COMMISSION MEMBERS PRESENT: Commissioners Shellie Roy Harper, Leslie Lamont, Dorothea Farris, Mick Ireland and Patti Clapper COMMISSION MEMBERS ABSENT: None CONTINUED SECOND READING AND PUBLIC HEARING ON RESOLUTION GRANTING APPROVAL OF SUBDIVISION/PUD CONCEPTUAL SUBMISSION, MAJOR PLAT AMENDMENT, GM S EXEMPTION AND 1041 HAZARD REVIEW FOR LOT 1, STILLWATER RANCH SUBDIVISION— MOTION TO APPROVE AT SECOND READING WITH STAFF DIRECTION — Tamara Pregl—County planner; Aspen/Pitkin County Housing Authority—applicant; Lee Novak, Housing Authority—Applicant's representative Chairperson Harper said she met with Lee Novak of the Housing Authority and looked at the property. She then asked Lance Clarke, who was attending the beginning of this meeting in Tamara Pregl's absence, how detailed the plans needed to be for this application at this level? Mr. Clarke said this is application is more detailed than plans ever are at conceptual. Lee Novak,the Housing Authority representative, said that one issue that the Board ends up getting is a submittal versus what the applicant actually does and doesn't show you. Mr. Novak said the Housing Authority is giving the Board everything they had to do as an applicant to figure out how big the buildings are and how they fit on the site,the utility detail work that they've done for the water service agreement. He added that there is a little more money invested design-wise for utilities design that they had to do to change the water service agreement. He also said they did floor plans to see what the buildings would look like. BOARD OF COUNTY COMMISSIONERS 1 SPECIAL MEETING JULY 25,2000 Commissioner Lamont said that there is a new piece of information that Mr. Novak put together that she finds very interesting regarding subsidies per unit. He had looked at the differences between seventeen units versus fifteen units versus thirteen units. She explained that at the last meeting, she moved to continue the meeting to today because she felt that the Board had gotten to a point where they needed to think about the various offers that were put before them. One of those offers from John and Jessie Gordon put a compromise offer on the table regarding whether the Board wanted to tie this up in litigation for years and years and what about considering selling the property and using the money from that sale to purchase affordable housing elsewhere. She felt the Board needed to look over the various scenarios and individually step back and think about what had been presented to them. Another option was to put only six units on this property versus the seventeen proposed. And, another was basically the same scenario that was done at Pitkin Iron where a private developer would buy it from the County and build two free-market units and the County would get between six and eight affordable housing units plus about $2,000,000.00. Commissioner Lamont continued by saying that if the Board were to approve this at the conceptual level, they would have the time between conceptual and detailed approval to continue to work on the refinements and the numbers that Mr. Novak worked on regarding seventeen units versus fifteen, etc. County Manager, Suzanne Konchan, gave the Board the information verbally that she had been given. For a seventeen-unit project with four one-bedroom and thirteen three- bedroom units the subsidy, per bedroom, would be approximately $86,800.00. For a thirteen-unit project comprised of two one-bedroom and eleven three-bedroom units, the subsidy,per bedroom, would be approximately $88,800.00. She pointed out the differences between the seventeen and thirteen unit scenarios and noted that they were relatively minor. Mr. Novak stressed that these figures are extremely preliminary estimates. He reminded the Board that he is seeing a market that shows 15%to 18% annual increases in construction costs. Chairperson Harper said she is not comfortable going with six or eight units as it just does not seem to achieve enough for the County. Commissioner Farris would rather deal with the honest issue of"we're full". No more buildings, no more second homes, no more apartment houses, no more anything. She would rather here that than hear someone say yes, we want to do affordable housing because that's the politically correct thing to do, but this is just not the right place and we don't know the right place. She can deal with that kind of honesty but she can't deal with people saying it's a great idea but you haven't found the right place yet. BOARD OF COUNTY COMMISSIONERS 2 SPECIAL MEETING JULY 25,2000 Chairperson Harper opened the hearing to public comment. Helen Klanderud is a homeowner who lives on Riverside Drive east of Aspen. She is here today to tell the Board that they have her 100% support for this project for the maximum number of units that could be built there. She agrees with Commissioner Farris on being clear about what everyone wants and what everyone is really saying. She doesn't think this project needs wide streets, curbs and gutters as it is basically a rural area. Perhaps some amenities could be dropped as the Board goes through this process. Peter Gerson recently bought Fritz Benedict's house on Lot 6, Stillwater Ranch Subdivision several years ago. He is a supporter of affordable housing BUT, he is surprised at two things. He is surprised that the County has received a considerable monetary value from the Benedicts. Reading her letters to the County at the time, he said she wanted the rural setting for homes for affordable housing. What she wanted was three or four houses. He is satisfied that the County needs more housing. BUT, what he is concerned with is the lighting that he feels would completely destroy the pastoral setting that is in this most beautiful area. He asked the Board to seriously consider this. Chairperson Harper explained to Mr. Gerson that the County passed a stricter lighting ordinance last November or December that should answer some of his concerns. Tim Semrau informed Commissioner Farris that unfortunately there are few sites that are acceptable for affordable housing projects. One of those is at 7 h and Main Street. Any change does bring the neighbors out and it is difficult to find those acceptable sites. With this site in particular, he believes the problem is one, it's a gift. He feels the Benedict children do have a say in what goes on there. Secondly, he spoke of a compromise that might be financially advantageous. The proposed subsidy cost for this project right now is $3,100,000.00. He spoke about the opportunity to do possibly three things. One was to downsize the project a little, or sell off one single-family lot, appease the Benedicts and maybe get one or two million in revenues and get some deed restricted, category units built. This could mean over$5,000,000.00 to the Housing Fund. He thinks the Board should look into this. Commissioner Clapper thinks this is worth looking into but she is concerned about the expenditure of time and money in going to a detailed submission as there would be a major change. A short discussion ensued on setting a time limit to look into this. Stewart Resnick, a neighbor of this project, said that the issue here is over building on a lot that was given to the County. The County limits everyone else in terms of what they're doing, he said. Why doesn't the County have some reasonable limits? He added that he really doesn't understand the economics of affordable housing, but he thinks someone needs to look again at the economics of this project. BOARD OF COUNTY COMMISSIONERS 3 SPECIAL MEETING JULY 25,2000 Marcia Gorshon stuck up for this affordable housing project. She said that Fritz and Fabi Benedict did not always agree on each other's concept of affordable housing. She doesn't think curbs and gutters and wide streets, as shown in the plan, look right in this environment. She doesn't totally agree with this plan, but she doesn't want the property sold to be built somewhere else. Mr. Novak wanted to respond to yet another comment on the wide streets shown for this project. He informed everyone that the street is only 16 feet wide from car width to car width. Bill (last name inaudible) said he is a perspective buyer of this project. He was curious as to where the 50 or 60 cars would park? He was under the impression that each bedroom would be allowed a car. This gentleman's wife also expressed concern over the number of trees that would be destroyed here. Chairperson Harper said the design team for the project is going to go back and see if they can find a parking plan that does not dictate everything being on the road. Mr. Novak informed the Board that the Code requirement reads 1 space per bedroom up to 2 per unit for cars. This would make the total number of cars lower than 50 or 60. Further discussion about affordable housing, including this project and the program in general, began among the Board members. Commissioner Clapper moved to approve the second reading on the resolution granting approval of Subdivision/PUD Conceptual Submission,Major Plat Amendment, GMQS Exemption and 1041 Hazard Review for lot 1, Stillwater Ranch Subdivision. NOTE: The Board will look into the issues raised before final plat. And,Mr. Novak will be exploring issues of lighting, trees, streetscape and staff will review Mr. Semrau's alternative option he suggested in today's meeting. Commissioner Ireland seconded the motion. Mr. Novak would like to setup a work session in between now and final approval in which he could bring the results of all the work and changes he could show the Board. Chairperson Harper closed the public hearing and called the question. Motion passed unanimously. ADJOURNMENT: The meeting adjourned at 1:10 PM.
