Crowley Land & Cattle LLC, Applicant, has applied to the Pitkin County Community Development Department for a constrained site determination pursuant to Sec. 6-70-40.a.7 of the Land Use Code ("Code"), and to the Pitkin County Board of County Commissioners (BaCC) to determine whether a constrained site Transferable Development Right(s) (TDR) should be granted. 2. The parcel is located to the north of Thomasville in the Frying Pan Valley, and is more specifically described in Exhibit A. 3. The parcel contains approximately 7] acres. Approximately 34 acres are zoned AR-2 and 37 acres are zoned RS-30. 4. The Applicant submitted a complete application subsequent to July 6, 2006, therefore, the application is being considered pursuant to the 2006 Land Use Code. 5. The Community Development Department has determined that the parcel is "undevelopable or severely constrained" pursuant to the Code, based on the following: ~ A. The parcel is entirely encumbered by elk severe winter range or the required Y. mile buffer for elk severe winter range. The Code prohibits development within these areas pursuant to Secs. 7-20- 70.f.1 and 7-20-70.d.6. B. An active elk migration corridor exists on and adjacent to the property through Suicide, Middle and Nelson Gulches. The Code prohibits development that blocks a migration corridor and within a Y. mile buffer of a migration corridor, pursuant to Secs. 7-20-70.f.3 and 7-20-70.d.5. C. An active osprey nest is located on the property. The Code requires a Y, mile buffer around the nest, pursuant to 7-20-70.d.l; the Y, mile buffer encompasses the entire property. D. The required 100 foot riparian buffer constrains a portion of the parcel. E. Approximately 25% of the parcel is comprised of slopes in excess ofJO%. The Code prohibits development on slopes in excess of 30%. 6. The BaCC reviewed the request for a determination as to whether one or more constrained site TDRs will be granted at a public meeting on December 6, 2006, at which time evidence and testimony were presented with respect to this application. 7. The Bacc determined that ]2 (twelve) constrained site TDRs shall be granted to Crowley Land & Cattle LLC, given the critical wildlife habitat areas on the parcel and the potential impacts of development of the parcel on the scenic quality and rural character of the area.
