ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO, ACCEPTING QUIT
CLAIM DEED FOR A PORTION OF SMUGGLER MOUNTAIN ROAD
FROM WRIGHT & PREUSCH MINING, LTD.
ORDINANCE No. -2000
RECITALS
I. Pitkin County has initialed an action in the United States District Court For the
District of Colorado, to determine the status of Smuggler Mountain Road. Wright & Preusch
Mining, Ltd. is a named Defendant in that action.
2. Wright & Preusch Mining, Ltd. has tendered to the County a Quit Claim Deed
for a sixty foot (60') easement, being thirty feet (30') on either side of the centerline of
Smuggler Mountain Road as existing and in place.
3. Subdivision documents for Smuggler Mine Subdivision indicate a dedication
of a sixty foot (60') easement for Smuggler Mountain Road from Wright & Preusch Mining,
Ltd. to Pitkin County. However, it appears that this easement was never recorded as only a
blank book and page number are shown on the final plat.
4. Acceptance of the Quit Claim Deed from Wright & Preusch Mining, Ltd.
satisfies conditions of subdivision for Smuggler Mine Subdivision. It also eliminates one
party from the pending federal action over Smuggler Mountain Road.
5. The legal description for the centerline of Smuggler Mountain Road does not
designate descriptions for the segments of the road within specific private property. It is
necessary to have a surveyor prepare an accurate legal description of only the portion of the
road that is being deeded to County by Quit Claim Deed. The current Quit Claim Deed
contemplates obtaining a specific surveyed legal description subsequent to acceptance of this
Deed and recording a Correction Quit Claim Deed when the description is completed.
NOW, THEREFORE, BE IT ORDAINED:
1. That the Quit Claim Deed from Wright & Preusch Mining, Ltd. to
Pitkin County is accepted and that chair is authorized to sign the Deed and any other
documents necessary to finalize this transaction, after approval of the form of such documents
by the County Attorney.
2. That staff is authorized to have the surveyor prepare a surveyed legal
description of the easement conveyed by the Quit Claim Deed.
3. Upon receipt of the surveyed legal description, a Correction Quit Claim
Deed shall be prepared and the Chair is specifically authorized to execute the Correction Quit

QUIT CLAIM DEED
THIS DEED made this /-4 day of August, 2000 between Wright & Preusch Mining
LTD, whose legal address is c/o Gary Wright, Esq. Wright & Adger 201 North Mill Street, Suite
106, Aspen, Colorado 81611, Pitkin County, Colorado as Grantor, and the BOARD OF
COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, and whose legal address
is 530 East Main Street, Third Floor, Aspen, Colorado, 81611, Grantee:
WITNESSETH:
That the Grantor, for and in consideration of Ten Dollars and other good and valuable
consideration, the receipt and sufficiency of which is hbreby acknowledged, have remised,
released, sold, conveyed and QUIT CLAIMed unto the Grantee, its successors and assigns,
forever, without warranty, the real property, together with improvements, if any, situate, lying
and being in the County of Pitkin and the State of Colorado, described as follows:
A sixty foot easement for public road purposes, for Smuggler Mountain Road, in the
general location as shown on Exhibit A attached hereto and made a part hereof and the
centerline as shown in Exhibit B, Easement Description of a Portion of Smuggler
Mountain Road attached hereto and made a part hereof as such road traverses the
following property of Grantor:
The Smuggler Mine property, being a parcel of land located in the East 1/2 of Section 7,
Township 10 South, Range 84 West, 6" Principal Meridian, Pitkin County, State of
Colorado more particularly described in Exhibit C attached hereto and made a part
hereof.
Grantor further agrees that Grantee may cause the easement to be surveyed, and upon
approval of the survey, Grantor will execute a correction quitclaim deed which includes the
specific surveyed legal description of the easement granted herein.
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances
and privileges thereunto belonging or in anywise thereunto appertaining, all the estate right, title,
interest and claim whatsoever, of the Grantor, either in law or equity, to the only proper use,
benefit and behoof of the Grantee, its successors and assigns forever.
IF ANY TERM or provision of this Quit Claim Deed would otherwise violate the rule
against perpetuities or the rule restricting restraints on alienation, such term or provision shall
automatically expire and be of no further force or effect, on the day before the expiration of
ninety (90) years from the date of this deed.
