE FOR
DRAINAGE IMPROVEMENTS ON LINCOLN CREEK ROAD

1. Whereas, Pitkin County would like to partner with the United States Forest Service to
improve the drainage on Lincoln Creek Road, and;
2. Whereas, Pitkin County is willing to provide equipment to haul material to Lincoln Creek
Road and assist in the paving of the Grottos entrance, and;
3. Whereas, The United States Forest Service will reimburse Pitkin County for labor and
material for said project, and;
4. Pitkin County will assist in the application of surface material on Lincoln Creek Road.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin
County, Colorado does authorize the Chair to sign the Cooperative Work Agreement with the United.
States Forest Service and directs staff to assist in the drainage improvements for Lincoln Creek Road
and intersection improvement for the Grottos.

COOPERATIVE ROAD AGREEMENT No. 03-RO-l1021500-011
for
LINCOLN CREEK ROAD
Between
USDA FOREST SERVICE,
WHITE RIVER NATIONAL FOREST
And
PITKIN COUNTY, COLORADO
This Project Agreement is made and entered into by and between the BOARD OF COUNTY
COMMISSIONERS of Pitkin County in the State of Colorado, hereinafter referred to as the County and
the Forest Supervisor, White River National Forest, hereinafter referred to as the Forest Service, under
the Forest Road Agreement #03-RO-II021500-011 dated August 7,2003.
A. PURPOSE OF AGREEMENT
The Forest Service and the County have determined to repair and restore Lincoln Creek Road
(Pitkin County Road 23 / FSR No. 106) in order to provide for the safe mix of commercial,
administrative use, and public traffic. Portions ofthe Lincoln Creek Road are currently County and are
listed on the current Schedule "A" of the Forest Road Agreement dated August 7, 2003. The Lincoln
Creek Road project begins at milepost (MP) 0.0 on State Highway 82 and continues along to end at
milepost 10.7, for a total distance of 10.7 miles. The Grottos Day Use Area project begins at milepost
0.0 on State Highway 82 and continues along to end at milepost 0.03, for a total distance of 160 feet.
All work proposed in this agreement is located on National Forest System Lands.
B. FOREST SERVICE SHALL:
a) Reimburse the County for the cost of personnel, equipment, and materials associated with
the County's portion of the work - see Section C.
Reimbursement shall not exceed $38,836 (Salaries/Labor and Materials). Partial payments may be
made upon submission of an invoice from the County. No payment will be made for less than
$200.00.
County will provide the Forest Service with itemized invoices for materials purchased, and for the
equipment and personnel used. The original copy of the invoice shall be submitted to:

b) Provide the necessary materials, personnel, and equipment to perform the following work:
I. Lincoln Creek Road - MP 0.0 - MP 6.2
a) Upon the County's delivery of350 tons of %" minus aggregate (culvert bedding material)
to select stockpile locations along the road, the Forest Service will replace 23 culverts and
install 4 new culverts along - Target Date June 16, 2006.
b) Install cross drainage structures (waterbars/dips) along the road - Target Date June 16,
2006.
c) Recondition approximately 7,500 feet of roadside ditch - Target Date June 16,2006.
d) Cut approximately 85 hazard trees along the road and cut brush along approximately 1,500
feet of the road - Target Date June 16, 2006.
e) Replace running planks and curb boards on the bridge, at the entrance of the road - Target
Date October 14, 2006.
f) Post the necessary signs on the bridge to meet the appropriate standards - Target Date June
16, 2006.
g) Replace signs on gate, at the beginning of the road - Target Date June 16, 2006.
h) Dispose of gate at MP 3.3 - Target Date June 16,2006.
i) Dispose of 23 old culverts that were replaced - Target Date June 16,2006.
2. Lincoln Creek Road - MP 6.2 - MP 10.7
a) Perform level 2 road maintenance to Ruby Townsite, an approximate distance of 4.5 miles.
The Forest Service will install cross drainage structures (waterbars/dips) along the road.
3. Grottos Dav Use Area Road
a) Remove brush along 225 feet of Colorado State Highway 82, below the entrance - Target
Date June 16,2006.
C. THE COUNTY SHALL:
a) Provide the necessary materials, personnel, and equipment to p~rform the following work:

1. Lincoln Creek Road
a) Deliver 350 tons of ',4" minus aggregate (culvert bedding material) to select stockpile
locations along the road - Target Date June 2, 2006.
b) Place and compact 1,350 tons of 3" minus aggregate, milepost 0.0 to milepost 0.6, on the
road - Target Date October 14,2006.
c) Reconstruct the entrance of the road (place/compact 165 tons of ',4" minus aggregate,
relocate barrier rocks and 2 bulletin boards) - Target Date October 14, 2006.
d) Dispose of 23 old culverts that were replaced by the Forest Service - Target Date June 16,
2006 - see Section B.
2. Grottos Dav Use Area Road
a) Place and compact 77 tons of 3" minus pitrun material to modify the road grade at the
beginning of the road - Target Date June 9, 2006.
b) Place and compact of 80 tons of ',4" minus aggregate at the beginning of the road
(subgrade preparation for asphalt apron) - Target Date June 9, 2006.
c) Install asphalt apron (45 tons asphalt) at the beginning of the road, at the junction with
Colorado State Highway 82 - Target Date June 9, 2006.
D. IT IS MUTUALLY AGREED AND UNDERSTOOD BY ALL PARTIES THAT:
1. MODIFICATION. Modifications within the scope of the instrument shall be made by mutual
consent of the parties, by the issuance of a written modification, signed and dated by both
parties, prior to any changes being performed. The Forest Service is not obligated to fund any
changes not properly approved in advance.
2. TERMINATION. Either party(s), in writing, may terminate the instrument in whole, or in part,
at any time before the date of expiration. Neither party(s) shall incur any new obligations for the
terminated portion of the instrument after the effective date and shall cancel as many obligations
as is possible. Full credit shall be allowed for each parties expenses and all noncancellable
obligations properly incurred up to the effective date of termination.
3. NONDISCRIMINATION. The cooperator shall comply with all Federal statutes relating to
nondiscrimination and all applicable requirements of all other Federal laws, executive orders,
regulations and policies. These include but are not limited to: (a) Title VI of the Civil Rights
Act of 1964 (42 U.S.C. 2000d), which prohibits discrimination on the basis of race, color,
handicap, or national origin; (b) Title IX of the Education amendments of 1972, as amended (20
V.S.C. 1681-1683, and 1685-1686), which prohibits discrimination on the basis of sex.
4. P ARTICIP A TION IN SIMILAR ACTIVITIES. This instrument in no way restricts the Forest
Service or the Cooperator(s) from participating in similar activities with other public or private
agencies, organizations, and individuals.

5. OWNERSHIP. No part ofthis instrument shall entitle the cooperator to any share or interest in
the project other than the right to use and enjoy the same under the existing regulations of the
Forest Service.
6. OBLIGATIONS. Nothing herein shall be considered as obligating the Forest Service to expend
or as involving the United States in any contract or other obligations for the future payment of
money in excess of funding approved and made available for payment under this instrument and
modifications thereto.

8. LEGAL AUTHORITY. The recipient/cooperator has the legal authority to enter into this
instrument, and the institutional, managerial and financial capability (including funds sufficient
to pay non-Federal share of project costs) to ensure proper planning, management, and
completion of the project.
9. FUNDING EOUlPMENT AND SUPPLIES. Federal funding under this instrument is not
available for reimbursement of cooperator purchase of equipment.
10. PROPERTY IMPROVEMENTS. Improvements placed on National Forest System land at the
direction of either of the parties, shall thereupon become property of the United States, and shall
be subject to the same regulations and administration of the Forest Service as other National
Forest improvements of a similar nature.
11. COMPLETION DATE. This agreement is executed as of the last date shown below and expires
no later than October 31, 2007, at which time it is subject to review and renewal, or expiration.
12. AUTHORIZED REPRESENTATIVES. By signature below, the cooperator certifies that the
individuals listed in this document as representatives of the cooperator are authorized to act in
their respective areas for matters related to this agreement.
IN WITNESS WHEREOF, the parties as hereto have executed this Project Agreement as of the last date
