OFFICE CIVIL PROCESS BILLINGS AND AMENDING BOARD OF COUNTY
COMMISSIONER'S RESOLUTION#95-61

1. C.R.S. § 30-1-104 authorizes counties to fix certain Sheriffs fees (based on
actual expenses) and mileage by Resolution and to collect the same.
2. Article X Section 5.7 of the Pitkin County Home Rule Charter authorizes the
Board of County Commissioners (the "BOCC") to establish the fees to be charged and
collected by the Sheriff.
3. It is the intent of the statutes and the Home Rule Charter that the fees
represent the cost of service and the Board has heard evidence that current costs are
anticipated to be in excess of the current fee schedule.
4. The BOCC increased fees in 1995 pursuant to Resolution #95-61.
5. The fee schedule attached here to as Exhibit A and incorporated by this
reference, is the best attempt to support actual expenses by the fees charged and the
proposed schedule is in the best interest of the County.
NOW THEREFORE, be it resolved that the Board of County Commissioners of
Pitkin County, Colorado hereby approve the schedule of fees for civil service attached here
to as Exhibit A.
