ON J AGREEMENT
For good and valuable consideration, the receipt of which is hereby acknowledged by both
parties, the Board of County Commissioners of Pitkin County, Colorado("County")agrees to sign
the 600 foot Well Spacing Statement tendered by Pitkin Iron Development,LLC("Pitkin Iron")with
regard to the County's Jaconvel Well (Permit No. 013-754-F), subject to the following conditions:
1. If it is determined by a licensed water engineer or a qualified groundwater hydrologist that
the proposed Pitkin Iron well(Receipt No.0459057-E)reduces the County's production
of water from the Jaconvel Well under the terms of the County's current well permit
(Permit No. 013-754-F),Pitkin Iron agrees to implement a well operations program that
eliminates such reduction or will provide the County substitute water in the amount of the
reduction.
2. Pitkin Iron agrees in advance to sign a 600 foot Well Spacing Statement, if the County
needs such a statement for any reason associated with the County's use of the Jaconvel
Well under the terms of its current well permit (Permit No. 013-754-F).

[(we) Pitkin County Board of County Commissioners stare as follows:
1. I(we) own real property descnbed as Lot F, Pitkin Iron/River Ranch P D
in
the SE 1/4 of the NE 1/4,Secdon 8 Township 9 South Range 85 West
6th P.M., Pitkin County, Colorado. Located on our property are the following well(s):

2. I(we) have been apprised that _ Pitkin Iron Development, LLC
present owners of a parcel of land in the SE 1/4 of the NE 1/4, Section 8
Township 9 South Range 85 West 6th P.M., desire to drill a n-%%
well or the extend the use of an existing well I(we) also understand that the purpose of such well is se!
forth in the well permit application, and that I(we) have reviewed the application that was
submitted to the State Engineer and receipted by him under receipt no. 0459057 -E
3. The proposed location for the subject well will be less than 600 feet from one or more of my(our) wells.
4. By this statement I (we) are specifically waiving any objection to the issuance of a well permit for the
subject well, as set forth in the referenced application, and would request that permit issuance nor be
postponed or denied because of any concerns by the Division or others that the proposed well will
materially affect my(our) weU(s) or water right(s). I(we) also specifically waive any right (I)we may have
to participate in a hearing before the State Engines pursuant to Section 37-90-137(2), C.R.S.
