[ ] You aze responsible for the information contained in the attached Earthmoving Permit
Requirements handout.
[ ] State law (Senate Bi1193-15~) requires that you contact the Utility Notification Center of
Colorado, at (800) 922-1987, before commencing any earthmoving.
[ 1 Work in a wellands azea is generally prohibited: however, some activities are permitted.
You are required to obtain a permit from the Army Corp of Engineers. Please call (303)
243-1199.
[ ] You will be required to post a Bond with the Building Deparnent for revegetation if
your project:
a) Has a potential to impact watershed azeas (riparian or streams, etc.).
b) Has a potential for visual impacts from public viewing corridors (Roads, County
Pazks, Trails).
c) Has steep (15% or greater) slopes or unstable soils.
d) Disturbs large areas (To be determined by the Land Management DepartmeatJ
[ ] If bonding is required, a revegetation plan including the following items, MUST be
submitted.
a) Plant Material List (BE SPECIFIC -scientific names are required).
b) Planting schedule. This is a commitment by the. applicant that the work will be
performed by a certain date. The bond will be released after the vegetation has
been successfully established.
[ ] Most projects require a Fugitive Dust Control Plan. If you aze unsure whether you need
to submit a dust plan, please call the Environmental Health Department. at 920-5070.
[ ] Proposed ponds will require an impoundment permit by the State Water Engineer.
[ ] Permit applications not approved within six months of submittal will be voided.

1.01 General
1.01.01 Purpose. The purpose of these requirements is to
s~aIiYssh engineering, inspection and permitting;;
~po-Isczes by which excavation, grading or fill
procedures (hereinafter referred to as
"Earthmoving") may be properly controlled.;
1.01.02 +Permits Recuired. No person shall begin
earthmoving work, except as specifically exempted
herein, without first obtaining a Earthmcving
permit from the County. A separate permit will be
required for each site or parcel of lard. A
permit will not be required for the following:
a. Excavations less than 4 feet in depth
and fills less than 4 feet in heig'r_t~
which are net intended to suppor`,~f
structures, do not exceed 50 cubic yards'9

do not obstruct a drainage course.;

1.02iPermit Requirements: To receive a permit, each applicant is
required to submit a permit application form and. any
associated plans ar specifications required by the County.

1.02.01 Plans and Snec~~~c~t~ons. When required by the
permit application, two sets of plans and
specifications shall be submitted for review by
the County. These plans and specifications .shall
be prepared and signed by a qualified Civil
Engineer duly licensed by the State of Colcrado
and shall show the fo'_lowing•
a. Location may.
b. Property lines.
c. Land description and ra.*:e and address of
cwrer.
d. Location of all buildings, structures,
- ~ roads, or existing cut or fill slcnes
within 30 feet on either side of the
property lines.
e. Accurate contours showing the .existing
topography (and streams, roads, existing
.vegetation densities and types, etc.)
with 5' contour intervals or less.
f. Extent and the slopes of all propesed
earthmoving shown by contours or by
slope limits and cross sections.
g. An estimate of the quantity of
excavation and fill involved.
h. Detailed plans of all drainage devices,
walls, cribbing, dams or other t
protective devices to be constructed in ,'
connection with, or as a part of, the "
proposed work.
i. A map showing the drainage area and
estimated runoff affecting the site.

e. Liability. Neither the issuance of a
permit nor compliance with the
provisions hereof or with any conditions
impose3 in the permit issued hereunder
shall relieve the developer from the
full responsibility for any damage.

1.02.04 Denial of peg-ai`. A permit will not be issued in
any case where the work as proposed by the
applicant will 'not comply to t:7e requirements
contained herein, cr if the proposed work is not
consistent with land use or de<relopment policies
currently 'adopted by the County. If it can be
shown to the satisfaction of the County that
compliance to requirehents car. be attained by the
construction of___reta~-,; ,,g .st..~sctures, drainage
devices, or by other means, the permit may be
issued with the condition that such work be
performed.
The developer has the right to .appeal ary decisicr.
made by the Ccurty concerning the approval ar
denial of the permit. Any appeal must be made to
the County no later than ten (10) calendar days
after approval or denial of the permit. The
County will resacnd to the appeal in a timely
manner. A11 decisions made within the res~cnse
are final. -.
1.02.05 ComnZiance .with p~a-s and Recu~r~-* ~i

include the provision that the applicant, his

the proposed work in accordance with the approvedy

all applicable requirements; If it is determined
'. by the County that the conditions present do not

is obtained for a revised earthmcving plan which

modifications of the approved earthmoving plans,.`
must be approved by the County in writing.
Modifications which affect basic tract design or
land use must first be revie*aed and approved by
the County Planning Office or Commission, as

and the County shall recover them provided notice
of noncompliance is given in writing to the
developer by the County. The surety executing
such bond or deposit shall continue to be firmly
bound under a continuing obligation for the
payment of all necessary costs and expenses that
may be incurred or expended by Pitkin County in
causing any unsatisfactory work to be corrected or
any unfinished work to be completed. ..In the event
of default, the County shall have the right to 5o J
onto the premises to perform the required work;
In the case of a cash deposit, said deposit or any
unused portion thereof shall be refunded. Other
securities, such as cash payment or letters of
credit, shall be approved by the County Attorneys
office prior to permit issuance.
I.04`Btandards.
1.04.01 Cuts. Cut slopes shall rot be steeper than 1-i/2 q
horizontal to 1 vertical unless approved by they
County; whts~may require that the develcper furnish'
a cualifie3 engineer's or geciogist's retort
certifying that the site has been investigated and
indicating that the prcposed deviaticr. from
__._._...~tandards will fulfill the intant of these
specifications. Flatter slopes may be required if
needed for stability and safety.
Cut slopes exceeding 40-feet in vertical he_ghtf
measured from the lower toe of the slope shall be
terraced. Drainage terraces are to be a minimum
of 6 feet wide and 1 fcct deep, and sloped at a
minimum of 4% in the dir=_ction of flow. Terraces
sY.all be cut every 30 feet vertically, except that
where only one terrace is required it shall be
approximately mid-height.
1.04.02 Fi11s. Fill slopes shall not be steeper than 1-3
1/2 horizontal to 1 vertical unless approved by ..;
the County, _. who may require the developer to
furnish a qualified engineer's or geolcgist's
report certifying that the site has been
investigated and indicating that the proposed
deviation will fulfill the intent of these
specifications. Flatter slopes may be required if'~
needed for stability and safety. A11 fills shall
be compacted to a minimum of 90% of maximum.`
density as per -the latest AST.? or AASHO test-
methods.

Fill placed on or above the top of ar. existing or
proposed cut or natural slope steeper than 3
horizontal to 1 vertical shall be set back from
the tap edge of the slope a minimum distance on
cut or fill slopes steeper than 2 horizontal to 1
vertical. The setbacks given are minimum and may
be increased by the County if considered necessary
for safety or stability.
1.04.04 Reveo•etation: The developer shall be responsible
for complete revegetation of the earthmoving site.,'
Said revegetation shall conform to the adepted~
Pitkin County Landscape Guidelines, which are
avallahle-upon.recsest. Unless otherwise approved
by the County, revegetation of the site shall be
accomplished by reszeding with a native grass mix
comparable to those described within the County
Landscape Guidelines. ?reparatory to the seeding,
at least four (4) inches of native topsoil s::all
be placed and tilled to the desired lire and grade
e.tcept where, in the opinion of t_:e County, the
existing site conditions will not require topsoil
coverage. In any case, the top four (4) inches of
soil must be free of rocks and other foreicn
matter before reseedinc begins.
Hydraulic seeding shall be the preferred method
employed by the developer. All seed shall be
furais::ed in bags or other containers clearly
labe?ed to show the name and address of the
supplier, the seed name, the let num'aer, .net
weicht, origin, the percent weed content, the
guaranteed percentage of purity and ge~inatien,
and the pounds o` pure live seed .of each seed
species in the container. All brands furnished
shall be free from such noxious seeds as Russian
or Canadian Thistle, European Biad:aeed, Johnson
Grass and Leafy Spurge. The developer may be
required to submit to the County a signed
statement certifying that the seed furnished is
from a lot that has been tested by a recognized
labarator•/ for seed testing within six (6) months
prior to the date of delivery. Seed which has
become wet, moldy, or otherwise damaged i:n transit
or in storage will not be acceptable.
Seed types and amount of pure Live seed recuired
per acre shall be in conformance with the '%
surrcundirg native grasses and be determined by .
the developer. The County may review the proposed
seed mix ar its compatibility with the surrounding
vegetation and approve it before use.

the developer's expense: Tests shall be taken at
locations designated by the County and shall be
performed by an independent testing firm approved
by the County. Certified copies of the test data
are to be furnished- upon request to the County.
-Inspection shall include but need not be-limited,
-to:-preparation of surface for fills, ~refaining~
walls,--drainage devices, etc. The developer or
his agent shall notify the County at least one (I)
day in advance of each required inspection. Final
approval shall not be given until all work,
including installation of all drainage structures
and their protective devices, has been
satisfactorily completed and all required data~or
reports have been submitted.
1.05.03 Final Reports. IIpon completion of the work, the
fallowing reports or data may be required

from the developer's engineer certifying
that all earth~oving work has been
completed in conformance with the
approved plans and applicable^
requirements, accompanied by "as-built"

b. Soils and/or geology reports.
c. Cross sections.
d. Other reports as required.
The-release of any bond or .security posted by the;
developer may be cori3itioiied uaon the submittal ofj
